ORDINANCE AMENDING ZONING 0P~DINANCE NO. 1074
WHERE.~£, the Planning Commission of the City of Santa Ana has
given notice of public meetings as required by law in connection with
all applications to amend the Zoning Ordinance to cover the properties
hereinafter described,~ and has duly held two public meetings upon the
question o2)each amendment, and thereafter, by resolution, recom~ended
such amendments to the City Council for adoption; and
'~HEREAS, the City Council gave due an~ regular notice of a pub-
lic hearing to be held 0efore the City Council, ~nd such public hearing
has been duly and regularly held, and the City Council does now find
that public necessity requires the following amendments and changes in
the present classification of certain property in the City of Santa Ana
and that the proposed uses under the proposed new classifications will
not be detrimental to the surrounding property;

165 FEET, MORE OR LESS, NORTH OF FOURTH STREET.
THE COUNCIL OF THE CITY OF SANTA ANA DO ORD ~N AS FOLLOWS:
SECTION l: That the public interest and convenience requires, and
there is hereby established set-back lines upon and along Grand Avenue
in the City of Santa Alia, California, between which set-back lines and
said Grand ~venue it shall be unlawful for any person, firm or corporation
to erect any building, wall, fence or other structure. The set-back lines
hereby established are, and their location is hereby described as follows:
Beginning at a point in the South line of Lot 10, Block "C", Bart-
lett's Addition, as recorded in Book 13, Page 45, Records of Los An-
geles County, l0 feet Easterly from the Southwest corner of the said
Lot 10. Thence Northerly l0 feet Easterly from and parallel to the
West line of the said Bartlett's Addition to a point which is 50 feet
Southerly from the North line of Lot 9, Block "A" of the said Bart-
lett's Addition; thence Northerly in a straight line to a point in
the North line of the said Lot 9, Block "A", which is 12.38 feet East-
erly from the Northwest corner of the said Lot 9, Block "A", Bsrt-
lett's Addition.
The proposed set-back em the West side of Grand Avenue, North of
Fourth Street is described as follows:
Beginning at a point in the East line of Block "F", Tract No. 34~,.
as recorded in Book 15, Page 5, Records of 0r~uge County, which is
12~ feet Northerly from the Southeast corner of the said Block "F";

S~T~0N 2: The foregoing set-back lines are established after reso-
lution of intention duly passed and adopted, the same being Resolution
#3613, and a hearing held thereon after notice by publication and posting
in the manner prescribed by Ordinance #813 of the City of Santa Aha entit-
led."An Ordinance Prescribing the Method of Procedure for Establishing
Set-Back Lines in the City of Santa Ana, and Penalty for the Violation of
Ordinances Establishing Such Lines", and the City Council having heard and
passed upon all persons desiring to be heard at the public hearing so held
and all protests filed and made to the establishment of said set-back.
SECTION 3: The Building Inspector of the City of Santa Aha shall re-
fuse to issue any permit for any building, wall, fence or other structure
proposed to be erected within the space between the present lines of Grand
Avenue and the set-back lines hereinabove described and established by
this Ordinance, end that no person shell build or erect any building,
wall, fence or structure in said area.
SECTION 4: That any person, firm or corporation violating any pro-
visions of this Ordinance shall be deemed guilty of a misdemeanor and up-
on conviction thereof shall be punishable by a fine of not more than
$500.00 or by imprisonment in the County Jail of Orange County for a per-
'iod of not more than six months, or by both such fine and imprisonment.
Each suc~ person, firm or corporation shell be deemed guilty of a separ-
ate offense for each day during any portion of which any violation of this
0rdin~nce shall be committed, continued or permitted by such person, firm
or corporation and shell be punishable therefor under this Ordinance.
SECTION 5: The City Cler~ shall certify to the passage of this Or-
dinonce and shall cause the same to be published in three consecutive is-
sues of the SantaAna Register, a newspaper printed, published and circu-
lated in the City of Sant~ Ana, and hereby designated for that purpose.

SECTION 2 OF ORDINANCE NO. 1056 AND CREATING A
CIVIL SERVICE BOARD CONSISTING OF FIVE MEMBERS.
THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS:
SECTION 1: That Section 2 of Ordinance No. 1056 entitled "AN
ORDINANCE OF THE CITY OF SANTA ANA, CREATING A Cl~IL SERVICE BOARD, PRO-
VIDING FOR THE ~R AND ~ETHOD OF APPOINTmeNT; PROVIDING FOR THE PLAC-
ING OF ~MBERS OF T~[E POLICE DEP~TMENT AND THE FIRE DEPAR~ENT UNDER
CIVIL SERVICE" is hereby amended to read as follows "There is hereby
created a Civil Service Board, consisting of five (5) members to be ap-
pointed by the City Council. Each of the members shall be a person of
good repute in his business, profession or occupation, and known to be in
sympathy with the merit system or Civil Service system in the public ser-
vice, and with the control of employment matters through a centrel person-
nel agency. No member shall hold any other City office, and must be a
bona fide resident and elector in the City of Santa Ana. At the tim~ mak-
ing the new appointments or the replacement appointments the City Council
shall designate the expiration date of each appointee so that said terms
shall expire consecutively, one on December 31, 19~8, one on December 31,
1949, one on December 31, 1950, one on December ~l, 1951 and one on Decem-
ber 31, 1952. At the expiration of each of the terms so provided for and
designated a smccessor shall be appointed for a term of five 5) years.
Any member of such com~nission may be remoVed from office for incompetency,
incompatibility or derelictio~ of duty or malfessance in office, or ~Zher
good cause, by the appointing power; provided, however, that no member of
the commission shall be removed until charges have been preferred in w~it-
lng, and after due notice ~ hearing is had before the City Council. Any
decision of such Council shall be final.
Vacancies of the Civil Service Board from whatever cause shall be
filled by the City Council for the ensuing or unexpired term.
The Civil Service Board shall keep ~ record of its proceedings and
transactions and shall provide rules and regulations for t!~e keeping of
service records of all employes of the City of Santa Ana under Civil Ser-
Service and for the classification of such employes. Such rules and re-
gul&tions shall have the force and effect of law.
SECTION 2: The City Clerk shall certify to the passage of this

TENTION AS SUCH CITY TO VACATE PORTIONS OF CERTAIN
STR~ETS AND ALLEYS WITHIN SAID CITY, DESCRIBING THOSE
PORTIONS PROPOSED TO BE VACATED, AND FIXING THE TIME

THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS:
WHER~&~, heretofore, after stud~, the Planning Consultant recom-
mended the vacation and abandonment of those portions of the streets and
a~d alleys hereinafter described as unnecessary for present or prospec-
tive public street purposes; and
Ww~.~EAS, the City Council, after study, did and does concur with
said conclusions and recommendations, and has heretofore by Resolution
adopted a map for filing in the Clerk's office showing each parcel herein
referred to; NOW THEREFORE:
SECTION 1: The City Council of the City of Santa Ann hereby de-
clares its intention to proceed with the abandonment of said portions of
said streets and alleys under the provisions of Part 3, Division 9 of the
Streets and Highways Code, which said part is known as the "STREET VACA-
TION AOT OF 1941".
SECTION 2: The City Council of the City of Santa Ann hereby de-
clares its intention to vacate, abandon and close up all of those por-
tions of Lowell Street, Olive Street, Towner Street and of two unnamed
alleys hereinbelow described and as shown on and in accordance with the
official maps on file in the office of the City Clerk of said City, and
reference is hereby made to said maps for further particulars, and the
portions of the streets and alleys herein referred to and graphically
shown on said official maps and proposed hereby to be vacated lie in the
City of Santa Ann, County of Orange, State of California and are des-
cribed as follows:
Parcel $1: An alley 10 feet in width, lying between Lots 1
and 2, Block 3, of the French Street Tract, as
recorded in Book 4, Page 45, Miscellaneoas Maps,
Records of Orange County, California.
Reference is hereby made to a map thereof adopted by Resolution No. 3582
now on file in the office of the City Clerk.
Parcel #2: An alley 15 feet wide lying between Lots 36 and
37 of the Main Street Tract, as recorded in Book

Reference is hereby made to a map thereof adopted by Resolution No. 3635
now on file in the office of the City Clerk.
SECTION 3: The City Council of the City of Santa Aha hereby deter-
mines the necessity for reserving from that parcel hereinabove referred
to as Parcel #2 and described herein as such Parcel #2, an easement l0
feet in width along the west portion of said alleyway for the constructio~
operation and maintenance of telephone, telegraph and communication
structures consisting of poles, anchors, wires, cables, conduits, man-
holes and necessary fixtures and appurtenances, it being the determination
of the City Council that the public convenience and necessity requires the
reservation of such easement to protect the existing communication struc-
tures in this area.
SECTION ~: The 29th day of March .., 19~8 at the hour
of 7730 P.M. on said day in the Council Chambers in the City Hall of
the City of Santa Aha is hereby fixed as the time and place for hearing
all persons interested in or objecting to the proposed vacation andabandon-
merit of any of the portions of streets or alleys hereinabove described.
SECTION 5: The Street Superintendent of the City of Santa Aha is
hereby ordered and directed to post eonspiciously along the line of that
portion of each street or alley herein proposed to be vacated, notices
stating the passage of this Ordinance of Intention to vacate and stating
the time and place of hearing herein fixed, which said notices shall be
posted not more than 300 feet apart and at least three of such notices
shall be posted along the line of each portion of each street or alley
herein described.
SECTION 6: The City Clerk shall certify to the passage of this Or-
dinance and shall cause the same to be published in three consecutive is-
sues of the Santa Ana Register, a newspaper printed, published and circu-
lated in the City of Santa Aha, and hereby designated for that purpose.

ORDINANCE NO. 1221
AN ORDINANCE PROVIDING FOR THE LICENSING, ESTABLIS~MENT
AND REGULATION OF AMUSEMENT CENTERS, FIXING CONDITIONS
AND FEES THEREOF, PROVIDING A PENALTY FOR VIOLATION AND
REPEALING SECTION #40 OF ORDINANCE ~1155.
THE CITY COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS:
SECTION 1: Section #~0 of Ordinance #1155 entitled "AN ORDINANCE
REGULATING LICP~SE FEES IN THE CITT OF SANTA ANA" is hereby repealed.
SECTION 2: It shall be unlawful for any person, firm or corporation
to erect, establish, open, operate, maintain, or carry on any amusement
center as herein defined, without first having made application in writing
to the City Council of the City of Santa Aha for a permit so to do, and
without first having obtained a license from the City Clerk of the City of
~anta Aha, as herein provided.
SECTION 3: A. The applicant desiring to establish, maintain or car-
ry on an amusement center in the City of Santa Aha shall file an applica-
tion in writing addressed to the City Council, setting out his name, ad-
dress, the exact nature of the amusement items, rides, stands, and/or other
concessions or related activities proposed to be established or carried on,
the address and legal description of the property upon which said activi-
ties are proposed to be established, and reciting the fact that he has re-
ported to the Police Department of the City of Santa Ana and has been
photographed and fingerprinted prior to the filing of said application.
B. Upon receiving such application the City Council
shall set the same for public hearing and shall cause notice of such hear-
ing to be given by posting notices thereof for at least ten days prior to
the date of such hearing .within a radius of 300 feet of the external
boundaries of the property proposed to be used for said amusement center.
Said notices shall be posted not less than three to each 300 feet of pro-
perty frontage within said radius, and the heading shall be printe~ in
blain type not less than one inch in height. The heading shall state "NO-
TICE OF PROPOSED A~USE~ENT CENTER", and such notice shall carry a state-
ment in six or eight point type, describing the property, giving the street
address of its frontage, and shall contain a brief statement of the nature
of the activities proposed to be established on said property.
C. The public hearing provided for herein shall be con-
ducted by the City Council, and they shall hear and consider all persons
present or petitions presented to them. The City Council shall call for a
recommendation from the Chief of the Police Department, the Pls~ing Engin-
eer or a report of the Planning Com~ission, and may require the Chief of
the Fire Department or the Assistant Chief of the Fire Department to re-
port on said proposed location.
D..Following said hearing the City Council shall either
grant or deny the permit applied for by minute order. Said permit shall
be revokable for cause.
SECTION 4: A. No amusement center shall be operated within the City
of Santa Ana unless there is first obtained from the City Clerk of the
City of Santa Aha a license so to do, which license shall be issued under
the exact terms and conditions of the permit granted by the City Council.
B. A fee of $25.00 per quarter shall be charged, which
shall cover the first five mechanical amusement devices, rides, vending
stands, concessions or related amusement units operated in said amusement
center, which said'five shall be specified on the license, and there shall
be an additional fee of $5.00 per quarter for each related amusement unit
in excess of said five units.
l C. The Clerk shall not issue any license for an amuse-
ment center unless there has been a permit issued therefor by the City
Council as herein provided.
SECTION 5: Amusement centers shall not be located in any district
in the City of Santa Ana other than those designated as C-l, C-2, M-l,
in Ordinance #107~, as amended.
SECTION 6: An amusement center is defined as a permanent location
whereon or wherein are maintained mechanical devices or animals for fur-
nishing rides or movement to humanbeings in a limited area, mechanical
amusement devices of any description and/or operated in conjunction with
vending stands, entertainments or related amusement functions catering pri-
marily to minors and for which a fee, fare or consideration is charged.
SECTION 7: No amusement center in the City of Santa Ana shall be
open for operation between the hours of lO:O0 P.M. on any day and ll:O0
A.M. on the succeeding day, nor'earlier than l:O.O P.M. on any Sunday.~
SECTION S: A. No amusement center in the City of Santa Ana shall
be operated at any time u~less there is maintained theraon or therein
facilities for male and female persons, in separate eom-
adequate toilet
part~ents.
B. The entire area in and around any amusement center
shall be maintained free from combustible trash or waste, to the end that
no undue fire hazard may occur and during the hours that it is open to
the public all parts thereof shall be freely open to inspection by the
Fire and the Police Departments of the City of Santa Aha.
C. Any canvass or other cloth used to entirely enclose
any portion of any amusement center shall be flame proof by a process car-
tilled by Underwriters' Laboratories, Inc.,or other laboratories of recog-
niz6d standing and approved by either the Chief or the Assistant Chief of
the Fire Department.
D. No amusement center shall make any unnecessary or
unreasonable noise by loud speakers or amplifying devices.
SECTION 9: Any person, firm or corporation who violates any provi-
sions of this Ordinance shall be gaiety of a misdemeanor and upon convic-
tion thereof shall be punishable by a fine of not more than $300.00, or by
imprisonment in the County Jail for a term not exceeding 90 days, or by
bot~ such fine and imprisonment.

AN ORDINANCE AMENDING THE UNIFORM BUILDING CODE,
1948 EDITION, ADOPTED BY ORDINANCE NO. 1180
OF THE CITY OF SANTA ANA.
THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS:
SECTION 1: That Section 1003, Chapter 10, entitled "Location on Pro-
perty", of the Uniform Building Code, 1946 Edition, as heretofore adopted
by Ordinance No. ll80 , is hereby amended to read as follows:
"All exterior walls or parts of walls except on street fronts,
of Group E occupancies, which are less than five feet (5') from adjacent
property lines, shall have no openings therein and shall be of not less
than four-hour fire-resistive construction; such walls five feet (5') or
more but less than ten feet (10') from adjacent property lines except on
street fronts, shall be of not less than two-hour fire-resistive construc-
tion; all walls of type 5 construction more than ten feet (10') from pro-
perty lines shall be not less than one-hour fire-resistive construction,
and shall be constructed as specified in Parts V, VI, and VII of this
Code. Ail openings in exterior walls except on street fronts, which are

SECTION 2: That Section 1103, Chapter 11, entitled "Location on
Property", of the Uniform Building Code, 1946 Edition, as heretofore adop-

property l~nes shall have no openings therein, shall be of not less than

SECTION S: That Section 1602, Subdivision B, Chapter 16,
entitled "Limitations of Types of Consoruction", of the Uniform
Building Code, 1946 Edition, as heretofore adopted by Ordinance
1180 , is hereby amended to read as folios:

be not less than one-hour fire-resistive construction, provided, however~
temporary partitions dividing portions of stores, offices, or similar
places occupied by one tenant only may be constructed of wood panels or

SECTION 1: That Section 4 of 0rdinsnce #821 of the City of Santa
Ana is hereby amended to read as follows:
"Section 4. LICENSE. Any person, firm or corporation,
carrying on the business of Pltumbing, constructing or assuming control
of any Plumbing house drainage, or gas-fitting affecting the sanitary
conditions of any house or building situated within the limits of Santa
Ana shall first obtain a license therefor, from the City Clerk of said
City, and shall pay therefor the sum of Twenty-five Dollars ($25.00)
per quarter year, or any portion thereof, and for the purposes of this
Ordinance the year shall be divided into quarters commencing respective-
ly on the 1st day of January, the 1st day of April, the 1st day of July,
and the 1st day of October of each and every year. The license herein
provided for may be purchased upon an annual basis at the option of the
licensee. No person, firm or corporation shall engage in the business
or work of plumbing, gas-fitting or house drainage without first procur-
ing the license herein provided for.
SECTION 2: That Section 18 of Ordinance #821 of the City of Santa
Ana is hereby amended to read as follows:
"Section 18. EXAMINATION. No person, as principal, agent,
manager or employe, shall conduct, manage or carry on the trade, business
Or calling of a master plumber or work as a Journe2man, or do any plumb-
ing of any kind or description in the City of Santa Ana, for which a
plumbing permit is required, except as here~ nafter in Section 29 provided,
without first having submitted to a practical examination before, and ob-
taining from the examining board of plumbers of the City of Santa Ana, a
certificate of competency showing such persons to have sufficient practi-
cal experience and sufficient knowledge to do plumbing work. If appli-
cant fails to pass such ex-m~nation he can again make application to take
examination, but not before a period of thirty (30) days has elapsed."
SECTION 3: That a new Section, numbered 20~, is hereby added to Or-
dinance #S21 of the City of Santa Aha to read as follows:
"Section 20~. COMPENSATION OF EXAMINERS. The compensation
of each member of the Examining Board while serving as such member shall
be as established by Resolution of the City Council, but shall not be less
than $5.00 for each meeting."
SECTION ~: That Section 29 of Ordinance #821 of the City of Santa Aha
is hereby amended to read as follows:
"Section 29. REGISTRATION. (A~ All master plumbers,
journeyman pl,,mbers and apprentice plumbers shall register their names
and addresses in a book kept for that purpose in the office of the Build-
ing Department of the City of Santa Aha, and no permit shall be issued to
any person, firm or corporation to do any plumbing, drainage, gas-fitting
or other work regulated by this Ordinance unless such person, firm or
corporation is registered in such book as provided herein and holds a
valid unexpired and unrevoked certificate under the terms and conditions
of this Ordinance, except under the terms and conditions and as otherwise
next hereinafter in this Section provided.
(B) Any permit required by this Ordinance may be issued to
any person to do any construction or work regulated by this Ordinance in
a single family dwelling used exclusively for living purposes, including
the usual accessory buildings and Quarters in connection with such build-
ings in the event that any such person is the bona fide owner of any such
dwelling and accessory buildings and Quarters, and that the same are oc-
cupied by or designed to be occupied by said owner. No plumbing or drain-
age work for which a Permit is required shall be commenced in any building
~r premises until a Permit to do such work shall have been first obtained.
No person, except the holder of a valid unexpired and un-
revoked certificate under the terms and conditions of this Ordinance,
shall be granted nor allowed a second plumbing Permit allowing plumbing

last such permit granted to him.

THE COUNCIL OF THE CITY OF SJ~NTA ANA DO ORDAIN AS FOLLOWS:
SECTION l: That Ordinance No. 349, entitled "AN ORDINANCE REQUIR-
ING THAT N~ STREETS IN NEW SUBDIVISIONS SHALL CONFOPd~I TO THE STREETS
ALREADY EXISTING IN SAID CITY", that Ordinance No. 574, entitled "AN 0R-
DINANCE TO ADD SECTION l½ TO 0RD~ANCE NO. 349", and that Ordinance No.

SECTION 2: That the City Council of the City of Santa Ana shall
not accept any new streets, alleys, new subdivisions of land, or t~e
maps thereof until all the following provisions applicable thereto have
been complied with, and when the streets or alleys are improved at the
time they are offered to the City they shall not be accepted ~u~less
said improvements meet the minimum requirements next hereinbelow set
out.
(a) Before submitting any street or subdivision map to
the City Council for its approval a plat showing a complete layout of
streets, alleys, lots .and blocks with~ the boundaries of the area to
be subdivided shall be submitted to the Planning Commission for its ap-
pr oval.
(b) After the Planning Commissio~ has aoproved the proposed
subdivision map, the original tracings of the subdivision map to be filed

shall be submitted to the Board of Trustees, together with cash, a cer-
tified or cashier's check, or surety bond, to be approved by the Board
of Trustees, in the amount of the estimated cost of the improvements as
a guarantee that the improvements will be made, with a statement list-
ing the specific improvements to be made.
(c) The following improvements are required on all new
streets; the construction of curb and sidewalk, the installation of
water, sewer and gas mains; the installation of sewer laterals and water
services from mains to curbs; and the grading and paving of streets and
alleys, except that the Board of Trustees may at its option omit the re-
quirement for sidewalks where the construction of sidewalks wouid not
conform 'to the aopearance of the surrounding subdivided and occupied
area.
(dl All sidewalks and curbs shall conform to existing 0rdin-
ances and requirements of the City of Santa Ana.
(e) All grading, preparation of the subgrade, and all sur-
facing shall be done in accordance with the Standard Specifications of
the Department of Public Works, Division of Highways of the State of
California, and to any and all special provisions and requirements of the
City of Santa Ana which may be in force at the time.
~ (f) The minimum requirements for surfacing of streets and al-
leys in strictly residential areas not subject to heavy, fast traffic
shall be an untreated rock or crusher run base 4 inches thick after
thorough compaction, upon which shall be laid plant-mix surfacing, the
thickness of which shall be not less than 2½ inches when compacted.
(g) On streets which are subject to or may become subject to
heavy and/or fast travel the Board of Trustees may require a thicker sub-
base and surfacing than the minimum requirements.
(h) On streets now open to public travel on which an asphalt,
concrete, or oil mix surfacing has been constructed in the central por-
tion of the street, the above requirements on surfacing shall apply to
all of that portion of the street lying between the edges of the ribbon

surfacing now maintained by the pity (normally considered to be 18 feet
wide) and the curbs, except that under no conditions will gravel surfac-
ing and/or any application of so-called penetrating oil be cons~ered as
surfacing.

~i) In conformance with Sections 14 and 26 of the/~tandard
Specifications and these additional requiremants, contracts for surfac-
ing may be let by the ton of surfacing material, by the ton of paving
asphalt and mineral aggregate, or by the square foot of area to be sur-
faced. Where any contract is awarded on a square foot basis the follow-
ing conditions shall be complied with: After the subgrade has been com-
p~ted it shall be accurately checked for grade and cross-section and any
areas found to be higher than the subgrade elevation, as shown on the
plans, shall be brought to the correct elevation. After the rock base
has been thoroughly compacted but before any surfacing or prime coat has
been applied a scratch templet which is cut to the exact cross-section
of the street shall be dragged along the street in such a manner that any
hig~ areas will be readily observed and cut to grade.
(j) All water lines will be installed as prescribed in Ordin-
ance No. 1216 and amendments thereto.
(k) All sewer lines and sewer laterala shall be of vitrified
clay sewer pipe. In case the sewer pipe is of the bell and spigot type
aufficient oakum or jute, or a rubber ring, shall be pressed into the an-
nular space between the body of the pipe and the bell before pouring the
joint to prevent any of the joint compound from entering the sewer pipe.
The joint shall then be poured with a coal tar compound, commonly known
as CPI-2, recommended by the Cl~y Institute of California, Southern Divi-

IS AN ORDINANCE I~EGULATING 'lIME LICENSE FEES
OF THE CITY OF SANTA ANA.
THE COUNCIL OF THE CITY 0F SANTA ANA D0 ORDAIN AS FOLLOWS:
SECTION 1. That Ordinance No. 658 entitled "An Ordinance Provid-
ing for the Licensing of Business, Shows, EXhibitions, and Games Conduct-
ed or Carried On in the City of Santa Ana, Fixing the Rate of License
Therefor, and Providing for the Collection Thereof", be, and the same is
hereby amended by amending Section 17A thereof, which said Section 17A
was last amended by 0rdinance No. 1155, so that said Section 17A will
read as follows:
"SECTION 17A. It shall be unlawful for any person, firm, corpora-
tion or association to sell, dispose of, or offer for sale at public
auction in the City of Santa Ana, California, any platinum, gold, silver
or plated ware, precious stones or semiprecious stones, watches or other
jewelry, or furniture, rugs or other house furnishings, whether the same
shall be their own property or whether they shall sell the same as agents
or employees of others, except judicial sales or those made by executors
or administrators of the estates of decedents, and excepting also sale
made at public auction of the stock on hand of any person or persons or
corporation that shall for the period of one year next preceding such
sale have been continuously in business in the City of Santa Aha, Califor-
nia, as a retail or wholesale merchant; provided that in the latter case,
before such merchant may hold an auction, he must obtain a permit therefor,
which shall be applied for and issued in the following manner: Said mer-
chant shall, not less than fifteen (15), nor more than thirty (30) days
previous to conducting such sale, make a written application therefor
under oath to the City council specifying the name and address of the ap-
plicant, the location and purpose of the sale and its expected duration
and itemizing in detail the quantity, quality, kind or grade of each item
of goods, wares and other articles to be sold, the wholesale market value
thereof, and the name of the auctioneer who shall conduct the sale. The
application shall then be investigated by the Chief of Police and a re-
port made thereon by him to the City Council as to the character of the
applicant and his auctioneer, the bona fide ~ture of the purpose of the
sale and whether the place where it is proposed to carry on said sale
is a proper place. The City Council must be furnished also with satis-
factory evidence that the merchandise, proposed to be sold, is a bona
fide part of the merchant's stock in trade and not secured, purchased or
brought into said place of business for, or in anticipation of, said
sale. In considering the application and attending the facts, the City
Council shall exercise a reasonable and sound discretion in granting or
denying the permit applied for. Such sale at public auction shall be
held on successive days, Sundays and legal holidays excepted, and shall
not continue for more than thirty (30) days in all from the commencement
of the sale, and shall be permitted only where such merchant is bona
fide disposing of his stock for the purpose of retiring from business.
Such auction shall be conducted during the daytime between the hours of
9:00 A.M. and 8:00 P.M.
Save and except also a sale made at public auction of the furniture,
~gs and other household furnishings of an individual or family who has
for more than ~ne year prior to their application maintained their resi-
dence in the City of Santa Aha. In the case of such ~ndividual or family
desiring to dispose of said items at public auction, application shall be
made to the City Clerk of the City of Santa Aha at least five (51 days
prior to the first date upon which said auction is proposed to be held,
to afford an opportunity for investigation of said person, the auctioneer
and the itemized inventory by the Chief or-Police. Said application shall
be accompanied by an affidavit stating the name or names of the owners of
the property, a complete inventory of the items to be offered for sale,
and their estimated value, the place where the sale will be held, and the
name of the auctioneer. If it appears therefrom that the sale is in all
respects a bona fide sale of the household goods of one individual house-
hold, then a permit to hold said sale at public auction shall be granted
by the City Clerk. No auction sale of an individual's household goods or
effects, as in this subparagraph referred to, shall continue for a greater

period than twenty (20) days, including the day of the first auction sale.
Every person employed as an auctioneer to conduct a public auction as
herein provided shall obtain a permit from the City Clerk ~r the purpose
of conducting such public auction, and shall pay a license fee of ten dol-
lars (~10.00) per day."

SECTION l: That Ordinance No. ll91, entitled "AN ORDINANCE OF
THE CITY OF SANTA ANA PROVIDING FOR AND REGULATING THE USE OF PARKING
METERS, AND REPEALING ORDINANCES NUMBERED llll, lll3, 1129 AND 1147."
is hereby amended by amending Section 7, Section 10, Section ll, and
Section lB of said Ordinance, and by adding thereto a new section num-
bered Section 7A, which shall be added to said Ordinance immediately
following the eno of Section 7 thereof.
SECTION 2: That Section 7 of Ordinance No. ll91 is hereby amend-
ed to read as follows:
"Section 7. VIOLATIONS. It shall be unlawful and a viola-
tion of the provisions of this Ordinance for any person:
(a) To cause, allow, permit or suffer any vehicle registered
in the name of or operated by such person to be parked overtime or be-
yond the period of legal parking time as herein provided, or to remain
parked in any metered parking space adjacent to a parking meter while
the sigGal showing legal parking is not displayed by said parking meter,
or to deposit in any parking meter any coin for'the purpose of parking
beyond or longer than the maximum legal parking time limit for that
particular parking area.
(b) To park any vehicle across any line painted upon the
pavement, or any similar marking of a parking meter space, or in such a
position that ~he vehicle shall not be entirely within the area desig-
nated by such line or markings.
(c) To use any parking space set off by painted lines on the
pavement along side of and next to a parking meter for the purpose of
standing, storing or parking any object or thing other than a vehicle
used for transportation, without first obtaining permission from the
Chief of the Police Department so to do."
SECTION 3: That Ordinance No. ll91 is hereby amended by adding
thereto a new section, to be known and numbered as Section 7A, to be
inserted at the end of Section 7 and before Section $ of said Ordinance,
which said new Sec~Qn 7A shall read as follows:
"Section 7~. CONTLNUING VIOLATIONS SEPARATE OFFENSES. Every
person violating Sections Six (6) or Seven (7) of this Ordinance by
failing or refusing to deposit the proper coin in a parking meter, by
leaving the vehicle parked after the meter shows a signal indicating
that the lawful parking period for the coin deposited has e×pired, or
by depositing in any parking meter any coin for the purpose of parking
beyond the maximum legal parking time for the particular Traffic Zone
as designated by the City Council and shown by the adjacent parkin~
meter, is guilty of a further and separate violation for each period of
time, equal to the maximum legal parking time for tho particular Traffic
Zone, or parking space, as designated by the City Council, that the ve-
hicle is left so parked."
SECTION 4: That Ordinance No. ll91 is hereby amended by amending
Section l0 thereof to read as follows:
"Section 10. ENFORCEMENT. It shall be the duty of each
police officer to take the number of any meter at which any vehicle or
thing is parked, placed, ranked, stored or left in violation of any of
the provisions of this Ordinance, the State vehicle license of such ve-
hicle; the time and date of such over-parking, and the make of such ve-
hicle, and issue, in writing, a citation for said violation in the same
form and subject to the same procedure provided for by the Ordinances of
the City of Santa Ana and the laws of the State of California applicable
to the traffic violation withal said City.
Any operator or owner of ~ vehicle to whom a citation has
been issued may, within twenty-four hours of the time of the issuance of
said citation, pay to the Clerk of the City Court as a penalty for, and
in full satisfaction of such violation the sum of one dollar ($1.00).

Said payment may be made in person or by mailing said sum to the Clerk
of the City Court, City Hall, Santa Ann, California, within said period
of twenty-four hours. The failure of such owner or operator to make
such payment within said twenty-four hours shall render such owner or
operator subj eot to the penalties hereinafter provided for violation of
the provisions of this Ordinance."
SECTION 5: That Ordinance No. ll91 is hereby amended by amending
Section ll thereof to read as follows:
"Section ll. USE OF FUNDS. That all money deposited in said
parking meters shall be deposited in a special fund, to be known as-the
'Parking Meter Fund", and shall be used exclusively for the purchase, in-
stallation, maintenance, repair, servicing and policing of said parking
meters and pavement markings in the Traffic Zones wherein parking is re-
gulated or controlled by parking meters, for the proper regulation of
traffic, the elimination of traffic violations upon the public streets of
the City of Santa Ann, for the ~limination of traffic hazards, the re-
alignment, improvement and widening of streets to expedite orderly traf-
fic movement, the purchase, installation and maintenance of mechanical
traffic control devices, and the purchase or lease and operation of lead
for off-street parking within the City of Santa Ann, or any of them, as
the City Council of the City of Santa Ann may determine."
SECTION 6: That Ordinance No. ll91 is hereby amended by amending
Section l~ thereof to read as follows:
"Section 14. PENALTIES. Any person violating any of the pro-
visions of this Ordinance shall be deemed guilty of a misdemeanor and
upon conviction thereof shall be punished by a fine of not less than two
dollars ($2.00) nor more than fifty dollars ($50.00), or by imprisonment
in the County Jail for not more than five days, or by both such fine and

pervisors of Orange County, California, and fixed the sum as shown by

operative property, and showing the total value of all prpperty belong-
ing to public utilities and used as operative property of such public

by elect to levy a total tax during the fimcal year of July l,
June 30, 1949, for all purposes provided in Subdivision 9 of Section
#764 of an Act of the Legislature entitled "An Act to Provide for the
Organization, Incorporation and Government of Municipal Corporations",
Statutes of 18S3, page 93 as amended, but exclusive of the tax for li-
brary, state retirement, recreation, bond, interest and sinking fund
purposes, in excess of One Dollar, but not in excess of One Dollar and
Twenty-five cents 151.25) on each One Hundred Dollars of the assessed
value of all real and personal property within the said City of Santa
Aha, as set forth in this Ordinance.
SECTION ~: This Ordinance is urgently required for the imme-
diate preservation of public health, peace and safety. The following
is a specific statement showing the urgency of this Ordinance:
That the revenue to be derived from the taxes to be levied and
collectsd in accordance with the terms hereo~ is necessary for the pre-
servation of public health, Peace and safety; and in order for this.Or-
dinance to be in effect in time required for this year's tax levy, an
ordinance is now immedistely required.
SECTION 6: The City Clerk shall certify to the passage and adop-
tion of this Ordinance by a vote of five members of the City Council of
the City of Santa Ana,~and shall cause the same to be published by one

insertion in the Santa Aha Register, a Newspaper printed, published and
circulated in the City of Santa Ana and hereby designated for that pur-

the City 0ouncil grant such variance, in the manner provided herein,
from the terms of this ordinance as it deems to be necessary to assure
that its spirit and purpose will be observed, public safety and welfare
secured, and substantial justice done. The granting of such variance
shall conform to the following procedures and consideratimns:
(a) Upon the filing of a verified petition by a property owner,
or upon its motion, the Planning Commission of the City of Santa Aha
shall give public notice of the intention to consider the granting
of a variance as provided in Sections 12 end 14 hereof.
(b) Not more than thirty (30) days following said hearing the
Planning Commission shall announce its findings by formal resolution,
and said resolution shall recite among other thihgs the facts and
reasons which, in the opinion of the Planning Commission, make the
granting or denial of the variance necessary to carry out the provi-
sions of this Section amd the general purpose of this ordinance, and
if such resolution recommends that the variance be granted, it shall also
recite such conditions and limitations as may be imposed to serve the
purposes of this Section.
Such resolutions shall be numbered consecutively in the order
of their passage, and shall become a permanent record of, the Planning
Commission, and when so recorded shall be referred to the City Council
of the City of Santa Aha, as provided in ostrich 1~ and if approved
by the City Council such resolution shall govern all administrative
processes with reference to the property involved.
(c~ Before any variance, may be granted, it shall be shown:
(1) That special circumstances attach to the property or to
the intended use covered by the application or in the motion of the
Flanning Commission which do not generally apply to the other property
in the same district and vicinity.
2. That because of said special circ,,m-tances, property covered
by application or motion of the ~lanning Commission is deprived of
privileges possessed by other properties in the same district and
vicinity, and that the granting of the variance is essential to
the enjoyment of a substantial property right possessed by other
property in the sam~ district and vicinity.
3. That gra~ting the variance will not result in material damage
or prejudice to other property in the same district amd vicimity.
(d~ Application for a variance shall set forth in detail such
facts as in the opinion of the applicant pertain to sub-paragraphs
- 2 -
1, 2 and 3 of paragraph (c) of this Section.
Ail acts of the Planning Commission or the City Council under
the provisions of this Section shall be construed as administrative
acts performed for the purpose of assuring that the intent and pur-
poses of this ordinance shall apply in special cases as defined in
this Section, and shall not be construed as amendments of the provi-
sions of this ordinance or of the map which is a part hereof."
SECTION 3. That the sub-divlsionentitled "R~.&RINGS" under
Section 14 of said Ordinance, is hereby amended to read as follows:
"HEARINGS. Public hearings as provided in this section shall
be conducted before the City Planning Commission, or before any
member thereof designated by the Commission tO SO serve. The Commission
may establish its own rules for the conduct of public hearings and
the member of the commission presiding at any such hearing is hereby
empowered to a~m~uis~er oaths to any person testifying before it.
S,,mm"ry of all pertinent testimony offered at a public hearing
and the names of persons so testifying shall be rezorded and made a
part of the permanent file of the case as provided for in paragraph
of this Section entitled "Petitions".
If, for any reason, testimony on any case set forth for publie
hearing cannot be completed on the day set for such hearing, the
Commissioner presiding at such public hearing may, before the adjourn-
ment or recess thereof, publicly announce the time and place to and
at which said hearing will be continued and such announcement shall
serve as sufficient notice of such continuance and without recourse
to the form of public notice as provided for in the first instance
by this Section.
Upon the c~npletion of a public hearing, relative to any variance,
the City Planning Commission shell, not later than thirty (30) days
thereafter, render its decision in the matter. Failure to so act
within said thirty (30) days shall serve to automatically and im-
mediately refer the whole matter to the City Council for such action
as it deems warranted under the circumstances, unless: (1) An extension
of time is agreed upon with the applicant or his agent.
(2.) One or more additional hearings are considered by the Commission
to be advisable.

(3) A longer period is deemed necessary for consideration in
case of proceedings initiated by the Commission.
The Plauning Commission shall announce and record its action by
formal resolution and shall, within ten (101 days of such action, report
the same, together with ~ll records in the matter to the City Council.
Such resolution shall recite the findings of the Planning Commission
upon which it bases its decision.
'l~ne recommendations of the Planning Commission in the matter of
variance applications shall be advisory only. After the action of the
Planning Commission has been reported to the City Council of the City
of Santa Aha, the said Council, may grmat or deny such application,
provided however, that if the recommendation of said Commission should
be rewersed by the City Council, such action shall be by formal resolu-
tion setting forth the findings upon which said City Council's decision
is based. If the Commission's recommendation is ~proved by said City
Council, its action in granting or denying a variance may be by minute
order based upon the Commission's resolution in the matter. The City
Council at the time of granting a variance, may impose such conditions
~ d limitations as may be deemed necessary.
The decision of the Planning Commission in the legislative matter
of a~ending district boundaries or use classifications as established
by this ordinance shall be advisory only. If an application involving
an amendment be approved, then not later than ten (10) days after final
action by the Planning Commission thereon, its recommendshion together
with the complete records of the case shall be delivered to the City
Council of the City of S~ta Aha. After the City Council has acted,
the records of the case shall be returned for permanent filing in the
records of the Planning Commission. The minutes orresolutions of
action taken shall be notice to all persons.
SECTION 4: The City Clerk shall certify to the passage of this
Ordinance and shall cause the smue to be published in three consecutive

AN ORDINANCE REGULATING TRAFFIC MOVEMENT
AND PARKING ON THAT CERTAIN CITY PROPERTY
BOUNDED ON THE SOUTH BY 6TH STREET, ON THE
WEST BY SHELTON STREET, ON THE NORTH BY 8TH
STREET AND ON THE EAST BY FLOWER STREET.
THE CITY COUNCIL OF THE CITY OF SANTAANADO O~F~AINAS FOLLOWS:
SECTION l: It shall be unlawful for any person to drive,
park or place any motor vehicle or trailer upon any portion of
that certain property belonging to the City of Santa Aaa, Calif-
ornia, bounded on the South by the North curb line of 6th
Street, on the West by a line 106 feet East of and parallel
to the West curb line of Shelton Street, on the North by the
South curb line of 8th Street and on the East by a line 310.15
feet East of and parallel to the West curb line of Flower
Street which is landscaped, cultivated, seeded or planted.
SECTION 2: It shall be unlawful for any person to
park or place any trailer of whatsoever type, upon any portion
of said property and leave the same so parked or placed, for
a period of time longer than 24 hours without first having
obtained a permit from the City Marshal so to do.
SECTION 3: It shall be unlawful for the operator of
any vehicle to park, place or rank the same on any portion
of said property within 100 feet of any vehicular entrance
thereto or exit therefrom, except where the paved orimproved
surface has been marked to indicate that parking is permitted
by the placing of lines or mm~ks upon the surface of said
paved or improved portions of said property.
SECTION 4: It shall be unlawful for the operator of
any vehicle to park, place or rank the same upon any pDrtion
of said property immediately adjacent to or on any portion of
said property which has been marked in red or which has been
marked by words or sign to indicate that no parking is per-
mitted, or to park, place or rank said vehicle adjacent to
any curb which has been painted red or which bears a sign
indicating that no parking is permitted.
SECTION 5: It shall be unlawful for the operator of
any vehicle to place, park or rank the same in any area or
portion of said property where the pavement, curb or area
has been marked to indicate a loading zone or passenger load-
ing zone by word~ or sign or where said paving or curbing has
been painted white or yellow and to leave the same so placed,
parked or ranked for a longer period of time than 5 minutes,
or to leave any vehicle parked, placed or ranked on any
portion of said property where the paving or curb is mar~ed
or the area is designated by sign to indicate a maximum time,
for any period of time longer than the period indicated by
said words or sign.
SECTION 6: It shall be unlawful for any person to
park or place any vehicle on any portio~ of said property re-
served for parking as indicated by parallel lines painted
upon the paving or improved surface unless said vehicle be
so parked, placed or ranked as to be entirely within one
space as indicated by said painted lines.
SECTION 7: The City Clerk shall certify to the pass-
age of this Ordinance and shall cause the same to be pub-
lished in three consecutive issues of the Santa Aaa Register,
a newspaper printed, published and circulated in the City of

AN ORDINANCE APPROVING THE ANNEXATION OF THAT
PORTION OF ORANGE COUNTY WATER WORKS DISTRICT
NO. 6 LYING AND BEING OUTSIDE OF THE. CITY OF
SANTA AMA, CALIFORNIA
WHEREAS the City Council of the City of Santa Aha did hereto-
fore by Resolution Number 3702 initiate annexation proceedings cover-
lng certain uninhabited territory contiguous to said city, which
said Resolution was regularly published in the Santa Ana Register,
a newspaper of general circulation, published in said city once a
week for two successive weeks prior to the hearing on said proposed
amuexation, which said hearing was set by said Resolution so pub-
lished, on the 1st. day of November, 1958, and
WHEREAS at said hearing on the let. day of November, 1958
there were no objections to said proposed annexation and no written
protest vms filed by any person against said proposed annexation.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF SANTA ANA DO
ORDAIN AS FOLLOWS:
SECTION l& That after due hearing regularly held upon
due notice as hereinabove set forth, and as in the files of this

ORDINANCE AMENDING ZONING ORDINANCE NO. 1074
WHEREAS, the Planning COmmission of the City of Santa Aha has given
notice of public meetings as required by law in connection with all appli-
catinns to amend the Zoning Ordinance to cover the properties hereinafter
described, and has duly held two public meetings upon the question of each
amendment, and thereafter, by resolution, recommended such amendments to
the City Council for adoption; and
WHEREAS, the City Council gave due and regular notice of a public
hearing to be held before the City Council, and such public hearing has
been duly and regularly held, and the City Council does now find that pub-
lic necessity required the following amendments and changes in the present
classification of certain property in the City of Santa Aha and that the
proposed uses under the proposed new clawsification will not be detrimen-
tal to the surrounding property;
NOW THEREFOP~E, THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS
FOLLOWS:
SECTION l: That Sheet ll of the Districting Map of the City of
Santa Aha of Ordinance No. 1074 entitled "AN ORDINANCE ESTABLISHING DIST-
RICTS WITHIN THE CITY OF SANTA ANA AND ESTABLISHLNG CLASSIFICATIONS OF
LAND USES AND REGULATING SUCH LAND USES IN SUCH DISTRICTS; REGULATING THE
HEIGHT OF BUILDINGS AND OPEN SPACES FOR LIGHT AND VENTILATION; ADOPTING A
MAP OF SAID DISTRICTS; DEFINING THE TERMS USED IN SAID ORDINANCE, PROVID-
lNG FOR THE ADJUSTMENT, AMEI~)MENT A~D ENFORCEMENT THEREOF; PRESCRIBING
