AN ORDINANCE ALSO,DING Oi%DI}[~i'iCE NO. 1074, FOR COliVENI£N~E ~WOWN AS: "ZONING OblDINAYCE OF THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS ['OLLOWS: That ~rdinance No, 10[4 of the City of Santa Ana known as "Use Districting Ordinance" and for convenience known as "Zonin~ Ordinance of 19}9", is hereby emended by changing certain Sections and by adding new Sections as follows: Section 1: ~h~.t the first paragraph Sf Section J of sale Ordinance No. 10~4 be amended to read as follows: '~In order to classify, regulate, restrict and segregate the use of lend and buildings, to regulate and restrict the height and bulk of buildin~s and to regulate the area off yards and other o~en s~aces a0out Dulldln~s, several classes of districts Oeginnlng with the most restricted classification and pro~ressln~ to the lessrestricted clas- sifications are established to be known as follows: R-1 (for convenience celica Single Family Residence District) R-2 (for convenience celled Limited ~[ultio!e Residence District) R-3 (for convenience caz±ed Multiple Family Residence District) C (for convenience ca±led Local Commercial District) C-1 (for convenience celled Neighborhood Commercial District) C-2 (for convenience ca~.ed General Commercial D~strict) ~,~-± (for convenience called kanufacturi~g District) ~2 (for convenience called Industrial ~istrict) classes of which said severalhdistrlcts are hereby established, and which said classifications and ~istricts are and shall be shown and designated as R-i, ~-2, .i-3, C, C-i, C-2, Di[-i, and M-2 respectively on those certeln sheets or Sections numbered consecutively from Sheet or Section No. 1 of D!strictlnM Map of the City of Santa Ann as amended. Section 2: That suo~aragraoh 1. of Section 3 of said Ordinance No. 10~4, be amended so as to read as follows: "l. (a) No land building, structure, or accessory shall be used for any purpose other tt~ a use permitted by said 'Zoning Ordinance of lS~S,, and ~n~nents thereto, in the District in which such land building, structure or accessory is located. (b) In any District created by said 'Zoning Ordinance of 19G9', or ~men~ments thereto, no proposed or existing building, structure, or accessory, which i~ designed, ar- ranged, or intended for use other than a use permitted in such District by said ordinance, and amendm~ents thereto, shall be moved into, erected, or established in such District." Section ~: That subparagraph ~. of Section ~ of said Ordinance No. lO~, be amended so as to read as follows: "~. (a) No building, structure, or accessory shall be erected, nor shall any existing building be reconstructed, added to, enlarged or structurally altered to exceed in heist the limit established, or n~uber of stories permitted by said 'Zoning Ordinance of 19~9', and amendz~ents thereto, for the District in which such building is located. (b) An existing building, structure or accessory which exceeds the heig~t limit, or the nu~ber of stories permitted, in any certain District established by said 'Zon- ing Ordinance of 19Z9', and amendments thereto, shall not be moved into or established in such District." Section ~: That subparagraph 5. of Section ~ of said Ordinance No. 107~, be ~uended so as to read as follows: "~. No building shall be erected, structurally altered, added to, enlarged, reconstructed or rebuilt, nor shall any existing building be moved, nor shall any open spaces surrounding any building be encroached upon or reduced, in any m~nner except in conformity with the building-site requirements and the area and yard regulations established by 'Zoning Ordinance of 19G9', and amend~.~ents thereto, for the District in which such building is located." Section 5: That a new Section, to be denominated Section 8eS is hereby added to Ordinance No. 1074 which said Section shall fellow Sec- tion 6. and shall read as follows: "Section 6.5: ~C' C0~,~RCIAL DIST~ICT (for convenience called Local Cormuercial District) (A) Uses Permitted: 1. All uses permitted in the M-l, H-Z, and R-S Districts, but under the conditions and provisions set forth in the R-S District. ~. The following trades, services, and retail stores provided, that, with the exception of automobile parking lots and automobile serv- ice stations, they are conducted entirely with- in enclosed buildings: (a) Automobile parking lot, but not used oar sales ~ (b) Automobile service station provided any tube and tire repairing, battery charging, storage of merchandise and supplies are conducted wholly within buildings. Provided further, that any lubrication or washing, not conducted wholly within a building shall be per- mitted only if a ~naso~ry wall, not less than five ($) feet nor more than six (8) feet in height is erected and main- tained between such uses and any adjoin- ing R-l, R-2 or R-~ District. No pro- vision in this paragraph shall be inter- preted to permit general automobile re- pairing, painting, body and fender work or steam cleaning° (c) Bank (d) Beauty Parlor (e) Barber Shop (f) Book Store (g) Cafe, Restaurant (h) Delicatessen (i) Drug Store (j) Flower Shop (k) Notions or Gift Store (1) Offices of persons engaged in professions (m) Photograph Studios (n) Grocery store, meat market, or vegetable market, of not to exceed two thousand (2000) square feet of floor area for say one, and not to exceed three thousand five hundred (3500) square feet of floor area for any combination of two or more. Such other business, office, or enterprise of a local neighborhood service type ~ich is consid- ered by the Planning Co~uission to be similar in character to those listed in Paragraph S. above in this Section, unless, in the opinion of the Planning Commission such use would be by compari- son with those mentioned in said paragraph 2, detrimental to, or incompatible with, the neigh- borhood, surrounding the location or proposed lo- cation of the intended use, or would be of general rather thau local neighborhood importance. Exterior si~s in connection with any one busi- ness shall be limited to posed surface area° All against the building and the roof line 50 square feet of ex- signs shall be flat shall not extend above or firewall. (B) Building Height Limit: Two (2) stories, but not to exceed thirty-five feet, except as provided in Section 11 and 13 of said "Zoning Ordinance of t939", and anaendments thereto. (C) Except as provided in Section ll and 12 of said "Zoning Ordinance of 19~9'~, mhd amen~nents thereto, yards follows shall be provided and maintained. 1. as Front Yard: There shall be a front yard eqnal to that prescribed for an inside lot in the R-~5 District as provided in Section 6 of said "Zoning Ordinance of 1959". Side Yards: (a) There shall be a side yard of not less than three (Z) feet on that side of s~y lot in the "C" District which abuts an R-i, R-~, or R-~ District. (b) On a corner lot, the rear of which abuts the side line of an adjoining lot in ti~e R-l, R-~°, or R-$ District, there shall be a side yard on the ex- terior, or street side, of such corner lot equal to three-fourths (S/~) of the depth of the front yard re- quired for key-lots as prescribed in paragraph $~ subsection (C) of Section 11 of said ~'Zoning Ordinance of 1959", but the width of such yard need not be more thsa~ ten (10) feet aud shall be not less than t~bz~ee (Z) feet in width. (c) Where a corner lot is completely abutted ontwo sides by land in the "C" District, the exterior side yard shall be equal to the front yard required for the adjoining inside lot, in tho C District, abutting the sazae street as said yard. (d) No provision of this section shall be interpreted so as to reduce the buildable ¥~idth of a corner lot such as described in paragraph 3, (b) of Subsection (C) of this Section, and which lot was in existence at the time this ordinance was adooted, to less than twenty-eight (2~) feet. (el In all other cases not mentioned above a side yard for a commercl~! bu~ldlng in the C District shall not be required, out if provided shall be not less than three (3) feet in width. 3. Rear Yard: Except as provided in Section 11 and 12 of the "Zolning Ordinance of 1939", and amendments thereto, there shall ce a rear yard of not less than twenty (20) feet. 4. Buildings and structures hereafter erected established or located in the C District primarily for residential ourooses shall be made to comoty with the orov!sions of Section 6 and also with the orovlsions of Section ll which are aooiicsble to the R-3 District of said ~'Zonlng Ordinance of 1939" and amendments thereto. 5. Exceoting growing olants, all goods, merchandise, wares, produce or other commodities which are stored or offered for sale or exchange in the C District ahall be housed in buildings, but the displaying of such goods, wares, merchandise or other commomities in any entry way or re- cessed entrance of a buildln~ shall be considered as beinif housed in a building. 6. Only new merchandise, goods or wares shall be sold, stored or exchanged in ~he "C" District." ~. Section ~: If any section, subsection, sentence, clause or ohrase of this ordinance is for any reason held to be unconstitutional, such decisl~ shall not affect the validity of the remalnin~ vortlons of this ordinance. The City Council hereby declares that it would have Dassed this ordinance and each section, suosectlon, sentence, clause and phrase thereof, Irre- soectlve of the fact that any one or more sections, suosections, sentences, clauses or phrases be declared unconstitutional. Section 8e The City Clerk shall certify to the passage cf this Ordinance and shall cause the same to be published in three consecutive issues of the Santa Aha Register, a newspaper printed, published and circulated in the City of Santa Ana and hereby designated for that purpose. Section 2: Central Traf£ic Districts "A" and "B" as hereinafter referred to, are those traffic districts as sme now or may hereafter be specified by resolution of the City Council as Central Traffic District "A" and Central Traffic District "B" respectively, pumsuant to the pro- visions of Ordinance No. 1030 of t he City of Santa Aha or any ordinance amendatory thereof. Section 3: Parking ~eters may be installed along the curb adjacent to any pmmklng space on any street within Central Traffic District "A". Each pa~king meter shall be of such type as to display a signal showing legal parking upon the deposit therein of from one to five one cent coins, or one five cent coin, lawful money of the United States, for the part of the street upon which said meter is placed; each meter shall by its device provide 12 minutes parking upon the deposit of each one cent coin up to and including 5 one cent coins, or provide 60 minutes parking upon the deposit of one five cent coin or nickel, mad each meter shall be so ranged that upon the expiration of said parking times, it will indicate by mechanical operation and the showing of a proper sigual that the lawful parking period has expired. It is provided however, that the City Council of the City of Santa Aha may, by resolution, designate certain parking spaces within Central Traffic District "A" as 24 minute parking spaces, in which event such parking spaces shall be provided with parking meters which shall be limited to the deposit of two coins of one cent value, and which parking meters shall be designated by a sign thereon indicating a maximum ti~ limit of 24 minutes parking. 1. Section 4: Psmktngmeters msy be installed along the curb adja- cent to any parking space on any street within Central Traffic District "B". Each such parking meter shall be of such type as to display a signal showing legal parking upon the deposit therein of from one to ten one cent coins, or upon the deposit of one or two nickels or five cent coins, lawful money of the United States, for the part of the street upon which eaid meter is placed; each such meter shall by its device provide 12 minutes parking upon the deposit of each one cent coin up to and including 10 one cent coins, or provide 60 minutes psmking upon the deposit of one five cent coin or nickel, or provide 120 minutes psmking upon the deposit of 2 five cent coins or nickels, and each such meter shall be so amranged that upon the expiration of said parking times, it will indicate by mechanical operation and the showing of a proper signal that the lawful parking period has expired. Section §: All parking meters shall be placed upon the curb along side of and next to parking spaces. Such parking spaces shall be of suf- ficient size to accommodate an automobile and shall indicate parallel or diagonal parking by painted lines on the pavemente Section 6: Whenever any vehicle shall be parked in any space along side or next to which there is located, under this ordinance, a parking meter, the owner, operator, manager or driver of said vehicle shall upon entering said space immediately deposit the proper coin of the United States in said meter and said parking space may then be used by such vehicle duming the parking limit provided for the coin deposited. All parking shall be between the lines of a parking space. Section 7: It shall be unlawful for any person to cause, allow~ permit or suffer any vehicle to be parked over time or beyond the lawful period of time as herein provided, or to remain parked in any parking space while a signal showing legal parking is no~ displayed by such adja- cent parking meter. Section 8: The provisions of this ordinance relating to the operation of parking meters shall be effective only between the hours of g:00 o'clock A. M. and 8:30 o'clock P. M. on business days from Monday to Friday, both inclusive, of each week and from 9:00 o'clock A. M. to 8:00 o'clock P. M. on Saturdays, except that such parking l~mitations shall not be operative on any legal holiday, other than Saturday afternoons. Section 9: It shall be unlawful to deposit or cause to be deposited in any psmking meter, any slug, device or metallic substitute for a one cent or a five cent coin of the United States, or for any person to de- face, in~ure, tamper with, open or wtlfully break, destroy or impair the usefulness of any parking metel~. Section lC: It shall be the duty of each police officer totake the number of any meter at which any vehicle is overparked, as provided in this ordinance, the State vehicle license of such vehicle; the time and date of such over-parking, and the make of such vehicle, and issue, in writing, a citation for illegal parking in the same f cfm and subject to the same procedume provided for by the ordinances of the City of Santa Ana and the laws of the State of Cslifornia applicable to the traffic violation within said City. Any operator or owner of a vehicle to whom a citation has been issued may, within twenty-four hours of the timeof the issuance of said citation, pay to the Clerk of the City Court as a penalty for, and in full satisfac- tion of such violation the sum of fifty cents ($.80). Said payment may be made in person or by mailing said sum to the Clerk of the City Court, City Hall, Santa Aha, California, within said period of twenty-four hours. The failure of such owner or operator to make such payment within said twenty-four hours shall render such owner or operator subject to the penal- ties hereinafter provided for violation of the provisions of this ordinanceo Section ll: All revenue received from the operating of s aid parking meters shall be used exclusively for the purchas~ maintenance and repair of said parking meters, servicing and policing parking meter zones and for the el~uation of the traffic hazards within the City of Santa Aha. Section 12: Except as provided in Section 1 hereof, this ordinance shall be deemed to be in addition and supplementary to, and not in conflict with nor a repeal of prior or existing ordinances of this City, but shall be ~n additional provision for the regulation of traffic and parking in those zones provided for herein. Section 13: If any section, part of section, sentence, clause or phrase of this ordinance shall be held to be unconstitutional or invalid, the remaining provisions hereof nevertheless remain in full force and effect. Section lA: Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be punished by a fine of not less than $1.00, nor more than SBO.O0, or by imprisonment in the County Jail for not more than five days, or by both such fine and imprisonment. Section 15: The City Clerkmhall certify to the passage and adoption of this ordinance and shall cause the same to be published in three con- secutive issues of the SANTA ANA REGISTER, a newspaper printed, published and cL~culated in the City of Santa Aha, and hereby designated for that purpose. Regulating the Use of Public Highways Within Said Oity", be and the same is hereby amended by adding a new sub-section under Section 9 thereof, whloh said new sub-section shall be numbered $ub-section "(a)# of Section 9 and shall read as follows: "(a) It shall be unlawful for the operator of a vehicle to stop said vehicle and leave the same so parked for a period of time longer than one hour between the hours of 7 otclock A, M. and 6 otclook P. M. of any day, except Sundays and Holidays within Central Traffic District 'A!." Se$tion ~: That Ordinance No. 1030 entitled ,An Ordinance of the City of Santa An. Regulating the Use of Public Highways Within Said City", is hereby amended by adding thereto a new Sub-section under Section 9, which new Sub-section shall be numbered See", and shall fol- low Sub-section e, of said Section, and shall read as follows: "(se) It shall be unlawful for the operator of any vehicle to park said vehicle in any space which has been designated as a ~4 minute parking space under the provisions of Section ~ of Ordinance No. //~/ , and along side or next to which space there is located a parking meter on which there is a sign indicating a maximum time limit of ~4 minutes parking, and leave said vehicle so parked in excess of ~A minutes, between the hours of 9100 o~clock A. M. and 5:30 otclock P. M. on business days from Monday to Friday, both inclusive, of each week and from 9:00 o'clock A. M. to 8:00 o'clock P. M. on Saturdays, except that such parking limitations shall not be operative on any legal holiday, other than Saturday afternoons." The City Clerk shall certify to the passage and adoption of this Ordinance s~d shall cause the same to be published by three insertions in the Santa Aha Register, a daily newspaper printed, published and circulated in the City of Santa Ana, and hereby designated for that purpose. The City Council hereby declares that this ordinance is necessamy for the irmnediate preservation of public peace, health and safety in that the validity of the general municipal election required by law to be held April 8, 1947, may be affected, for the following reasons: that there has been no amendment of said Ordinance No. 958 to include the territory annexed to the City of Santa Aha at the recent annexation proceedings of the territory known as "Southeast Santa Aha"; that ex- cept for this amendment, said recently annexed territory would not be within the boundaries of any of the five wards established by Ordinance No. 958; '~hat unless this amendatory ordinance is passed as an emergency measure, it will not have become effective within sixty days next be- fore the date of the general municipal elections to be held April 8, 1947, as required by Sub-section l~ of Section 76A of Act 5233 of the General Laws of the State of California. The City Council therefore declares that this ordinance is adopted as an emergency measure and shall take effect from and a~ter its adoptione PASSED AND ADOPTED by the City Council of the City of Santa Aha, at its regular meeting held on the 3rd day of February, 19A7. Section 2: The City Treasurer of the City of Santa Ann is hereby authorized and empowered to appoint a deputy who shall be knows as Assistant City Treasurer, Such Assistant City Treasurer shall serve without compensation and shall furnish bond for the faithful per- formance of his duties to the City of Santa Ann in the sum of Five Thousand ($5,000,00) Dollars. The City Treasurer and his bondsmen shall be responsible for all acts of such Assistant City Treasurer. This ordinance shall not be construed to prohibit the appoint- ment as Assistant City Treasurer of any person who shall be employed by the City of Santa Aha. The Assistant City Treasurer shall be appointed by the Treasurer subject to the approval of the City Council of the City of Santa Ann, and before entering upon his duties shall furnish bond as herein re- quired and shall take his oath of office. Such deputy shall hold office subject to the pleasure of such Council and the City Treasurer, and cease to hold office at the pleasure of either the City Treasurer or such Council. Section 2: It shall be unlawful for any person, while carrying concealed upon his person any dangerous or deadly weapon, to loaf or loiter upon any public street, sidewalk or alley or to wander about from place to place with no lawful business t~ereby to perform, or to hiae, lurk or loi- ter upon or about the premises of another. Section 3: It shall be unlawful for any person who has con- cealed upon his person or who has in his i~Gediate physical possession any dangerous or aeadly weapon to engage in any fight or to participate in any other rough or disorderly premises of another. Said Commission shall consist of five members. One only of said members shall be a member of the City Council of the City of Santa Ana, to be appointed by the Mayor of said City, and to serve during his incumbency as a member of such City Council, and during the pleasure of the City Council. The other four mem- bers shall be appointed by the City Council for a term of four (4) years each, to expire on the first day of January of each respective year. The first appointments, however, shall be as follows: One (1) member shall be appointed to serve until January l, 19~8; one (1) member shall be appointed to serve until ~anuary l, 19~9; one (1) member shall be appointed to serve until January l, 1950; and one (1) member shall be appointed to serve until January l, 1951. All subsequent appointments shall be for the term of four (4) years each. The City Council shall have the right, however, to remove any member of such Commission at their pleasure and discretion. SECTION 2: The said Traffic Safety Commission shall investigate any and all matters relative or appertaining to traffic safety measures or im- provements which may come to their notice. They may make recommendations to the City Council concerning the same, and upon request of the City Coun- cil shall report concerning any traffic safety question presented or refer- red to ~hem. They shall appoint one of their members a Chairmen and one of their members as Secretary at the first meeting following the first of each year, and they shall keep true and correct records of all meetings concern- ing traffic safety matters coming before them. SECTION 3: The Traffic Safety Cormnission shall meet at least once each month at such time as they shall by resolution decide, and shall make monthly reports to the City Council concerning any and all recommendations for traffic safety, and shall also furnish a copy of the minutes of all meetings. SECTION ~: The Traffic Safety Commission shall prepare or cause to be prepared rules and regulations governing their own conduct. All such rules and regulations governing the Traffic Safety Commission shall first receive the approval of the City Council of the City of Santa Aha. The Traffic Safety Commission shall operate as a unit and not as individ- ual members thereof. All Commissioners shall serve without pay. SECTION 5: The Traffic Safety Commission shall designate one or more of its me, mbers to act as members of a County-wide Traffic Safety Council. SECTION 6: That all Ordinances or parts of Ordinances in conflict with the provisions of this Ordinance shall be, and the same are, hereby repealed. mOTION 7: The City Clerk shall certify to the passage and adop- tion of this Ordinance and shall cause the same to be published in three (3) consecutive issues of the Santa Aha Register, a daily newspaper printed, published and circulated in the City of Santa Aha and hereby designated for that purpose. The City Council hereby declares that an emergency exists for the immediate passage and adoption of this Ordinance and that traffic fatalities and accidents have become a menace to the public health and safety and this Ordinance is intended to assist in curbing and preventing such traffic hazards, ther~re, the City Council declares that this Ordin- ance shall take effect and be in force from and after its adoption. It is provided however, that in the event the provisions declaring an emergency should be declared invalid for any reason whatsoever, then and in that event this Ordinance shall nevertheless take effect thirty (30) days after the first publication thereof as hereinabove provided and thereafter shall be in full force and effect. THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS: SECTION 1. BUILDINGS IN SEWER DISTRICTS MUST BE CONNECTED TO PUB- LIC SEWERS. All buildings or other structures which contain any plumbing fixtures and which are located within any sewer district or district ser- viced by a public sewer must be connected to a public sewer. Whenever any property shall be included in a sewer district or area served by public sewer, every building or other structure located on such property, and containing any plumbing fixtures, shall, within ninety days after completion of the public sewer in such district or area, have all such fixtures connected to the said public sewer, and any and all cess- pools or septic tanks on such property shall be disconnected and completely filled with good, sound earth, at the time the sewer connection is made, PROVIDED, however, that, if the said property has been, previous to its inclusion in a sewer district, connected to a public sewer, and if such connection is approved by the Superintendent of the Sewer Department of the City of Santa A~a, said connection shall be considered as complying with the provisions of this section. SECTION 2. CONNECTION OUTSIDE OF A SEWE~ DISTRICT. Any lot or any building or structure on any lot located within the City Limits of the City of Santa Ama, but outside of an existing sewer district or area served by public sewer, may be connected with a public sewer, but no person shall make, or cause or permit to be made, any such connection unless, and until he shall have been granted a sewer permit for such connection, and unless, and until, said person or the owner of said lot~ 6r his duly authorized agent, shall have paid to the Superintendent of the Sewer Department of the City of Santa Aha an amount equal to that which would have been assessed to said &or, had it been in the district assessed for the existing sewer to which said connection is to be made. Said amount may be reduced at the discretion of the Superintendent of the Sewer Department to allow for extra length of house sewer or connecting sewer necessary. SECTION 3. DETERMINATION OF FEES FOR SEWER PERMIT. It shell be unlawful to make any sewer cc~nection unless a permit therefor shell have been applied for and issued by the Superintendent of the Sewer De- partment of the City of Santa Ana. Whenever any public sewer shall have been constructed and installed out of funds made available from voluntary contributions made by property owners benefited or to be benefited thereby, or out of funds made avail- able from voluntary contributions made by some of such property owners Jointly with City funds, or entirely out of funds provided by the City of Santa Aha, no permit for such connection shall be issued by the Superin- tendent of the Sewer Department of said City as provided in this section unless the application therefor is accompanied by the payment of a fee payable to the City of Santa Aha, in an amoGnt which the Superintendent of the Sewer Department shall ~ to be said applicant's proportionate share of the cost of construction of such public sewer had he Joined with all property owners benefited or to be benefited thereby in making avail- able funds for payment of the cost of constructing such public sewer. The proportionate share of the cost of the construction of such pub- lic sewer next hereinabove referred to shall be computed upon a basis of the entire cost of the lateral and one-half the cost of the main sewer line based upon the linear front footage of the property to be served by said Sewer. SECTION 4. DETERMINATION OF FEES FOR WATER METER CONNECTION. When- ever any water main has been installed out of funds made available from voluntary contributions made by property owners benefited or to be benefited thereby or out of such funds Jointly with City funds or entirely out of funds provided by the City of Santa Ma, no water service meter connection shall be made for such property until a permit has been obtained therefor from the Superintendent of the Water Department and no such permit shall be issued under the circumstances herein set forth unless the application therefor is accompanied by the payment of a fee payable to the City of Santa Ana in an amount which the Superintendent of the Water Department shall ~ to be the proportionate share of the cost of constructing the water main for the service to the property for which meter connection is applied for and said cost shall be computed upon a basis of the linear front footage of said property abutting on said 'water main. SECTION 5. PENALTIES. Any person violating any of the provisions of this Ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not to exceed five hundred dollars ($500.00) or by imprisonment in the County Jail for not more than six (6) months or by both such fine and imprisonment. SECTION 6. This Ordinance is urgently required for the ~mmediate preservation of the public health, peace and safety. The following is a specific statement showing the urgency of this Ordinance: That there are areas in the City of Santa Aha not now served with sewer lines, that in some instances because of defective septic tanks and cesspools a present d~nger to the public health now exists, and this Ordin- ance is adopted to allow the City to put in sewer mains to correct and remedy the existing health menace and to insure the safety of the public generally. SECTION 7. The City Clerk shall certify to the passage of this Ordinance and s~all cause the same to be published in three consecutive issues of the Santa Aha Register, a newspaper printed, published and cir- culated in the City of Santa Ana, and hereby designated for that purpose. SECTION 3. EXCEPTIONS: The provisions of this Ordinance shall not prohibit a seller from taking orders or delivering any commodity from a vehicle on that part of the public street, alley or way within the City of Santa Ana immediately adjacent to the premises of the purchaser. SECTION 4. DEFINITION: Any vehicle or structure parked or placed wholly or partly within any public street, alley or way bearing thereon any sign visible from outside said vehicle or structure and at a distance from the same of twenty feet containing the words "For Sale" or any other language indicating that said vehicle or structure or any article or thing therein contained may be acquired by purchase or trade shall 'be pre- sumed to be in violation of Section i of this Ordinance. SECTION 5. PENALTIES: Any person violating, any of the provisions hereof shall be gmllty of a misdemeanor and upon conviction thereof s~%ll be punishable by a fine not to exceed one hundred dollars ($100.00) or imprisonment in the County Jail for not more than 30 days or by both such fine and imprisonment. SECTION 6. SEVERABILITY OF PROVISIONS: It is the intention of the City Council that each separate provision of this Ordinance shall be deemed independent of all other provisions herein and it is further the intention of the City Council that if any of the provisions of this Ordin- ance are declared invalid all other provisions herein shall remain valid and enforceable, SECTION 7. For each bbl. of cement or lime used other than pavement ............................. 0.05 SECTION 3: The City Council does, by the enactment of this 0rdin- ance, determine and declare that the amount of water available to the City of Santa Ana through the Orange County Feeder Line of the Metropol- iran Water District is in excess of the amount required for domestic purposes by the City of Santa Ana at the present time. That until such time as the City ~ouncll of the City of Santa Ana, and/or the Directors of the Metropolitan Water District, shall determine and declare that such excess water no longer exists, such excess water - 2 - available to the City of Santa Ana in the said Orange County Feeder.Line may be sold for the purpose of irrigation of agricultural land within the exterior boundaries of the City of Santa ~a. Water sold for irri- gation shall be only through connections made directly to the Metropoli- tan Water District line. All such connections shall be made by the City of Santa Aha or the Metropolitan Water District upon approval of the City Council of the City of Santa Aha on applicstion for such service. No application for such service will be approved by the City Council until application for such service has been made in writing to the Santa Aha Water Department, ac- companied by sufficient funds to cover the estimated cost of installa- tion plus 10%. Should the cost of installation exceed the amount de- posited, the applicant will be billed for the balance due, and no water will be turned on until said balance is paid. Should the cost of in- stallation be less than the amount paid, the money in excess of cost of installation will be refunded to the applicant. All such connections shall be end remain the property of the City of Santa Aaa. All water served through such connections shall be paid for by the applicant at the rate of $20 per acre foot, payment therefor being due end payable at the office of the Water Department in the City Hall on the first day of the month following delivery of water. Should payment for water used not be made by the 10th of the month, no more water will be delivered until such payment has been made. Should the City Council of the City of Santa Aha and/or the Direc- tors of the ~etropolitan Water District determine, at any time, that the amount of water available to the City of Santa Ana is no longer suffi- cient to supply water for the irrigation of agricultural land, the City Council may at its option rescind the provisions of this Ordinance which grant the privilege of using w~ter for agricultural purposes, and all meters, connections, and other appurtenances shall become the sole pro- perty of the City of Santa Aha. SECTION 4: SERVICE OUTSIDE CITY. That any person, firm, or cor- - 3 - poration outsdie of the corporate limits of t~e City of Santa Ana, and desiring to become a consumer of water supplied by the City of Santa Ana shell first make application to the Water Superintendent for such service, who shall submit the same for approval or rejection to the City Council. If said application is approved, such applicant shall provide, at his own expense, sll necessary piping, and installation, except meters end taps, which shall be furnished and set by the City Water Department, and shall pay for the water furnished to him or them by the City of Santa Aha, et double the rates specified in Section 2 for services inside the City limits. The charge for the installation of meters shall be the same as for services inside City Limits. All other rules, regulations, sorvice charges, etc. shall apply to these consmmers. SECTION 5: APPLICATIONS. All applications for water must be made out on forms provided by the Water Department and must be signed by the applicant. All applicants other than the record ovmers of real property, or their authorized agents, must deposit with the Water Department such sum as is estimated by the Superintendent of the Water Department to be the amount necessary to coyer the charge for one average month of water consumption at location covered by applicalion, which in no case shall be less then $5.00; said deposit to guarantee that all charges for water, service or penalty of any Kind shall be, paid by applicant, unless the record owner of the real property affected sig~ls a written guarantee for the payment of all such items. The Superintendent of the Water Department may, where actual month- ly water charges indicate that his original estimate was in error, re- estimate the same and notify applicant of such chamge, making appropriate refund or demand for increased deposit. If an increased deposit be de- manded in writing and the same be not deposited within ten days there- after, the supply of water shall be i~nediately turned off ~nd shall not again be turned on until the additional deposit, together with all out- standing charges including the $1.00 for turning on the water, shall be -4- deposited and paid. SECTION 6: PAYMENT OF WATER RATES. All water rates are due and payable at the office of the Water Department in the City Hall, on the date they are rendered and become aelinquent fifteen (15/ days after rendered. If the bill is still unpaid thirty (301 days after being ren- dered the water will be shut off from the premises an~ shall remain off until all rates, fines and penalZies have been paid. When the supply of water has been turned off for a violation of any Ordinance, or of any rule, regulation or requirement of said City, governing consumers of water, it will not be turned on again except upon payment of the amount due, together with the additional sum of one dol- lar, which is hereby made a penalty for a failure to pay the said rate, and to pay said City for the turning on of water again. SECTION 7: CIRCUSES, SHOWS, ETC. All circuses, shows, or exhi- bitions using water from the mains of the City of Santa Ana, shall make application for such water at the office of the Water Department and shall pay in advance therefor the sum of $20,00 per day. SECTION 8: CHANGE OF LOCA~TION. Any person desiring to change the location of any water service that has already been installed shall make application to the City Water Department for such change and said Depart- ment, if in their judgment they deem such change to be.necessary or ad- visable, will cause such change to be made and the applicant requesting such change shall become liable to the City for the cost of all labor and materials used, plus ten per cent (10%) including the cost of any heavy cast iron meter box where it be determined that the installation of the same is necessary. Unless such charges be paid within ten (10) days of mailing a statement %hereof to the applicant requesting the same, the supply of water will be shut off from the premises and the same shall re- main shut off until all charges, rates or penalties have been paid, in- cluding ~l.00 for again turning the water on. Said charges are due upon the completion of the work herein referred to. SECTION 9: FIRE SERVICES. No fire line shall be used for any pur- pose other than for the extinguishment of fire. Under no circumstances -5- to be used, fifteen (15) extended. shall any meter be installed on fire lines.. All necessary maintenance and repairs on fire lines from the water main to city curb cock shall be paid for by owner. Upon failure to pay said charges, water will be shut off until such charge is paid. Fire hydrants are provided for the sole purpose of extinguishing fire and shall be opened and used only by the Water and Fire Depart- ments, or such persons as may be authorized to do so by the Water De- partment. It shall be unlawful for any person to draw water through any fire hydrant, or other hydrant owned or controlled by the City of Santa Aha, without first obtaining a permit so to~ do from the Water Department. No such permit shall be issued to any person who has violated any of the provisions of this Ordinance, or whose indebtedness to the City of Santa Aha for water used, or damage to hydrants, is delinquent. Such permit shall show the date of issuance, the number or numbers of the hydrants and the location thereof. All such permits shall expire in days from date of issuance and shall not be transferred or Upon granting any permit under this section, the Water Department shall require a fifty dollar (~50) deposi~ from the applicant, said de- posit to be returned upon the return to the Water Department of the per- mit issued and any tools issued to such applicant, under such permit, and upon the payment to the ~Vater Depar~e~ ~or all water used under such permit. It shall be unlawful for any person to fail to return to the ~ater Department any fire tools issued under such per~it on or before the ex- piration of said permit, which fire hydrant tools are t~e property of the City of Santa An~. It shall be unlawful for any person to draw water through any fire hydrant without the use of a standard fire hydrant wrench and an amxil- iary valve, such auxiliary valve to be placed on fire hydrant opening with the ~uxiliary valve closed before any fire hydrant valve is opened. Every person drawing water frown any fire hydrant into ~ tank shall -6- pay for such water used at the rate of ten cents (10¢) for each 250 gal- lon tank or fraction thereof, and the r~te of payment for lsrger tanks shall be multiples of the rate of 250 gallon tanks. SECTION 10: ~ETERS TO RE~AIN PROPERTY OF THE cITY. All water meters and meter boxes installed by the Water Department shall remain at all times the property of the Water Department, and where replace- ments, repairs or adjustments of any meter are rendered necessary by the act, negligence or c~relessness of the consumer, any expense caused the Department thereby shall be charged against, and collected from the con- sumer. If consumers or owner fails to pay such charges, water may be shut off until such charges are paid. Each separate pipe connection in any meter box ~hall be separately metered. SECTION ll: FAILURE OF ~TER. If a meter fails to register dur- ing any period or is known to register inaccurately, the consu£~er shall be charged with an average daily consumption at same season as shown by ~the meter ~i~en in use and registering accurately. SECTION 12: INST~LLILL~G ~ETERS. The City of Santa Ana shall have the right at any time, and et ~y point, to put in a water meter, and may force the collection for the amount oi water that shall be used, in accordance with all the Ordinances, rules and regulations of said City, governing the consumption of water, and for that purpose, and at any time, go upon the premises ef the consumer of water.~ SECTION 13: STOP COCKS., There shall be a stop cock in every at- tachment on the sidewalks, just inside t~e curb, at a point to be desig- nated by said City, which said stop-cock and its box shall be supplied by the City, and shall be for its exclusive use, and under its exclusive c ont ro i. SECTION 14: DA~&~GES. The City will not be responsible for dam- ages to buildings or their contents, from any break beyond the street service box; the water consumers are hereby required, for their own pro- tection, to provide at their ov~ expense, another stop-cock to be placed at the first suitable point beyond the stop or service of the City. SECTION 15: APPLICATION FOR W~TER i~LII,iS ON NEW SUBDIVISIONS. Ap- plicants wh'o are owners of a new subdivision or tract of land, and who desire water service and ~ire protection therein, where there are no water mains or fire hydrants in the street in front of such subdivision or tract of land, may make application to have water mains and fire hy- drants laid in same. Such mains and fire hydrants shall be of such size and kind as the Superintendent of the Water Department shall determine will properly supply said tract, having due regard to the requirements of adjacent lands, and the growth of the City. The applicants shall be required to pay cash in advance to the Water Department for the total estimated cost of such mains, and for such fire hydrants, valves and gate boxes as may be required by the proper city authority, such cost to be determined by the Superintendent of the Water Department, who shall there- upon install such mains, fire hydrants an~ gate boxes, provided, however, that said applicant or applicants have complied with all other require- ments of the said Wster Department. It is understood that all mains installed become at once, and re- main the sole property of the City of Santa Aha. If, upon completion of the installation of said water mains, fire hydrants, valves and gate boxes, the actual cost of installation is found to be materially more than said estimate, the said applicant shall pay to the Water Dep~rtment the difference between the estimate and the actual cost, before the water is turned into said mains. If the actual cost is materially less than the estimate the Water Department shall refund to the applicant the difference between the estimate and the actual cost. Nore than one applicant may join in an application, and the water mains, fire hydrants, valves and gate boxes will be extended in a similar manner as above. SECTION 16: GENERAL REGUL~TIONS. In all cases where water is sup- plied to several tenants from one connection or tap, the City contracts only with the owner of the property or his authorized agents, and on failure to comply with these regulations and pay the rate, the services will be disconnected until regulations are complied with and the rate paid. Consumers must prevent all waste of water, and keep their service pipes, fixtures, stop cocks, and other apparatus (but not the service put in and owned by the City) in good repair, end free from leakage at their own expense, and they will be liable for all damages which may re- sult from their failure to comply with this rule. Water rates ~ill be charged for premises vacated in ever instance, until the City shall have been notified in writing of the discontinuance of the use of water, and to turn the water off. Any ~uthorized employee of the City ~ater Department s~all be ad- mitted at all reasonable hours, to all parts of the premises supplied with water, to see that the regulations ~re observed. No one except a~ authorized employee of the Water Department shall turn the water on or off from any building or premises at City curb or cock, or connect or disconnect or in any way tamper with any pipes in the meter boxes or with any other part of the water system of the City of Santa~Ana. No user of water supplied by the Santa Ana Water Department shall supply water to users on a piece of property held by another owner; nor shall w~te~ be supplied through one meter to a group of users occupying a parcel .of ground under one ownership exceeding one-~alf acre in area. Ail faueets, sprinklers, hos~ nozzles or other continuous streams must be shut off promptly upon the alarm of fire¢ the water ~ot to be turned on again until the fire is known tv be extinguished. No person si~all place on or about any ~ydrant or curb-cock connect- ed with the ~ipes of the Santa Aha Water Department, any building mater- ial or other obstructions, so as to prevent free access to the same, or leave any vehicle standing within l0 ft. of same. The City reserves the right at any time to shut off the water in their mains for the purpose of making extensions or repairs, or for other purposes, and all persons having boilers within their premises not supplied with tanks or cisterns, but depending upon the pipes of the City ~J~ter Department to keep them supplied, are hereby cautioned against danger of collapse. -9- That whenever a water consumer shall allow the payment of the water bills, fines or penalties for water used upon any property in the City of Santa Aha to become due ~ld delinquent the same shall be a lien against said real property and said lien shall not be affected by a change ih the ownership of said real property. SECTION 17: PENALTIES FOR VIOLATION. Any person, firm or cor- poration, violating any of the provisions of this Ordinance, shall be deemed guilty of a misdemeanor, a~d upon conviction in a court of com- petent jurisdiction, shall be fined not more than two hundred dollars, or be imprismned in the County Jail of the County of Orange not exceed- ing sixty days, or by both such fine and imprisonment. THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLL0~: SECTION l: All officers and employes of the City of Santa Ana who collect, receive or have ia their possession any money belonging to the City of Santa Ann are hereby required to deposit the same in a banking institution in the City of Santa Ann authorized to take and re- ceive deposits in the name of said City, and maintaining a general ac- count for the City of Ssnta Ann ia the name of the Treasurer of said City. SECTION 2: All such money shall be deposited within a reasonable time from the receipt thereof, taking into consideration the amount in- volved, the security of the location in which such money is kept, aud the hour of receipt, but in no case shall any such money be withheld from deposit in such banking institution for a longer period than six days. SECTION 3: All such money shall be deposited to an account under the name of "City of Santa Ann, General Account" and shall be subject to withdrawal by the check or order of the Treasurer of the City of Santa Ann. SECTION 4: All persons depositing money under the provisions of this Ordinance shall receive from the banking institution a duplicate deposit slip and shall settle for the same with the Clerk on the first Monday of each month by delivering to said Clerk said duplicate deposit slips and receiving a receipt therefor. SECTION 5: All officers and employes of the City of Santa Ann receiving or having in their possession any money or negotiable instru- ments received as deposits, as security, or in pledge to guarantee any payment or the doing of any act, shall within a reasonable time, to be determined by the same conditions as hereinabove set out in Section 2, deoosit the same in some banking institution in the City of Santa Ama whose deposits are insured under the provisions of any law of the United States, in a special account designated by i~s n~me for the retention of such funds. The name of the account under which the funds referred to in this Section are deposited shall be so distinctive that it cannot be confused with the "City of Santa Ana- General Account", and shall show the neme of the officer or employe upon whose o~der withdrawal may be made. All officers and employes maintaining any such account under the provisions of this Section shall immediately notify the City Council of the City of Santa Ane in case the total ~mount on deposit equals or ex- ceeds $4500.00, and provisions shall be made for the redepositing of a portion thereof in a trust fund of the City, maintained in the name of the Treasurer of the City of Sant~ Aha. SECTION 7: This Ordinance is urgently required for the preserva- tion of the public peace and safety. The following is a specific state- ment ~howing the urgency of this Ordinance: That heretofore the practice in the.handlingi~f public monies and trust monies has developed and continued, which might endanger the secur- ity of the CitY, s and the socurity and safe~y of trust deposits held by the City of Santa Aha. This Ordinance is adopted for the correction of the methods of handling funds, to regulate, govern and control the deposit of all City or trust funds in the hands of the City or its employes, and the Council of the City of Santa Aha does hereby direct that all officers or employes receiving or having in their possession any money or negotia- ble instruments belonging to the City of Sant~ Ana, or received in trust guaranteeing any payment or the doing of any act shall, prior to the 1st day of ~nu~ry, 19~8, comply with the provisions hereof, that the account- ing period then beginning shall be under the provisions of thzs Ordinance.
