HomeMy WebLinkAbout62-110RESOLUTION NO. 62-110 INITIATING PROCEEDINGS FOR ANNEXATION OF TERRITORY TO THE CITY OF SANTA ANA, DESIGNATING AN APPROPRIATE NAME FOR SAID TERRITORY OF "NEWPORT AND DYER, S.E. ANNEX" AND GIVING NOTICE OF PROTEST HEARING THEREON WHEREAS, a map and description were submitted to the Orange County Boundary Commissionby the owners of more than twenty-five (25%) percent of said territory together with the statement that said description was intended to be used in annexation proceedings to the City of Santa Ana, California; and WHEREAS, said Boundary COm~mission met in regular session at 11:00 A.M. on the llth day of June, 1962, and after consideration of the report from the County Surveyor's office to the effect that the principal portion of said description had been approved as to definiteness and certainty of the proposed boundaries at prior meetings, but that the reference to Book and Page recording data regarding a deed had been omitted, and that said deed conveyed property at a point where said description joined the San Diego Freeway; on motion duly seconded and carried, said Boundary Commission found that the boundaries of the proposed annexation were not definite and certain and caused a report of said action with respect to the definiteness and certainty of said proposed boundaries to the propo- nents to be prepared; and WHEREAS, said description was then amended to include said recording data, the omission of which had been the sole basis for finding said boundary not definite and certain, and said amended description is hereinbelow set out. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby initiates proceedings for annexation of said to the City of Santa Ana, California, for -1- territor~ herein described, the following reasons: 1. That said territory is in need of municipal services to afford~ an opportunity for development. 2. That said territory can be served by the City of Santa Ana with municipal services of the highest quality anywhere obtainable. 3. That it is to the mutual advantage and benefit of the City and the landowners that said territory become a part of Santa Ana. BE IT FURTHER RESOLVED: That the City Council hereby declares its intention to annex all of the territory hereinbelow described under the provisions of the Annexation of Uninhabited Territory Act of 1939; hereby finds and declares that said territory is uninhabited within the meaning of Government code Section 35303 on the date of the adoption of this Resolution; and that said territory is contiguo~s to the City of Santa Aha, lies in the County of Orange, State of California, and is described as: -2- ~EW~0RT AND DYER, S. ANNEX" is hereby designated as an appropriate name by which said territory shall be known for the purpose of this annexation. BE IT FURTHER RESOLVED: That notice is hereby given that July 23, 1962, at the hour of 7:30 P.M. in the Council Chambers, City Hall, Third and Main Streets, Santa Aha, California, is the time and place fixed at which said Council will hear written protests against this annexation made by any person owning property within said terri- tory. At any time before said hearing, any owner of real property within said territory may file written protest against this proposed annexation. Such protest shall state the~une of the owner of the property affected and the description and area of the property in general terms, all as provided for in the California Government Code, Section 35312.
