COMMISSION AND GRANTING A VARIANCE ON
VARIANCE APPLICATION NO. 1759 FILED BY
THOMAS J. BOWMAN, SUBJECT TO CONDITIONS
WHERE~S, after public hearing on notice, the Planning
Commission denied Variance Application No. 1759, filed by THOMAS'
J. BOWMAN to construct a new wrecking yard office and sales building
in the C-2 and R-2 Districts and located at 3117 West Fifth Street;
and
WHEREAS, Appeal Application No. 83 was duly filed by said
applicant requesting a hearing on said Variance Application before
the City Council; and
WHEREAS, the City Council, after public hearing on notice,
has determined that the Planning Commission should be overruled and
that said Variance should be granted, subject to conditions.
NOW, THEREFORE, BE IT RESOLVED: That the City Council
hereby grants a variance on Variance Application No. 1759 to permit
the property located at 3117 West Fifth Street, in the City of
Santa Ana, County of Orange, State of California, described as:
Lot 16 of Tract No. 477, and a portion of the Northeast
quarter of the Southwest quarter of Section 10, Township
5 South, Range 10 West, San Bernardino Base and Meridian,
in the C-2 and R-2 Districts, to be used for the construction of a
new wrecking yard office and sales building. Said Variance is
granted subject to the following conditions~
1. That a minimum of tan (10) 9' x 20' accessible and useable
off-street parking stalls be provided;
2. That all parking stalls, driveways and maneuvering areas be
on hard surface asphalt or concrete and be marked;
That all lighting used in conjunction with the wrecking
operation and retail sales facilities be reflected away
from any nearby residences;
That an eight-foot solid block wall be constructed around the
entire wrecking yard facility except at the front where the
building forms a part of the wall;
5. That development otherwise conform to all provisions of the
M-2 District.
THE FOLLOWING CONDITION IS TO BE COMPLIED WITH PRIOR TO THE ISSUANCE
OF A BUILDING PERMIT:
6. That the owner pay a drainage assessment fee of $415.00 per
acre on the Northerly 380 feet of the parcel;
THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE
ISSUANCE OF UTILITIES R~LEASE:
7. That the owner provide sanitary sewer and storm drain facilities
to meet with the approval of the Department of Public Works;
8. That sidewalk be placed on all frontage on Fifth Street where
sidewalk does not exist.
