HomeMy WebLinkAbout62-242RESOLUTION NO. 62-242 FINDING THAT MORE THAN ONE-HALF OF THE LAND OWNERS WITHIN VEHICLE PARKING DISTRICT NO. 1 HAVE NOT MADE WRITTEN OBJECTIONS OR PROTESTS TO PROPOSED SUBSTITUTION PROCEEDING, DECLARING PUBLIC INTEREST AND CONVENIENCE REQUIRE THE SUBSTITUTION TO BE MADE, FINDING THAT ALL LANDS WITHIN THE DISTRICT WILL BE BENEFITED BY THE SUBSTITUTION AND ORDERING THE SUBSTITUTION AS ORIGINALLY PROPOSED WHEREAS, on the 17th day of December, 1962, at a regular meeting of the City Council of the City of Santa Ana, a public hearing was held on the question of substituting a "new property" and location for the parking lot maintained by Vehicle Parking District No. 1 in lieu and instead of the existing parking lot maintained by said District, proposing sale of the "old property", giving estimated values for each property and for the improvement cost on the "new property", all as set forth in Resolution NO. 62-199 initiating a substitution proceeding, which said Resolution was regularly published and posted as required by Chapter 2 of the Vehicle Parking District Law of 1943; and WHEREAS, said meeting was regularly held and it was determined that no owner of assessable land within Vehicle Parking District NO. 1 had made any written objection or protest to the proposed substitution proceeding as an entirety or otherwise; that on call by the Chair no person there present expressed any oral objection or protest to said proceeding; and WHEREAS, after considering all reports and studies, it was found that public interest and convenience require the substitution as set forth in Resolution No. 62-199; that all of the lands within the District will be benefited by the substituted acquisition and improvement in substantially the same degree and proportion as said lands were benefited by the "old property" and that the substitution should be made. NOW, THEREFORE, BE IT RESOLVED: That the owners of more than one-half of the area of assessable land included within said Parking District have not made written objections or protests to the proposed -1- substitution proceeding as an entirety; that no objection or protest, either written or oral, has been made to said proceeding; that the public interest and convenience require the substitution and that all of the lands within the District will be benefited by the substituted acquisition and improvement in substantially the same degree and in substantially the same proportion as said lands were benefited by the "old property"; that in fact said lands will be benefited to a greater degree by the operation of the "new property" than they were by the operation of the "old property". BE IT FURTHER RESOLVED: That the "old property" shall be offered for sale and disposed of in compliance with Section 2613 of the Santa Aha Municipal Code, and that the "new property", situated in the City of Santa Aha, County of Orange, State of California, and described as: PARCEL 1: The East 63.00 feet of Lots 8 and 9, Block 16, of the Town of Santa Aha, as shown on a map recorded in Book 2, Page 51 of Miscellaneous Records of Los Angeles County, California. PARCEL 2: The East 50.00 feet of Lot 5, Block 16, of the Town of Santa Aha, as shown on a map recorded in Book 2, Page 51 of Miscellaneous Records of Los Angeles County, California. EXCEPTING THEREFROM the South 43.90 feet. PARCEL 3: Lot 9 in Block 16 of the Town of Santa Ana, as shown on a map recorded in Book 2, Page 51 of Miscellaneous Records of Los Angeles County, California. EXCEPTING THEREFROM the Easterly 63.00 feet. PARCEL 4: Lot 8 in Block 16 of the Town of Santa Ana, as shown on a Map recorded in Book 2, Page 51 of Miscellaneous Records of Los Angeles County, California. EXCEPTING THERKFROM the Easterly 63.00 feet. ALSO EXCEPTING THEREFROM the Westerly 20.00 feet of the Easterly 83.00 feet of the Southerly 28.00 feet. PARCEL 5: The Westerly 55.00 feet of Lot 5 in Block 16 of the Town of Santa Ana, as shown on a Map recorded in Book 2, Page 51 of Miscellaneous Records of Los Angeles County, California. EXCEPTING THEREFROM the Northerly 7.50 feet of the Easterly 13.00 feet. ALSO EXCEPTING THEREFROM the Southerly 1.20 feet of the Easterly 30.00 feet. PARCEL 6: The West 115 feet of Lot 10 and the North 35 feet of the West 115 feet of Lot 7, in Block 16 of the Town of Santa Ana, as shown on a Map recorded in Book 2, Page 51, of Miscellaneous Records of Los Angeles County, California. -2- PARCEL 7: The East 10 feet of Lot 10 and the East 10 feet of the North 35 feet of Lot 7 in Block 16 of the Town of Santa Aha, as shown on a Map recorded in Book 2, Page 51 of Miscellaneous Records of Los Angeles County, California. shall be acquired by the City of Santa Aha. BE IT FURTHER RESOLVED: That the substitution as described in Resolution No. 62-199 initiating this proceeding is hereby ordered to be made with all expedition possible.
