HomeMy WebLinkAbout62-238RESOL~ION NO. 62-238 APPROVING M3~P, DECLARING INTE~ION TO VACATE AN Ui~AMED ALLEY RUNNING NORTH FROM NINETEENTH STREET APPROXIMATELY 146 FEET WEST OF bg\IN STRE~£ AND RESERVING TH~EREFROM A PUBLIC UTILITY EASEME~'~ WH~REAS, a request for the vacation of an unnamed alley, herein described, w~s received and referred to the ~ rtment of Public Works and the Planning Department, which said DeparTmmnts recommended approval of the abandonment subject to certain conditions. NOW, T/IEREFORE, BE IT RESOLVED: That the City Council hereby adopts the map attached hereto, orders the same filed with the original of this Resolution in the office of the Clerk of the Council, and reference is hereby made to said map for the exterior boundaries of the alley right of way proposed to be vacated. The City Council declares its intention to proceed with this vacation under the provisions of the Street Vacation Act of 1941 (Sections 8300 through 8374 of the California Streets and Highways Code) to vacate that certain ~med alley in the City of Santa Ana, County of Orange, State of California, described as: An unnamed alley, being 12 feet in width, running North from the North right of way line of Niueteenth Street for a distance of 117.34 feet, the center line of which is 152 feet West of the West right of way line of Main Street. and _the Southern C~lifc~ui~ ~dtsondomo~ny, . BE IT FURTHER RESOLVED: That the use of said alley by the ~acific Telephone anu 'l~zegraph. Co~pany/requ~res the reservation of an easement to construct, place, operate, inspect, maintain, repair, replace and remove such aerial ~ ~and Rower transmissioD , and underground telephone, ~e~egrapn, communicatmon/structures as s~l CCmlmnhmmayfrom time to time require, con- sisting of poles, anchors, wires, cables, conduits, man holes, markers and necessary fixtures and appurtenances in all or any part of the area of said alley herein proposed to be vacated, and the City Council hereby determines and declares that the public convenience and necessity require the reservation of said easement and right of way for said purposes. BE IT FURTHER RESOLVED: That January ~1, 1963, at the hour of 7:30 P.M., in the Council Chambers, City Hall, Third and Main Streets, Santa Aha, California, is hereby fixed as the time and place for hearing all persons interested in or objecting to said proposed street vacation.
