HomeMy WebLinkAbout1943 (#1124-1133)281 ORDINANCE NO. 1124 AN ORDINANCE AMENDING SEC. 89, RELATING TO CONTRACTORS, OF ORDINANCE NO. 658, ENTITLED "AN ORDINANCE PROVIDING FOR THE LICENSING OF BUSINESS, SHOWS, EXHIBITION AND GAMES CONDUCTED OR CARRIED ON IN THE CITY OF SANTA ANA, FIXING THE RATE OF LICENSE THEREFOR AND PROVIDING FOR THE COLLECTION THEREOF" AND REPEALING SECTIONS 4 and 5 OF ORDINANCE NO. 917 OF SAID CITY, ENTITLED "AN ORDINANCE OF THE CITY OF SANTA ANA, CREATING THE OFFICE OF PIASTER INSPECTOR, REGUI~TING PLASTERING WITi~IN THE CITY OF SANTA ANA, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH". THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS: SECTION 1: That Sec. 89 of Ordinance No. 658, entitled "AN ORDINANCE PROVIDIN FOR THE LICENSING OF BUSINESS, SHOWS, EEHIBtTION AND GAMES CONDUCTED OR CARRIED ON IN THE CITY OF SANTA ANA, FIXING THE RATE OF LICENSE THEREFOR AND PROVIDING FOR THE COLLECTION THEREOF", be and the same is hereby amended so as to read as follows: "Sec. 89. For every person, firm or corporation con- ducting, managing or carrying on the business of painting, plastering, lathing, brick masonry, floor finishing or p&lishing, interior decorating, landscaping, lawn renovating, wall papering, or contracting in any of said business, and all other such building contractors engaged in contract work on buildings or houses as primary, independent, or sub-contractors, the sum of $25.00 per annum, payable annually in advance on the 2nd day of January of each year, and the full license fee shall be payable for any unexpired portion of any calendar year when any such license fee becomes payable on the commencement of business during any calendar year. This section shall not apply to plumbing or electrical contractors who pay licenses under other ordinances of the City of Santa Aha." SECTION 2: That Sec. 4 and Sec. 5 of Ordinance No. 917, entitled "An ORDINANCE OF THE CITY OF SANTA ANA, CREATING THE OFFICE OF PLASTERING INSPECTOR, REGULATING PLASTERING WITHIN THE CITY OF SANTA ANA, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HERA~ITH" is hereby repealed. SECTION 3: Ail licenses issued prior to the effective ~ate of this Ordinance under Sec. 89 of Ordinance No. 658, now in effect, shall continue in effect until the effective date of this ordinance, and upon the taking effect of this ordinance, the licenses payable under Sec. 89 of said Ordinance No. 658 for the calendar year of 1943 shall become immediately due and payable. SECTION 4: The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published in three consecutive ~ sues of the SANTA ANA REGISTER, a newspaper printed, published and circulated in the City of Santa Aha, and hereby designated for that purpose. NOES, TRUSTEES None ABSENT, TRUSTEES None (SEAL) Erma Keeler City Clerki 283 ORDINANCE NO. 1125 AN ~RDINANCE AMENDING ORDINANCE NO. 984, ENTITLED "AN ORDINANCE OF THE CITY OF SANTA ANA, FIXING THE LICENSE FEES TO BE PAID ON DOGS, ESTABLISHING THE OFFICE OF POUNDKEEPER, AND SETTING OUT THE DUTIES TO BE PERFORMED BY HIM AND FIXING HIS COMPENSATION." THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS: SECTION l: That Section 3 of Ordinance No. 984, entitled "AN ORD1-NANCE OF THE CITY OF SANTA ANA, FIXING THE LICENSE FEES TO BE PAID ON DOGS, ESTABLISHING THE OFFICE OF POUNDKEEPER, AND'SETTING OUT THE DUTIES TO BE PERFORMED BY HIM AND FIXING HIS COMPENSATION", is hereby amended so as to read as follows: "Sec. 3: That it shall be the duty of the Poundkeeper to collect the licenses above provided for during each fiscal year, and when so collected he shall deliver to the person paying the license a tag, which shall be stamped with the fiscal year for which it is issued, and numbered. Such tag must be attached to the body of the dog for which it is issued, by a collar or harness on which the name and address of the owner is inscribed. The Poundkeeper shall keep a record of the licenses collected, and the tags delivered and to whom, with a brief description and name of the dog for which the same was issued and the name of the owner thereof and his address. He shall make a report to the Board of Trustees at its regular monthly meeting of the number of tags delivered and licenses collected, and shall pay to the City Treasurer moneys by him collected during the previous calendar month for licenses so issued. He shall receive such monthly compensation as shall be from time to time fixed by the City Cotmcil on a monthly salary basis." SECTION 2: That Section 5 of said Ordinance No. 984 is hereby amended so as to read as follows: "Sec. 5: In order to redeem or buy such dog, it will be necessary to pay the Poundkeeper $1.00 for taking up the dog, $1.00 f~ redemption thereof, and twenty-five cents per day For keeping and feeding the same. All moneys collected by the Poundkeeper as payment for such services, and moneys received from the sale Of unredeemed dogs by the Poundmaster shall be paid to the City Treasurer in the same manner and at the same time as hereinabove provided in Section 3 hereof for license fees." SECTION 3: The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published in three consecutive issues of the SANTA ANA REGISTER, a newspaper printed, published and circulated in the City of Santa Ana, and hereby designated for that purpose. THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS: SECTION l: That Section 4 of Ordinance No. lllO of the City of Santa Ana entitled "AN ORDINANCE OF THE CITY OF SANTA ANA RELATING TO AIR RAID PRECAUTIONS" is hereby amended so as to read as follows: "SECTION 4: The maintenance or leaving of any illumination at night from sunset to sunrise, except within a blackout structure, without provision for its extinguishment wi thin one minute by a competent person over the age of eighteen years in attendance at the place where such illumination is controlled, is hereby prohibited. It is provided, however, that this section shall not be deemed to prohibit the maintenance of any warning light or lantern in'and about any excavation or obstruction in any public way or place, or at any place of danger upon public or private property, when such warning light or lantern is accessible and extinguish- able at the time of an air raid warning signal by any person, and when such warning light or lantern is required to be maintained by any other law or ordinance and is so designed as to emit no illumination upward in excess of twelve degrees from the horizontal and conforms to the standards prescribed bY the Ninth Regional Civilian Defense Board and is approved by the Com~n~nding General of the Western Defense Command and Fourth Army."' SECTION 2: The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the SANTA ANA REGISTER, a daily newspaper printed, published and circulated in the City of Santa Ana and hereby designated for that purpose. The City Council declares that this ordinance is adopted as an emergency measure and shall take effect from and after its adoption. THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS: SECTION 1: That Ordinance No. 1052 entitled, "AN ORDINANCE ESTABLISHING WATER RATES IN THE CITY OF SANTA ANA, PRESCRIBING RULES AND REGU~ATIONS COVERING CONSUNPTION OF WATER AND FIXING A PENALTY FOR THE VIOLATION THEREOF, AND REPEALING ORDINANCES IN CONFLICT HEREWITH", as amended by Ordinances Nos. 1087, 1072, 1084 and 1119, is hereby amended by amending Section 2 thereof to read as follows: "SECTION 2: The following rates and compensation are hereby fixed and established as the monthly rates and compensa- tion to be charged and collected by the Water Department of the City of Santa Ana for water furnished by said department: A minimum charge shall be made as a base rate, readiness follows: to serve charge for each size of service MINIMUM METER RATES For each 5~8'" o~ 3/4" service $ 1.00 For each l" service 1.25 For each 1~''~ service 2.25 For each 2' service 3.25 For each 3" service 4.75 For each 4' service 7.25 For each 6' service 9.75 That the to be charged as follows: standby, or connection as actual meter rates to be charged when the amount is not less than the foregoing minimum rates are METER RATES 1. For all over 50,000 cu.ft, used in any one month at the rate of $.08 per 100 cu. rs. $1.00 FLAT RATES Due to the shortage of materials and t,,~ility of the City of Santa Ana to acquire necessary meters, the Superintendent of the Water Department is hereby authorized, when in his ~pinion it is necessary and advisable so to do, to male and install services without the installation of meters, until such time as the Santa Ana Water Department shall have in its possession for installation water meters of a suitable size and capacity at which time said services shall be metered, and the meter rates paid. TRUSTEES None TRUSTEES None ORDINANCE NO. 1129 AN ORDINANCE AMENDING ORDINANCE N0~llll ENTITLED "AN ORDINANCE OF THE CITY OF SANTA ANA PROVIDING FOR THE INSTALLATION, REGULATION AND CONTROL OF THE USE OF PARKING METERS", AND REPEALING SECTIONS 4 and 10 THEREOF. THE COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: Section 1: That Sections 4 and 10 of Ordinance No. 1111 entitled "An Ordinance of the City of Santa Ana Providing for the Installation, Regulation and Control of the Use of Parking Meters" be, and the same are hereby repealed. Section 2: That Ordinance No. 1111 entitled "An Ordinance of the City of Santa Aha Providing for the Installation, Regulation and Control of the Use of Parking Meters" be, and the same is hereby amended by adding a new section thereto at the end of Section 6 thereof, which saidnew section shall be numbered Sa, and by adding a new Section 10 thereto, which sections shall read as follows: Section 6a: It shall be the duty of each police officer to take the number of any meter at which any vehicle is overparked, as provided in this ordinance; the State vehicle license of such vehicle; the time and date of such overparking, and the make of such vehicle; and issue, in writing, a citation for illegal parking in the same form and subject to the same procedure provided for by the ordinances of the City of Santa Ana and the laws of the State of California applicable to the traffic violations within said City. Any operator or owner of a vehicle ~ whom a citation has been issued may, within twenty-four hours of the time of the issuance of said citation, pay to the Clerk of the City Court as a penalty for, and in full satisfaction of, such violation the sum of fifty cents ($.50). Said payment may be made in person or by mailing said sum to the Clerk of the City Court, City Hall, Santa Ana, California, within said period of twenty-four hours. The failure of such owner or operator to make such payment within said twenty-four hours shall render such owner or operator subject to the penalties hereinafter provided for violation of the provisions of this ordinance. Section t0: Any person vi~lati~g any of the provisions of this ordinance shall be deemed gufltF~O~ a mfsdemeanor~ and upon conviction thereof, shall be pudished by a fine of not less than $1.00, nor more than $50.00, or by imprisonment in the County Jail for not more than five days, or by both such fine and imprisonment. THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS: THAT WHEREAS, the City of Santa Ana, California, did, on the 28th day of December, 1914, by Ordinance, elect and determine to avail itself o£ {he pro- visions of the Act of the 27th day of March, 1898, and subsequent amendments thereto, relative to the assessment and collection of taxes for the municipal corporation of the City of Santa Aha, California, and did, in accordance therewith on or about said date, file with the Auditor of Orange County, California, a verified copy of said Ordinance pertaining thereto as provided by law; and WHEREAS, the Cottnty Auditor of the County of Orange, State of California on the 6th day of August, 1943, filed his statement in writing with the City Co~cil of the City of Santa Ana, California, showing the total value of all property within the corporate limits for the year 1943-1944, and equalized and collected by the Board 0f Supervisors of Orange Comaty~ California, and fixed the sum as shown by the assessment rolls for said year at $22,85?,305.00, exclusive of operative property, and showing the total value of all property belonging to public utilities and used as operative property of such public utilities within th, corporate limits of said City for the year 1943-1944, as determined and equalized by the Board of Equalization of the State of California, amounting to the sum of $~,320,440.00, which said amounts make a total assessed valuation for tax purposes within the City of Santa Ana of the sum of $25,1VV,745.00; and WHEREAS, the City Council elect to levy a total tax for the s~mm of $1.74 on each $100.00 of the taxable property of said City as provided by law, the amoun' of money ascertained and fixed to carry on the various departments of the City of Santa Aha and to pay the bonded indebtedness falling due for the current year 1943. 1944 is the fixed sum of ~904,443.17; and WHEREAS, said sum is to be apportioned among the various departments of the said City of Santa Aha and placed in the general and special funds to pay current municipal expenses on the assessed value of all the real and personal property within such municipality, over and above the several sums to be raised as provided by law; SECTION 1: That the total valuation of the taxable property of the City of Santa Ana of $25,177.745.00 shall be ~sed as a basis for the levy of the taxes of the City of Santa Aha, at the same t~me and in the same manner in which County levies are made and collected. SECTION 2: That the rate of taxation for municipal purposes and to pay the bonded indebtedness and interest of the City of Santa Aha, California, for the current year 1943-1944 is hereby fixed at $1.74 on the taxable property of said City, and that said amount of $904,443.17 in the aggregate, and the rate sum of $1.74 on each $100.00 of the taxable property of said City is hereby levied upon all the taxable property as ascertained by the County Assessor and equalized by the Board of Supervisors of Orange County, California, and as ascertained and equalized by the Board of Equalization of the State of California, as aforesaid, and which said rate so fixed shall be apportioned among special funds to pay the current expenses, bonded indebtedness and interest and other indebtedness of said City, falling due for the current fiscal year 1943-1944, and other several sums to be raised as fixed and provided by law, as follows, to-wit: For the General Fund $.66 on each $100.00 of the taxable property of said City; For the Street Fund, $.24 on each $100.00 of the taxable property of said City; For Sewer Fund $.03 on each $100.00 of the taxable property of said City; City; For the Fire Fund, $.26 on each $100.00 of the taxable property of said For Parks, $.03 on each $100.00 of the t~xable property of said City; F~r the Library Fund, $.15 on each $100.00 of the taxable property of City; For the North Flower Street Bridge Bonded Indebtedness Fund, $0.001 on, e~ch $100.00 qf the taxable property of said City; For the Sewer Bonded Indebtedness No. 2 Fund, $0.005 on each $100.00 of the taxable property of said City; For the Fire Department Bonded Indebtedness No. 2 Fund, $0.01 on each ~100.00 of the taxable property of said ~it~. For Santa Aha Main Sewer Line Bond Fund, $0.03 on each $100.00 of the taxable property of said City; For Joint Outfall Sewer Bond Fund, $0.03 on each $100.00 of the taxable propert of said City; For Electric Fire Alarm System Bond Fund $0.003 on each $100.00 of the taxable property of said City~ For East Fire Engine House Bond Fund, $0.003 on each $100.00 of the taxable property of said City; For Joint Outfall Sewer Maintenance Fund, $.03 on each $100.00 of the taxable property of said City; For West Fire Engine House Bond Fund, $0.002 on each $100.00 of the taxable property of said City; For Fire Apparatus. Bond Fund, $0.004 on each $100.00 of the taxable property of said City; For West Fifth Street Improvement Bond Fund, $0.005 on each $100.00 of the taxable property of said City; For Joint Outfall Sewer Extension Bond Fund, $0.04 on each $100.00 of the taxable property of said City; For the purpose of paying for the lands purchased or to be purchased at tax sales for delinquent assessments and taxes under Street Improvement Bond Act of 1915, SO.10 on each $100.00 of the taxable property of said City; For the City Hall Bonds No. 3 Bonded Indebtedness Fund, $0.02 on each $100.00 of the taxable property of said City; For the North Main Street Bridge Bonded Indebtedness Fund, $0.006 on each $100.00 of the taxable property of said City; For Water Bond No. said City; For Water Bond No. said City; For Water Bond No. said City; For Water Bond No. said City; Fund, Fund, Fund, Fund, $0.01 on each $100.00 $0.008 on each $100.00 of the $0°005 on each $100.00 of the $0.03 on each $100.00 of the taxable property of taxable property of taxable property of of the taxable property of SECTION 3: The City Clerk is hereby instructed to immediately submit a certified copy of this Ordinance to the County Auditor of Orange County, Cal~fornia. SECTION 4: That this City Council, by unanimous vote, do hereby elect to levy a total tax, during the fiscal year of July l, 1943, to June 30, 1944, for all purposes provided in Subdivision 9 of Section 764 of an act of the legislature entitled "An act to Provide for the Organization, Incorporation and Government of Munictpa~ Corporation", Statutes of 1883, page 9Z, as amended, but exclusive of the tax for library purposes and for payment for property sold under Bond Act of 1915, and bond, interest and sinking fun~ purposes, in excess of One Dollar, but not in ~xcess of One Dollar and Twenty-five cents ($1.25) on each one hundred dollars of the assessed value of all real and personal property within the said City of Santa Aha, as set forth in this Ordinance. SECTION $: The City Clerk shall certify to the passage of this Ordinance and shall cm%~e the same to be published in three consecutive issues of the Santa Aha Register, a newspaper printed, published and circulated in the City of Santa Aha, and hereby designated for that purpose. This Ordinance shall take effect thirty (~0) days from and after its adoption.
