HomeMy WebLinkAbout62-132RESOLUTION NO. 62-132 OV:LL~b%iN~ TH~· ~PLJZ~,,IN=~' -~ CO.~n~olON~-~ HiT Ai?LiCi?ION ;0. 107 SUBJECT TO m~":,:~--, ~ WHEREAS, after hearing on Notice, the Planning Commission denied a Conditional Use Permit on Conditional Use ~Permit Application No. 107 filed by EDW.~RD B. ~ ITAKER and DOROTHY L. ~,~ITAK~ to convert their garage at their residence at 1026 S. Driftwood Drive, Santa Aha, California into a nursery to care for six totally handicapped retarded children on a 2h hour care basis. These children were to be crib size and never ambulatory; and WHEREAS, Appeal Application No. 63 was duly filed by EDWARD B. WHITAKER requesting a hearing on said Conditional Use Permit Application No. lO? before the City Council and appealing the denial of said Conditional Use Permit by the Planning Commission; and WHEREAS, The City Council a~%er public hearing on Notice, after careful consideration of the statements contained in and the materials accompanying the Application, the testimony offered at the hearing, the examination all the facts established and after determining that said Conditional Use Permit Application meets the require- ments of Section 9250.8 of the Santa Ana Municipal Code, it has been determined that the Planning Commission's decision should be overruled and that said Conditional Use Permit should be granted subject to certain conditions. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby grants a Conditional Use Permit on Conditional Use Application No. lO7 to permit the establishment of a six-guest infirmary for physically ~d/or mentally handicapped children in the R-1 District on certain land situated in the City of Santa Ana, County of Orange, State of California and descri0ed, as: Lot 78 of Tract No. 3528 as shown on a map recorded in Book 121, p~les 32, 33 and 34 of Miscellaneous Maps, Records of Orange County, California subject to conditions as follows: That the total occupancy of the residence at 1026 S. Driftwood Drive be limited to not more than six handicapped children and the immediate family of the applicant (meaning ~.~. and Mrs. '~aitaker and their natural or legally adopted children.) e That an appropriate solid six foot wall or fence be constructed around the entire rear yard area of the property so as to protect the privacy of the handicapped children and the ~nitaker family as well as that of the adjoining families residing in neighooring residences. That Conditional Use Permit No. 107 is granted personally to the applicant, DOROTHY L. WHITAKER and that this Conditional Use Permit No. 107 shall not be transferable or assignable to any other person or party. That the applicant at all times comply with all applicable regulations of the State Department of Mental Hygiene, County Welfare Department, and City Building Code. That this Conditional Use Permit No. 107 is granted only for a period of one year from its effective date, at which time the applicant may request an extension of time for a period as determined by the City Council of the City of Santa Aha without applying for a new Conditional Use Permit.
