The City Council of the City of Santa Aha ordains as follows: SECTION 1. That Section 2 of Ordinance No. 924 of the City of Santa Ana, as amended by Ordinance No. 985 of the City of Santa Ana, is hereby amended to read as follows: "Section 2. That all sections and provisions of Ordinance No. 839, as amended by Ordinance No. 86S, as amended by Ordinance No. 924, as amended by Ordinance No. 985, except as herein mmended, shall remain and be in force and effect, and all provisions of said Ordinance No. 839 as amended, providing the penalty for a violation thereof, etc., shall be applicable to the provisions hereof. SECTION 3. Thut the City Clerk shall certify to the passage of this Ordinance, and cause the same to be published three times in the "Santa Aha Dat~y Evening Register", a daily newspaper printed, published and generally circulated in the City of Santa Ana, and the same shall take effect and be in force thirty days after the first publication thereof. The City Council of the City of Santa Ana ordains as follows: SECTION 1: It shall be ~lawful for any person, firm or corporation, as principal, agent, officer or employee, to manage, conduct, or permit on any premises owned or controlled by him or it, any public dance between the hours of 12:00 midnight and 6 A.M. of the same day. ~ECTION Z: Any person, firm or corporation, who shall violate any of the provisions of this ordinance, shall be guilty of a misdemeanor, and upon conviction shall be punished by a fine of not exceeding Five Hundred Dollars ($505.00), or by imprisonment in the County Jail for a period of not exceeding six (6) months, or by both such fine and imprisonment. It shall be unlawful for any person, firm or corporation, engaging in the sale of intoxicating liquors, to sell, give away, or deliver to any person, any intoxicating liquor between the hours of 12:00 midnight and $:00 A.M. of the same day. SECTION 2. Any person, firm or corporation, who shall violate any of the provisions of this Ordinance, shall be guilty of a misdemeanor, and upon conviction shall be punished by a fine of not exceeding Five Hundred Dollars ($§0~).00), or by imprisonment in the County Jail for a period of not exceeding six (6) months, or by both such fine and imprisodment. SECTION 5. Ve~elF City Clerk oT the City of Santa Ana 350 ORDINANCE 998 AN ORDINANCE OF THE CITY OF SANTA ANA REGULATING AND PROHIBITING THE SOLICITATION FOR DONATIONS FOR CHARITY, THE PROMOTION AND CONDUCTING OF BAZAARS, SALES OR E~IBITIONS FOR CHARITY, AND pREBCRIBING PENALTIES FOR THE VIOLATION ~5/EHEOF. The Board of Trustees of the City of Santa And ordains as follows: S~CTION 1. It shall be unlawful for any person, firm, association or corporation to make any appeal to the public for a charity, either by soliciting or collecting gifts, contributions, domations or subscr%ptions, or by promoting or conducting any bazaar, sale or exhibition, or by any other means whatsoeverw at any place or to any person in the City of Santa And, unless an application therefor has been filed with and a permit issued by the Board of Trusteee of the City of Santa And, in the manner herein provided. SECTIO~ ~. Any person, firm, association or corporation desiring to make an appeal to the publiS for a charity, either by soliciting donations or subscriptions or by promoting or conducting any bazaar, sale, exhibition, or by any other means whatsoever, at any place, or to any person in the City of Santa Aha, may file an application with the Board of Trustees of the City of Santa And, upon forms to be supplied by the City of Santa Aha, without charge t o the applicant, setting forth the following information: (1) The name and address of the applicant. The exact purpose for which the proceeds of the solicitation, sale, bazaar, exhibition, or other promotion are to be used. (s) The total sum which is sought to be raised and estimated total amount to be expended as compensation or reward for such solicitation, which statement shall be verified by the oath of the person or Chief Officer for whom solicitation is to be made. (4) The names and addresses of all persons who will be in any manner engaged in the work. The bank or place where all or any part of the funds raised by such activity will be placed on depoeit or ~nvested. (6) Such other information in respect to the character, and past and proposed activity of the applicant, as may be necessary or desirable to enable the Chief of Police to make a full and complete investigation. SECTION 5. That no application shall be granted hereunder, where the solicitation expenses or overhead shall exceed ten per cen~ (10%) of the amount sought tS be raised. SECTION 4. The City Council of the City of Santa Ana must act upon all applications filed with it pursuant to the px~vialon~ of this ordinance, not later than ten (10) days after the date on which any such application is filed. Should the said City Council, after a canplete investigation of the applicant and of the representations contained in the application, be of the opinion that the applicant has not stated true facts in his application, or that if a permit should be grante~ to the applicant a fraud would in all probability be perpetrated upon the public, it may refuse to issue a permit to such applicant. Should the City Council be sotisfied that the application is truthful~ that the applicant is scting in good faith, and that the public interest and general welfare will not be injured by the applicant's proposed activity, it shall 351 ~Issue a permit to such applicant to act for such period of time as the applicant shall request, provided, however, that no permit shall be valid for a period of more than sixty (60) days f~om the date of issuance. SECTION 5. Should the City Council of the City of Santa Ana become convinced that the activity of any person, firm, association or corporation in the City of Santa Aha, pursuant to any permit issued by it in accordance w.ith the terms of this ordinance~ is such as to indicate 'that the purposes set forth in the party's application are not being subserved and that the further activity of such person, firm, association or corporation in the City of Santa Aha would operate to defraud the public, it may direct a registered letter to the applicant at the address given upon the application filed with the said City Council, stating that the said permit shall become null and void on an~ after the third (3rd) day from the date on w~hich said letter is deposited in the City of Santa Ana. Said permit shall become null and void on the date named in accordance with the provisions herein. SECTION 62 All ordinances and parts of ordinances of the City of Santa Ana, in confl~c t with the provisions of this ordinance, are hereby repealed. SECTION V. Any person, firm, association, or corporation, viola ting any of the provisions of this ordinance, shall be deemed guilty of a misdemeano~y and upon conviction thereof shall be punished by a fine not exceeding five hundred ($500.00) Dollars or by imprisonment in the County Jail for a term not exceeding six (6) months, or by both such fine and imprisonment. SE.CTION 8. The City Clerk shall certify to the passage of this ordinance, and cause the same to be published three (3) times in the "Santa Ana Daily Evening Register", a daily newspaper, printed, published and generally circulated in the City of Santa Ana, and the same shall take effect and be in force thirty days after the first publication thereof. AN ORDINANCE PROHIBITING THE USE OF WHITE CANES, EXCEPT BYP~DESTRTANSWHOLLY OR PARTIALLY BLIND, AND PROVIDING PRedileCTION AGAINST HIGHWAY ACCIDNNTS TO SUCH PERSONS, AND PROVIDING PENALTIES FOR THE VIOLATION The City Council of the City of Santa Aha o~dains aa follows: SECTION 1. It shali'be unlawful for any person, except persons wholly or partially blind, to carry er use on the public streets of the City of Santa Aha, any ca~es or walking-sticks which are white in color, or white with red end or bottom. Such canes or walking-sticks may be used on the streets and other public places of the City of Santa Aha by.persons wholly or partially blind, as a means of protecting them and for the purpose of identifyi~g them by drivers of vehicles, operators of motor-driven vehicles, and other pedestrians with whom they come in contac~ on such streets and public places. SECTION 2. Any driver of a vshicle, operator of a motor-driven vehicle, or pedest-~tam who is not wholly or partially blind who a~proaches or comes in contact with a person wholly or partially blind, carrying a cane or walking-stick, white in color, or white with red end, shall come immediately to a full stop and take such precautions before proceeding am may be necessary to avoid accident or injury to the person so carrying a white cane or walking-stick. SECTION 3. Any person other than a person wholly or partially blind, who shall cax~y such a cane or walking-stick, such as is described in Section 1 hereof, contrary to the provisic~s of this ordinance, or who shall fail to heed the approach of a person so carrying such a white cane or walking-stick, or ~ne white with red end, or who shall fail to come to a stop upon approaching or coming in eo~mae~ with a person so carrying such a cane or walking-stick, or who shall fail to take precautions against accident or injury to such a person after coming to a stop as provided for herein, shall be guilty of a misdemeanor, and upon con- vio~ion thereof shall be punished by a fine not to exceed Five Hundred Dollars ($800.00), or by~aprisonmen~ in the County Jail of the County of Orang~ for a period not exceeding six (8) months, or by both such fine and imprisonment; and each such person ~s principal, agent or otherwise, shall be deemed guilty of a separate offense for each day during any portion of which the violation of, or failure, neglect or refusal to comply with any of the provisions of this ordinm~ce is cow--itted, continued or permitted by such ~rson. ORDINANCE NO. 995 AN ORDINANCE FOR SAFEGU~{EING LIFE AND PROPARTY BY PROHIBITING THE SALE AT RETAIL, THE DISPOSAL OF B~ GIFT OR AS PRAZ~IUMS, AND THE LOANING OR RENTING OUT FOR USE, OF CERTAIN ELECTRICAL MATERIALS, DEVICES, APPLIANCES AND EQUIPMENT UNLESS APPROVED FOR RETAIL, SALE, INSTALLATION AND USE; PROVIDING FOR THE APPROVAL OF SUCH ELECTRICAL MATERIALS, DEVICES, APPLIANCES AND EQUIPMENT IF THE SAME ARE FOUND TO BE IN CONFORMITY WITH THE LAW AND WITH APPROVED METHODS OF CONSTRUCTION FCE SAFETY TO LIFE AND PROPERTY; PROVIDING THAT THE MAKER'S NAME, TRADE-MARK, 0R OTHER IDENTIFICATION SYMBOL SHALL BE PLACED THEREON, TOGETHER WITH APPROPRIATE RATINGS, NECESSARY TO DETERMINE THE USE FOR WHICH INT~DED, AND THAT SAME SHALL NOT BE REMOVED. The City Council of the City of Santa Aha ordains as follows: SECTION 1. DE~INITION. The term "Sale at retail" wherever used in this ordinance, shall mean any sale direct to the ultimate user or consumer, irrespective of whether the principal business of the seller is selling at wholesale or at retail. SECTION 2. SCOPE. The provisions of this ordinance shall apply to the following electrical materials, devices, appliances and equipment: (a) All electrical materials, devices and equipment which are intended to be used in buildings as electrical conductors or which may be necessary to make an electric wiring installation in a building in conformity with the ordinances in force in the City of Santa Aha, but not including any generating, transforming or converting device, except as hereinafter specified, nor any device for measuring or recording current, voltage or power. (b) All lighting fixtures and portable lighting equipment intended for use in buildings. (c) All incandescent, arc, vapor and gas-tube (d) All transformers operating at 100 volts or more between any two con- ductors and having a rated capacity not exceeding 150 watts. (e) All electrically operated toys. (f) All radio receiving sets. (g) All electrically heated cooking equipment intended for domestic use, and electrically heated appliances in individual capacities not exceeding 10,000 (h) All other electrical aPpliances and equipment (i) All electrically illuminated signs. (J) All portable motion picture projectors. intended for domestic use. SECTt. 0N 3. APPROVAL REQUIRED. Every person, firm o~ corporation, before selling, offerin~ for sale, o._~r exposin~ ~.or sale, a~t retail or before the disposing o_~_f b_] gift, ~ premiums or in any similar manner, or before the loaning or renting out for use of, any electrical material, device, appliance or equipment specified in Section 2, shall first determine if such electrical material, device,'appliance o_~r equipment complies with the pF. ovisions o__f this ordinance and is approved for retail~sale, install- ation and use in the City of Santa Aha; and it shall be unlawful for any person, firm or corporation, or any partner, officer, agent or employee thereof, to sell, offer for sale, or expose for sale, at retail, or to dispose of by gift, as a premium or in any similar manner, or to loan or rent out for use, any such electrical material, device or equip- ment which is not approved for retail sale, installation and use in the City of Santa Aha 355 ~nd it shall be unlawful for any person, firm or corporation, or any partner, officer, a~ent or employee thereof, to sell, offer for sale, or expose for sale, · at retail, or to dispose of by gift, as a premium er in any similar manner, or to loan or tc rent out for use, any such electrical material, device or equip- ment which is ~ot approved for retail sale, installation and use in the City of Santa Aha or which does not comply with all other provisions of this ordinance. 'SECTION A. N~_~.PLATE MARKINGS. Ail electrical materials, devices,* appliances and equipment specified in Section 2, which are sold, offered for sale, or exposed for ~ale, at retail, or disposed of by gift, aa premiums or in any similar manner, or lo.shed or rented out for use, shall have the maker's namet trade-mark, or other identification symbol placed thereon, together with such other markings giving voltage, current, wattage, or other appropriate ratings as may be necessary to determine the character of the material, device, appliance er equipment and the use for which ~t is intended; and it shall be unlawful for any person, firm or corporation to remove, alter, change or deface the maker's name~ trade-mark or other identification symbol, or any of the necessary rating markings required by this ordinances SECTION 5. APPROVAL ~Y ELECTRICAL INSPECTOR. The Electrical Inspector of the City of Santa Aha is hereby authorized and empowered to enforce all of the provisions of this ordinance, and to make, adopt and promulgate such reales, regulations and SPecifications as may be necessary or useful in determining conformity of electrical materials, devices, appliances and equipment, as spec- ified in Section 2, with approved methods of construction for safety to life and property, and shall approve for retail .sale, installation and use in the City of Santa Aha such electrical materials, devices, appliances and equipment, and only such as are found to be in conformity With the law and with approved methods of construction for safety to life and property. ConfoEnity of electrical materials devices, appliances and equipment~wtth the standards of Unde~writersf Laboratories Inc., as approved by the Amer£can Standards Association, and with other safety standards approved by the American S~andards Association, shall be prima facie evidence that such electrical materials, devices, appliances and equipment comply with approved methods of constr~ction for safety to life and property. The Electrical Inspector shall prepare or designate a list of electrical materialst devices, appliances and equipment that are approved for retail sale, installation and use in the City of San~a Ana, and a copy ~f such list shall be kept on file in the office of the Electrical Inspector and shall be accessible for public reference during the regular office hours. SECTION 6. PROVISIONAL APPROVAL. The Electrical Inspector is hereby authorized and empowered to grant provisional approval for the retail sale, installation and use of any electrical material, device, appliance or equipment which has been submitted to him for approval and which, in his Judgment, is reasonably safe but has not yet been finally approved because no applicable rules, regulations and specifications have been made, adopted and promulgated in accord- ance with SeCtion 5 of this Ordinance, or because, in the opinion of the Electrical Inspector, further examination or experiemoe is' necessary or desirable before making the final decision as to approval. Provisional approval shall continue in force only for such time as is necessary to definitely determine whether the material, device, appliance or equipment complies with approved methods of construction for safety to life and proper~y. Any individual articles of material, deVices, appliances or equipment which have been sold at retail under provisional approval shall thereafter be considered as approved for installation and use, even though the provisional approval shall have been withdrawn and no final approval of the particular type of material, device, appliance or equip- ment shall have been granted. SECTION 7. LIABILITY F~ DAMAGES. This ordinance shall not be construed to relieve from or lessen the responsibility or liability of any party owning, operating, controlling or installing any electric materials, devices, appliances or equipment for damages to persons or property caused by any defect therein, nor shall the City be held as assuming any such liability by reason of the approval of any material, device, appliance or equipment authorized herein. SECTION 8. PENALTY. Any person, firm or corporation, or any partner, officer, agent or employee thereof, violating any of the provisions of this ordinance, shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not more than three hundred dollars ($300.00), or by imprisonment in the County Jail of Orange County for a period of not more than ninety (90) days, or by both such fine and imprisonment. SECTION 9. VALIDITY. If any sectian, sub-section, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have passed this ordinance and each section, sub-section, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, sub-sections, sentences, clauses or phrases be declared unconstitutional. SECTION 10. REPEAL OF CONFLI~..TING ORDINANCES. All ordinances or part of ordinances conflicting with the provisions of this ordinance are hereby repealed. SECTION ll. DATE TO TAKE EFFECT. The City Clerk shall certify to the passage of this Ordinance by the City Council of the City of Santa Ana, and cause the same to be published three times in the "Santa Ana Daily Evening Register", a daily newspaper, printed, published and generally circulated in the City of Santa Aha, and the same shall take effect and be in force thirty days after the first publication thereof. The City Council o£ the City of Santa Aha, California, ordains ae follows, to-wit: THAT ~.~HEREAS, the City of Santa Aha, California, did on the 28th day of December, 1914, by Ordinance, el~mt and determine to avail itself of the provision: of the Act of the 27th day of March, 1895, and subsequent amendments thereto relative to the assessment and collection of taxes for the municipal corporation of the City of Santa Aha, California, and did in accordance therewith on or about said date file with the auditor of Orange County, California, a verified copy of said Ordinance pertaining thereto as provided by law; and ~HEREAS, the County Auditor of the County of Orange, State of Californi~ on the 15th day of August, 1954, filed his statement in writing with the City Council of the City of Santa Ana, California, showing the total value of all property within the corporate limits for the year 1934-1935, and equalized and collected by the Board of Supervisors of sum as shown by the assessment rolls for of operative property; and Orange County, California, and fixed the said year at $15,968,815.00, exclusive WHEREAS, the City Council elects to levy a total tax for the sum of $1.75 on each $100.00 of the taxable property of said City as provided by law, the amount of money ascertained and fixed to carry on the various departments of the City of Santa Aha, and to pay the bonded indebtedness falling due for the current year 1934-35, is the fixed sum of $279,454.26; and WHEREAS, said sum is to be apportioned among the various departments of the said City of Santa Ana, and placed in the general and special funds to pay current municipal expenses on the assessed value of all the real and personal property within such municipality, over and above the several sums to be raised as provided by law. SECTION 1. That the total valuation of the taxable propert~ of the City of Santa Ana of $15,968,815.00 shall be used as a basis for the lewy of the taxes of the City of Santa Aha, at the same time and in the same manner in which County levies are made and collected. SECTION 2. That the rate of taxation for municipal purposes and to pay the bonded indebtedness and interest of the City of Santa Aha, California, for the current year 1934-35 is hereby fixed at $1.75 on the taxable property of said City and that said amount of $279,454.26 in the aggregate and the rate stun of $1.75 on each $100.00 of the taxable property of said City is hereby levied upon all the taxable property as ascertained by the County Assessor and equalized by the Board of Supervisors of Orange County, California, as aforesaid, and which said rate so fixed shall be apportioned among special funds to pay the current expenses, bonded indebtedness and interest and other indebtedness of said City, falling due for the current fiscal year 1934-35, and other several sums to be raised as fixed and pro- vided by law, as follows, to-wit. The word "person" as used herein shall include any corporation, association, society, club, co-partnership or individual. SECTION 2. It shall be unlawful for any person to solicit employment for himself or for any other person, either directly or through some other person acting on his behalf, to prosecute, collect, settle, compromise or to negotiate for the settlement compromise or collection of any tort claim, on behalf of any tort claimant, in which he himself has no pecuniary interest arising from such to~t. SECTION 3. The provisions of this ordinance shall not be construed to prevent joint tort claimants from negotiating with each other for the purpose of combining respective claims or actions against the tort feasor. SECTION 4. It shall be unlawful for any person, association of persons or corporations, to conduct or assist in co ~ucting any dance or dances in any public cafe or restaurant, or in any public hall or room where _ntoxmca~mng liquors are sold in the City of Santa Aha. SECTION S. It shall be unlawful for any person to take any form of alcoholic liquors into any public dance hall or into any premises where a public dance is held, and it shall be unlawful for any person in charge, or assisting in the con- ducting of any public dance hall, or any public dance, ~o permit any person therein amc possession, or to permmt any intoxicated, who has any fo~.. of alcoholic liquor in ' '~ ' boisterous or disorderly person to enter, be, or remain in, or to assist in any public dance hall or public dance, and it shall be unlawful for any person in an intoxicated condition to enter, be, or remain in Shy public dance hall or public dance, or for any person to conduct hmm~elf in a bois~e~ous or public dance. ORDINANCE NO. 1004 AN ORDINANCE OF THE CITY OF SANTA ANA REGULATING THE USE AND PROHIBITING THE OBSTRUCTION OF PUBLIC HIG~.'fAYS AND SID~VALKS. The Board of Trustees of the City of Santa Aha ordains as follows: SECTION 1. It shall be unlawful for any person to loiter or to stand or sit in or upon any public highway, alley, sidewalk, or cross-walk, so as to in any manner~hinder or obstruct the free passage therein or thereon of persons or vehicles passing along the same, or so as in any manner to annoy or molest persons passing along the same. SECTION 2. It shall be unlawful for any person to loiter or to stand or sit in or at the entrance of any hall, theatre or place of public assemblage, so as in any manner to obstruct such entrance. SECTION 3. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punishable by a fine not exceeding ~100.00, or by imprisonment in the County Jail for a period of not exceeding thirty (30) days, or by both such fine and imprisonment. SECTION 4. The existence and maintenance of conditions contrary to the provisions of this Ordinance constitute a menace to the public peace, health and safety of the citizens of Santa Aha. Therefore this ordinance is urgently required for the immediate preservation of the public peace, heslth and safety~ and is hereby declared to be an emergency ordinance. SECTION 5. The City Clerk shall certify to the passage of this ordinance· a nd shall cause the same to be published once in the "Santa Aha Daily Evening Register"· a daily newspaper· printed and published and circulated in the City of Santa Aha, California, and thereupon and thereafter said Ordinance shall take effect.
