HomeMy WebLinkAbout62-139RESOLUTION NO. 62-139 GRANTING A PERMIT TO PACIFIC ELECTRIC RAILWAY COMPANY FOR CONSTRUCTION ANDMAINTENANCE OF AN IN- DUSTRIAL DRILL TRACK AT GRADE ACROSS HUNTZINGERAVENUE WHEREAS, the PACIFIC ELECTRIC RAILWAY COMPANY on June 14, 1962 applied for a permit to construct a drill tract as hereinbelow set out and after study and negotiation the City Council has determined that said permit should be granted. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Aha hereby grants to the PACIFIC ELECTRIC RAILWAY COM- PANY, a Corporation, a permit to construct, reconstruct, maintain and operate an industrial drill tract at grade across that portion of Huntzlnger Avenue which is located in the City of Santa Ana, California, approximately 1197 feet Easterly of Harbor Boulevard, the center line of which is described as follows: Beginning at a point in the Northerly line of Hunt- zinger Avenue, 40 feet wide, in the City of Santa Ana, County of Orange, State of California, said point being Easterly thereon, measured along said Northerly line, 1197.82 feet frc~ the Easterly line of Harbor Boulevard, 80 feet wide; thence Southerly 40 feet to a point in the South line of said Huntzinger Avenue, said point being Easterly thereon, measured along said <So~th line, 1197.79 feet from the Southerly prolongation of the Easterly line of said Harbor Boulevard and there is attached hereto, a drawing, No. A.E. 15738, which drawing is by this reference incorporated herein showing the pro- posed location of said tract in red. BE IT FURTHER RESOLVED: That said permit is granted upon the following conditions: 1. That the Railway Company do the following at their expense: a. Replace all existing improve~ents removed in constructing the tracks in accordance with City standards. b. Reconstruct the grade and width of Huntzinger Avenue to conform to the proposed grade of the tracks and the master plan width in accordance with City standards. c. Construct drainage culverts under the proposed tracks in accordance with City standards. d. Install any crossing protection devices, present or future, d~-~ned necessary by the State Public Utilities Commission. These devices may include, but are not limited to, automatic flashing lights, automatic gates, and/or fixed signs. e. Replace all improvements removed due to change in elevation on alignment of the tracks by the railroad. f. Provide for the maintenance of pavement within the track area (track area is the area between points two feet outside the rails) and between track areas if the distance between the cen- terlines of adjacent tracks is less than 14 feet. g. Provide for the maintenance of any crossing protection devices installed for the crossing with the exception of advance highway warning signs and pavement markings. h. Prepare all plans for the improvements required within the crossing area and submit them to the City of Santa Aha, Depart- ment of Public Works for approval. i. Perform all surveys for the improvements required within the crossing area. j. Procure street construction permits frem the City of Santa Ana for the street work done within the crossing area and pay the regular permit and inspection fees therefor. ~. ~re~are ail maps, drawings, and docuxaents necessary for application to the State Public Utilities Cc~m%ission in accordance with State regulations for establishment of grade crossings. 1. Provide for the following at such time as the street is altered by the changing of its elevation or alignment or increase of its width: (1) Raise, lower and/or alter any existing tracks as may be necessary, both inside and. outside the limits of the crossing. (2) Prepare any existing tracks to receive pavement such as necessary replacement or installation of ties, rails and ballast. (3) Relocate any existing automatic signals, automatic gates, signs or other railroad equipment as may be necessary. 2. That the track be a standard gauge single track. 3. That the City of Santa Ana in making the grant of this permit, expressly reserves the right to improve, alter or repair all of said street or any part thereof, and to lay sewers or pipes or conduits for water or other purposes therein; such work to be done by the City so as to obstruct or injure the tracks as little as possible. It is further understood that this permit is especially granted upon all and each of the terms and conditions herein contained; and if the grantee or its successor in interest shall fail in any particular to comply therewith or with any Of them, then all rights to this permit shall be thereby forfeited and the grant shall be null and void and that nothing herein contained shall be construed to be an exclusive franchise.
