HomeMy WebLinkAbout63-015RESOLUTION NO. 63-15 AUTHORIZING CONDE~NATION OF REAL PROPERTY FOR THE EASTERLY EXTENSION OF ALTON STREET ACROSS HALLADAY STREET WHEREAS, Alton Street as it now exists dead-ends West of Halladay Street, is inadequate to satisfy the present demand for East-West traffic in this industrial area of the City, and is not adequate to provide for traffic circulation in the area. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Aha hereby finds and determines that public interest and necessity require that Alton Street be extended to and across Halladay Street, and further require that said City do have and acquire an easement for street purposes over, through and across certain land in the City of Santa Aha, County of Orange, State of California, described as: A strip of land 30 feet wide, bounded Southerly by the center line of Alton Street, said center line being on the South line of the Northeast quarter of the Southwest quarter of Section 30 in Township 5 South, Range 9 West, San Bernardino Base and Meridian, as said South line is shown on a map of the Seccombe Addition to Dyer, recorded in Book 8, Page 17, Miscellaneous Maps, Records of Orange County, bounded Northerly by a line parallel with and 30.00 feet Northerly, measured at right angles from said center line of Alton Street, bounded Easterly by the Southerly extension of the East line of Lot 26 in Block "B" of said Seccombe Addition, bounded Westerly by the West line of Lot 26 in Block "A" of said Seccombe Addition. EXCEPTING THEREFROM that portion previously dedicated for Harbor Road now known as Halladay Street. BE IT FURTHER RESOLVED: 1. That the City Attorney is hereby ordered to bring an action in the name of the City to condemn said property necessary to be taken and to do all things necessary to prosecute said action to final determination; 2. That p~blic interest, necessity and convenience require and it is hereby ordered that said City take immediate possession and use of the property herein ordered to be acquired upon compliance with the requirements of law applicable thereto as a right of way for public use; 3. That said public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury; 4. That the City of Santa Ana, a municipal corporation, is authorized and empowered to provide for the opening, extension, widening, construction and maintenance of public streets and highways within the City; 5. That said action in condemnation shall be taken in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain.
