HALLORAN SUBJECT TO CONDITIONS WHEREAS, after hearing on Notice the Zoning Administrator denied a Variance on Variance Application No. 1660 filed by BILLEE BYARS HALLORANand TERRENCE H. HALLORAN to expand the pres- ent store area of a bookstore situated on the Northwest corner of Washington Avenue and Spurgeon Street in an R-3 District; and WHEREAS, the Planning Commission affirmed the aforesaid action by the Zoning Administrator; and WHEREAS, Appeal Application NO. 66 was duly filed by BILLEE BYARS HALLORAN and TERRENCE H. HALLORAN requesting a hearing on said Variance Application No. 1660 before the City Council and ap- pealing the denial of said Variance by the Zoning Administrator; and WHEREAS, the City Council after public hearing on Notice, after careful consideration of the statements contained in and the materials accompanying the Application, the testimony offered at the hearing, the examination of all the facts established, and after determining that said Variance Application meets the require- ments of Section 9250.8 of the Santa Aha Municipal Code, it has been determined that the zoning Administrator's decision should be over- ruled, and that said Variance should be granted subject to certain conditions. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby grants a Variance on Variance Application NO. 1660 to permit the conversion of existing floor area of a resi- dence into additional retail bookstore area in the R-3 District on certain land situated in the City of Santa Aha, County of Orange, State of California and described as Lots 6 and 7 of the B~keley Tract in the City of Santa Aha, California subject to conditions as follows: 1. That all business shall b~ conducted entirely within the existing main dwelling on the lot. 2. That there shall be no goods stored, displayed or offered for sale or rent, outside of the existing main dwelling nor in the windows of said building. 3. That there shall be not more than one sign which shall be unlighted, have an area of not more than 6 square feet and be placed on a door or window of the existing residence or with one side flat against said building~ said sign shall be single faced only. 4. That no addition to existing building or new buildings shall be established for the purpose encompassed by this Variance. 5. That the applicant shall provide six accessible off-street parking spaces upon said property and that said parking spaces shall be in accordance with City standards. 6. That the conditions hereinabove numbered 1 through 5 shall be considered as replacing any and all conditions imposed pursuant t o a Variance granted upon Variance Application No. 243. 7. That condition NO. 5 shall be complied with prior to the issuance of a utilities release by the Building Department.
