HomeMy WebLinkAbout63-119RESOLUTION 63-119 AUTHORIZING CONDEMNATION FOR STREET PURPOSES FOR TH~ WIDENING AND IMPROVING OF EDINGER AVENUE WHEREAS, Edinger Avenue as it now exists is inadequate in width to acco~unodate the East-West flow of traffic between Harbor Boulevard and Main Street. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby finds and determines that public interest and necessity require that Edinger Avenue be widened as hereinabove set out and further require that said City do have and acquire for street purposes in fee simple title that certain land in the City of Santa Ana, County of Orange, State of California, described as: PARCEL 1: That portion of Lot 12 of Tract No. 1265 in the City of Santa Aha as shown on a map thereof recorded in Book 40, Page 48, Miscellaneous Maps, Records of said Orange County, lying Southerly of the following described line: Beginning at a point on the East line of said Lot 12, 715 feet South of the Northeast corner of said Lot 12, said point of beginning being the beginning of a curve concave Southerly having a radius of 1,098.00 feet, the radial of said curve at said point of beginning coincides with the Easterly line of said Lot 12; running thence Westerly along the arc of said curve to the Westerly line of said Lot 12. PARCEL 2: That portion of Lots 11 and 12 of Tract No. 1265 in the City of Santa Ana as shown on a map thereof recorded in Book 40, Page 48, Miscellaneous Maps, Records of said Orange County, described as: A spandrel shaped parcel of land bounded Westerly by the West line of said Lots 11 and 12, bounded Southerly bY. the North line of Parcel 1 and bounded Northeasterly by the arc of a curve concave Northeasterly having a radius of 25.00 feet and tangent to said Westerly and Southerly boundaries. PARCEL 3: LOt 36 in Block "C" of Tract No. 245, in the City of Santa Ana, as shown on a map thereof recorded in Book 13, Page 22, Miscellaneous Maps, Records of Orange County, California. PARCEL 4: The East 48 feet and 3 inches of Lot 18 in Block "F" of "Tract NO. 245, McFadden Home Place No. 1," in the city of Santa Aha, as shown on a map thereof recorded in Book 13, Page 22, Miscellaneous Maps, records of said Orange County. PARCEL ~.: That portion of Lots 48, 49, 50, 51 and 52 in Block "A" of Tract No. 531 as shown on a map thereof recorded in Book 18, Pages 2 and 3, Miscellaneous Maps, Records of Orange County, California, described as follows: Beginning at the Northwest corner of said Lot 52 and running thence Easterly along the North lines of said Lots 52, 51, 50, 49 and 48 to the Northeast corner of said Lot 48; thence Southwesterly in a straight line to a point on the West line of said Lot 51 which is 3.00 feet South of the Northwest corner of said Lot 51; thence, South- westerly in a straight line along the Southwesterly prolongation of the last-mentioned course, to a point on the West line of said Lot 52; thence, Northerly along the West line of said Lot 52 to the Northwest corner of said Lot 52. EXCEPTING that portion previously dedicated for street and alley purposes. PARCEL ~: A spandrel shaped parcel of land bounded Northerly by the Southerly line of Parcel 5, bounded Westerly by the West line of said Lot 52, and bounded Southeasterly by the arc of a curve concave Southeasterly having a radius of 25.00 feet and tangent to said Northerly and Westerly boundaries. BE IT FURTHER RESOLVED: 1. That the City Attorney is hereby ordered to bring an action in the name of the City to condemn said property necessary to be taken and to do all things necessary to prosecute said action to final determination; 2. That public interest, necessity and convenience require and it is hereby ordered that said City take immediate possession and use of the property herein ordered to be acquired upon cc~pliance with the requirements of law applicable thereto as a right of way for public use; 3. That said public improvement is planned and located in a manner which will be most cc~patible with the greatest public good and the least private injury; 4. That the City of Santa Ana, a municipal corporation, authorized and empowered to provide for the opening, extension, widening, construction and maintenance of public streets and highways within the City; is 5. That said action in cond-~nation shall be taken in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent detain.
