HomeMy WebLinkAbout63-080RESOLUTION NO. 63-80 INITIATING PROCEEDINGS FOR ANNEXATION OF TERRITORY TO THE CITY OF SANTA ANA, DESIGNATING AN APPROPRIATE NAME FOR SAID TERRITORY OF "SEVENTEENTH AND TUSTIN NORTHWEST ANNEX" AND GIVING NOTICE OF PROTEST HEARING THEREON WHEREAS, at the request of property owners in the territory herein described, a description and map of said territory were pre- sented to the Santa Ana Planning C~¢Lission, which approved annexation of said territory, and to the Orange County Boundary C~mmission, which caused a report to be prepared finding that the boundaries of said proposed annexation met the approval of the Orange County Surveyor's Office in respect to Government Code Section 35002. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby initiates proceedings for annexation of said territory, herein described, to the City of Santa Ana for the following reasons: That the said territory can best be served by the City of Santa Ana with municipal services of the highest quality anywhere obtainable at a cost for such services which is lower than can be obtained anywhere else in the County of Orange. That it is to the mutual advantage of the City and the land owners that said territory become a part of said City. BE IT FURTHER RESOLVED: That the City Council hereby declares its intention to annex all of the territory hereinbelow described under the provisions of the Annexation of Uninhabited Territory Act of 1939; hereby finds and declares that said territory is uninhabited within the meaning of Government Code Section 35303 on the date of the adoption of this Resolution; that said territory is contiguous to the City of Santa Ana, lies in the County of Orange, State of California, and is described as: Commencing at the intersection of the Southerly prolongation of the East line of Tract No. 3992, a map of which is recorded in Book 145, Page 6, Miscellaneous Maps, Records of Orange County, California, with the center line of East 17th Street, said point being on the Southwest corner of the Southeast Quarter of Section 5, in Township 5 South, Range 9 West, San Bernardino Base and Meridian; thence North 40.00 feet at right angles from said center line of 17th Street to a point on the North line of said 17th Street, said point also being an angle point in the city boundary of the City of Santa Ana, as established by Ordinance No. NS-494, and the true point of beginning; and running thence along said city boundary North 0° 17' 25" West 1,273.40 feet along the West line of the Southeast Quarter of said Section 5 to a point on the South line of Lot 9, Block '~", of the A. B. Chapman Tract as surveyed by Frank Lecouvreur in 1870, as shown on a map recorded in Book 102, page 15 of Miscellaneous Maps, Records of said Orange County, and to an angle point in said city boundary; thence North 89° 27' 46" West 664.63 feet along said lot line and along said city boundary to the Southwest corner of said Lot 9 and to an angle point in said city boundary as established by Ordinance Nos. NS-494 and NS-576; thence North 00° 11' 30" East, 272.42 feet along said city boundary to the North line of that certain 11.17 acre parcel of land as shown on a map of survey recorded in Book 8, -1- Page 9, Record of Surveys in the office of the County Recorder of said Orange County, and to an angle point in said City boundary as established by Ordinance No. NS-576~ thence West 415.00 feet, more or less, along said City boundary to the West line of that certain parcel of land conveyed by Frank C. Latham et ux to Eddy Meridith by deed recorded June 7, 1961, in Book 5746, Page 388, Official Records of said Orange County, and to an angle point in said City boundary as established by Ordinance No. NS-576~ thence North 1,073 feet, more or less, along said West line and its Northerly extension and along said City boundary to the North line of Santa Clara Avenue, said North line being 25.00 feet Northerly measured at right angles from the center line of Santa Clara Avenue and to an angle point in said City boundary as establishedby Ordinance No. NS-576~ thence along said City boundary and along said North line of Santa Clara Avenue, East 1,396.00 feet, more or less, to a point on the East line of the West half of Lot 8 in Block "A" of said A. B. Chapman Tract, and to an angle point in said City boundary as established by Ordinance No. NS-576~ thence departing from said City boundary South 50.00 feet along the Southerly extension of said East line to the South line of said Santa Clara Avenue, said South line being 25.00 feet Southerly measured at right angles from the center line of Santa Clara Avenue~ thence East 550 feet, motor less, along said South line to a point that is 298.00 feet West and 25.00 feet South of the Northeast corner of said Lot 9~ thence South 0° 04~ 24" West 175.00 feet~ thence South 44° 55~ 36" East 35.36 feet~ thence South 89° 55~ 36" East 23.00 feet~ thence South 0° 04~ 24" West 564.81 feet~ thence South 89° 43~ 55" East 228.00 feet to the Westerly line of Old Tustin Avenue, said West line being 30.00 feet Westerly, measured at right angles from the center line of Old Tustin Avenue, and to a point on said City boundary, as established by Ordinance No. NS-468~ thence South along said City boundary 1,190.95 feet, more or less, and along said West line of Old Tustin Avenue to the Southwest line of "Royal and Rosetta Mueller" property as shown on a Record of Survey Map filed in Book 6, Page 2, Records of Survey, in the office of the County Recorder of said Orange County, and to an angle point in said City boundary as establishedby Ordinance No. NS-345~ and running thence along said boundary of land annexed by Ordinance No. NS-345 for the following four (4) courses~ North SS° 45~ West, 148.50 feet~ thence North 77° 45~ West, 63.36 feet~ thence North 48° 30~ West, 128.70 feet~ thence South 719 feet, more or less, to a point on the North line of 17th Street~ thence leaving said land annexed by Ordinance No. NS-345 and following said City boundary as establishedby Ordinance No. NS-270, and along said North line of 17th Street, West 850 feet, more or less, to the point of beginning. BE IT FURTHER RESOLVED= That "SEVENTEENTH AND TUSTIN NORTHWEST ANNEX" is hereby designated as an appropriate name by which said territory shall be known for the purpose of this annexation. BE IT FURTHER RESOLVED: That notice is hereby given that June 17, 1963, at the hour of 7:30 P.M. in the Council Chambers, City Hall, Third and Main Streets, Santa Ana, California, is the time and place fixed at which said Council will hear written protests against this annexation made by any person owning property within said territory. At any time before said hearing, any owner of real property within said territory may file written protest against this proposed annexation. Such protest shall state the name of the owner of the property affected and a description of the property sufficient to identify it on the last equalized assessment roll, all as provided for in the California Government Code, Section 35312. -2- PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 6th day of May, 1963.
