RESOLUTION OF TP~ CITY COUNCIL OF THE CITY OF SANTA
ANA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER
THE CONSTRUCTION OF CERTAIN SEWER LINES TOGETHER
WITH APPURTENANCES AND APPURTENANT WORK WITHIN THE
SAID CITY FOR THE USE AND BENEFIT OF THE CITY OF
SANTA ANA ASSESSMENT DISTRICT NO. 218; DECLARING THE
SAID WORK AND IMPROVEMENT TO BE OF MORE THAN LOCAL
OR ORDINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT
TO BE BENEFITED BY SAID WORK AND IMPROVEMENT, AND TO
PAY THE COST AND EXPENSES THEREOF, AND FIXING THE
TIM~ AND PLACE FOR HEARING OF OBJECTIONS TO SAID WORK
AND IMPROVEMENT.
WHEREAS, the City Council of the City of Santa Ana by
Ordinance No. NS-589, presently in full force and effect, estab-
lished a procedure for finding and determining whether the public
convenience and necessity require certain improvements or acquisi-
tion of property, and authorizing notices and hearings to be
combined and held concurrently with the hearing required by the
improvement act pursuant to which the improvement proceeding is
proposed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
ANA DOES RESOLVE AS FOLLOWS:
SECTION 1: That pursuant to Ordinance No. NS-589, said
City Council hereby elects to combine the hearing required therein
with the hearing required by Section 5132 of the Streets and
Highways Code of the State of California.
DESCRIPTION OF WORK
SECTION 2: That it is the intention of said City Council
to order the construction of sanitary sewer facilities, to wit:
FIRST:
The Construction of Sanitary Sewers, Laterals, Manholes
and all appurtenant work in connection therewith, including
cutting and replacement of paving, relocation and recon-
struction of interfering utility services; in
Harbor Boulevard:
Between McFadden (Sugar) Avenue and a point approximately 150
feet South of the Fifth Street as shown on Pages 2, 3, 4 and
5 of the plans hereinafter referred to; and in
Camille Street:
Between Harbor Boulevard and Harper Street as shown on Pages
6 and 7 of said plans; and in

Gunther Street:
Between Camille Street and Bolsa Avenue (First Street) as
shown on Pages 8 and 9 of said plans; and in

Alley:

Between Harper Street and a point approximately 665 feet East
of Harper Street as shown on Page 17 of said plans; and in

SECOND:
The Construction of house laterals and appurtenant work
thereto; in
Jackson Street:
Between approximately 205 feet south of Camille Street to
approximately 220 feet north of Camille Street as shown on
page 20 of said plans.
PLANS, PROFILES, DRAWINGS AND SPECIFICATIONS
SECTION 3: That all of the said work and improvement to
be done as described in Section 2 .of this resolution shall be
constructed upon the grades, along the lines, between the points,
of the dimensions, at the places and in the manner shown on the
plans, profiles, drawings and specifications for the construction
of said work and improvement in the City of Santa Ana Assessment
District No. 218, said plans and profiles and drawings are
labelled, "Profile Alignment and Grade of Sanitary Sewers to be
constructed in the City of Santa Ana, california, Assessment
District No. 218'and are officially designated as Plan No. AD-218,
said specifications are labelled "Specifications and Special
Provisions for Sanitary Sewers to be Constructed in the City of
Santa Ana, California, Assessment District No. 218" and are
officially designated as Epecifications No. A?.-218 .. Said Plan
NO. AD-2.18 and Specifications No. AD-2~. have heretofore been
accepted and approved by the City Council of said City, are on
file in the office of the_City Clerk of said City (and a copy bein~
on file in the office of the City Engineer of said City), and
reference is hereby made to said Plan No. ~ and Specifications
NO. ~D-2~8 for a further, full and more particular description
of said work, and by reference thereto, the same are incorporated
herein and made a part hereof.
DESCRIPTION OF ASSESSMENT DISTRICT
SECTION 4: That said contemplated work and improvement
is of more than local or ordinary public benefit, and that said

City Council does hereby make the expense of such work and
improvement chargeable upon a district, which district is hereby
declared to be the district benefited by said proposed work and
improvement, and to be assessed to pay the cost and expense thereofl,
and which district embraces all that real property situate in the
city of Santa Ana, County of Orange, State of California, described
as follows:
Ail of that certain territory of the City o~ Santa Ana,
in Orange County, California, included within the exterlor boundary
lines shown on the plat exhibiting the property affected by or
benefited by or to De assessed to pay the cost and expenses of the
work and improvement of sanitary sewer facilities in and for said
Santa Aha Assessment District No. 218, which said plat is labelled
"Diagram and Map for Santa Aha Assessment District No. 218", has
been heretofore adopted and approved by this City Council and
officially designated as Plat No. AD-218 and is on file in the
office of the Clerk of the Council and a copy of which is also on
file in the office of the City Engineer. Said Plat No. AD-218
contains Seven (7) sheets in total, one (1) title sheet showing
the entire assessment district, the exterior boundaries thereof and
the excluded areas within found not to be benefited by this work.
The six (6) following sheets contain the details of the property
within the assessment district boundaries and the details of the
excluded areas within said boundaries hereby found not to be
benefited by this work. Said excluded areas shall be omitted from
the assessment hereafter to be made to cover the costs and expenses
of such work and improvement.
EXCEPTING from the area shown within and delineated upon
said plat hereinabove referred to the area of all public streets,
public avenues, public lanes, public roads, public driveways, publid
courts, public alleys, and all easements and right-of-way therein
contained belonging to the public, and all lots or parcels of land

belonging to the United States or any department thereof, to the
State of California or any department thereof, to the County of
Orange and to the City of Santa Aha, which lots or parcels of landl
are in use for the performance of any public function, and all suc~
property above mentioned and described as being excepted from the
area shall be omitted from the assessment hereinafter to be made
to cover the costs and expenses of such work and improvement,
reference is hereby made to said Plat for a further, full and more
particular description of said assessment district, and the said
plat so on file shall govern for all details as to the extent of
the said assessment district.
DESCRIPTION OF BONDS
SECTION 5: That serial bonds extending over a period of
nine (9) years from the second day of January next succeeding the'
next September 1st following their date, and bearing interest at
the rate of six percent (6%) per annum, payable semi-annually,
shall be issued as provided by the "Improvement Act of 1911"
hereafter referred to, to represent assessments of ($50.00) or
more for the cost of said proposed work and improvement, remaininc
unpaid for thirty (30) days after the date of recording the warrantI.
ESTIMATED COSTS AND EXPENSES
SECTION 6: That the estimated costs and expenses of
said work and improvement inclusive of the incidental expenses of
the proceedings is the sum of Five Hunarea ~lnet~-fiveThousand
Dollars ($ 59~000.00 ). Of the sum, Forty Five Thousand Five
Hundred Dollars(S45,500.00) is to be paid directly from the funds
of the City of Santa Ana and will not be included as a charge
upon the said assessment district.
TIME AND PLACE OF HEARING
SECTION 7: That notice is hereby given that on Tuesday,
September 4, 1962, at the hour of 7:30 P.M., in the Council
Chamber, in the City Hall, in said City, there shall be a public

hearing before said City Council for the purpose of determining
whether the public convenience and necessity require the above
described improvement, and at which time and place any and all
persons having any objections to such determination or to the
proposed work or improvement may appear and show cause why the
City Council should not find that the public convenience and
necessity require the above described improvement and why the said
work or improvement should not be carried out in accordance with
this resolution. Protests must be in writing and must contain a
description of the property in which each signer thereof is
interested, sufficient to identify the same, and must be delivered
to the Clerk of the Council prior to the time set for the hearing.
IMPROVEMENT ACT
SECTION 8: That all of the work and improvement herein
proposed shall be done and carried through in pursuance of an act
of the Legislature of the State of California designated as "The
Improvement Act of 1911", being Division 7 of the Streets and
Highways Code of the State of California.
PUBLICATION OF RESOLUTION OF INTENTION
SECTION 9: That THE REGISTER, a daily newspaper pub-
lished and circulated in said City, is hereby designated as the
newspaper in which this Resolution of Intention shall be published~
by the Clerk of the Council in the manner and form provided by lawt
and is the newspaper in which all further notices and resolutions
relating to said work and improvement shall be published.
The Clerk of the Council is directed to mail notices of
the adoption of this Resolution of Intention, postage prepaid, to
all persons owning real property which is proposed to be assessed
to pay any part of the cost of the work, whose names and addresses
appear on the last equalized assessment role for City or County
taxes, all in the manner and form provided for under Sections
5070, 5194 and 5195 of the said "Improvement Act of 1911" of said

POSTING OF NOTICE OF IMPROVEMENT
SECTION 10: That the Superintendent of Streets of the
City of Santa Ana shall cause to be conspicuously posted along the
line of said contemplated work and improvement and along all open
streets within the district liable to be assessed for said work
and improvement, notices of passage of this Resolution of
Intention, in the time, form and manner provided for by said
"Improvement Act of 1911" of said Streets and Highways Code of
the State of California.
PASSED AND ADOPTED by the City Council of the City of
Santa Ana at a regular meeting thereof held this 6th day of
August, 1962.
