HomeMy WebLinkAbout63-038RESOLUTION NO. 63-38 ENLARGING AND REESTABLISHING AN AREA IN WHICH SANTA ANA CITY EMPLOYEES ARE REQUIRED TO MAINTAIN THEIR RESIDENCE WHEREAS, Section 2202 of the Santa Ana Municipal Code requires that all City employees live within the City or such areas bordering the City as shall be designated by resolution of the City Council, and under authority of such Section, Resolution No. 58-57 was adopted February 17, 1958; and WHEREAS, after study, the Personnel Board of the City has recommended to the City Council an enlargement of the residential area and certain other changes as hereinbelow set out. NOW, THEREFORE, BE IT RESOLVED: That Resolution No. 58-57 is hereby rescinded and that all employees of the City of Santa Ana, excepting Probationary employees, shall establish and maintain residence within the City of Santa Ana as it now exists or as its boundaries may hereafter be altered, or within the area the exterior boundaries of which are next hereinbelow set out, all within the County of Orange, State of California, as follows: Beginning at the intersection of the Southwesterly prolongation of 23rd Street and the Pacific Ocean in Huntington Beach; thence, thence, thence, thence thence thence thence thence thence thence thence thence thence thence thence thence thence thence thence thence Northeasterly along 23rd Street to Golden West; North along Golden West to Garfield Street; West along Garfield Street to Edwards Street; North along Edwards Street to Edinger Avenue; West along Edinger Avenue to Bolsa Chica Road; North along Bolsa Chica Road to Garden Grove Boulevard; East along Garden Grove Boulevard to Knott Avenue; North along Knott Avenue to Cerritos Boulevard; East along Cerritos Boulevard to Beach Boulevard; North along Beach Boulevard to LaPalma Avenue; East along LaPalma Avenue to Dale Street; North along Dale Street to Commonwealth Avenue; East along Commonwealth Avenue to Broo~hurst Street; North along Brookhurst Street to Chapman Avenue; East along Chapman Avenue to Placentia Avenue; Northeasterly along Placentia Avenue to Palm Avenue; Southeasterly along Palm Avenue to Linda Vista; South along Linda Vista to Morse Avenue; Easterly along Morse Avenue to Imperial Highway; Southeasterly and Southerly along Imperial Highway to Santa Aha Canyon Road; thence, Northeasterly along Santa Ana Canyon Road to the Northerly prolongation of the Westerly line of Section 6, Township 4 South, Range 8 West; thence, South along the Northerly prolongation of Section 6 and along the West line of Range 8 West to the Santiago Creek; thence, along the Santiago Creek to the Santiago Reservoir; thence, along the Westerly shore line of the Santiago Reservoir to Santiago Canyon Road; thence, Southeasterly along Santiago Canyon Road to the Northwesterly line of Block 116 of the Irvine Subdivision; thence, Southwesterly along the Northwesterly lines of Blocks 116, 117, 118, 119, 120 of the Irvine Subdivision to Irvine Boulevard; thence, Southeasterly along Irvine Boulevard to the South- easterly line of Block 121 of the Irvine Subdivision; thence, Southwesterly along the Southeasterly lines of Blocks 121, 122, 123, 124, 125, 126 of the Irvine Subdivision to the Southerly corner of Block 126 of the Irvine Subdivision; thence, Northwesterly along the Southwesterly line of Block 126 of the Irvine Subdivision to the Southerly corner of Block 100 of the Irvine Subdivision; -1- thence, Southwesterly along the Southeasterly lines of Blocks 99, 98, 97, 96 and their extension thereof of the Irvine Subdivision to the Pacific Ocean; thence, Northwesterly along the shore line of the Pacific Ocean to the point of beginning. Ail boundaries descriptions are to the center line of the streets and/or creeks. "Residence" as used in this Resolution shall mean the principal place of abode or customary domicile of the employee to which he most frequently returns at the end of his work period and where the majority of his personal effects for day to day use are maintained as distinguished from a cabin, building, apartment, trailer or room where he less frequently sleeps, rests, and spends his leisure hours. BE IT FURTHER RESOLVED: That in exceptional circumstances of extreme hardship where compelling reasons of health or some other c~pelling or unusual circumstance requires a particular place of residence outside of the area delimited hereinabove, the e~ployee may make a detailed written request for a waiver of the residence requirement which shall state the exact location of the non-conforming residence request, the exact details of the reason creating the necessity for such waiver, any and all supporting data and documents such as a medical report by a physician or surgeon licensed to practice in the State of California giving the diagnosis, his opinion, and the basis for his opinion, including any laboratory examinations, physical examinations and X-rays. Such written request shall be filed in triplicate, except that the supporting documents need only be attached to the original thereof, and shall be delivered to the Department Head of the employee. Such Department Head shall attach thereto his personal comments and may include his recommendation and shall deliver the original and one copy to the City Manager within three (3) business days after receipt thereof. The City Manager shall attach to the original thereof his comments and may include his recommendation and shall deliver the original thereof to the Director of Personnel within five (5) days after he receives the same. The Director of Personnel shall present said reques~ at the next succeeding meeting of the Personnel Board. After examining the request and any supporting documents and making such inquiry as it may desire, the Personnel Board may grant a waiver of the residential requirement herein set out or may deny the same. In reaching its determination the Personnel Board shall consider the employee's need for such exceptional treatment on residence location, the employee's personal record, his value to the city as an employee and the effect of a waiver upon City service, the time necessary to reach his place of employment if he be called to perform emergency overtime, and such other matters affecting the public interest as may be presented or appear from the data available to the Personnel Board. Any waiver of residential requirements may be limited or conditioned. The fact of such waiver and any conditions affecting the same shall be filed with the City Manager and the Department Head. -2- PASSED AND ADOPTED by the City Council of the City of Santa Aha at ~ts regular meeting held on the 4th day of March, 1963.
