RESOLUTION 63-128 AUTHORIZING COND~4i~ATION OF PROPERTIES FOR THE WIDENING OF EDINGER AVEI~E BETWEEN BROADWAY AND BRISTOL STREET WHEREAS, Edinger Avenue, as it now exists between Bristol Street and ~ain Street, is inadequate in width to accommodate the flow of traffic presently using said street. I~OW, THEREFORE, BE IT RESOLVED: 'l'hat the City Council of the City of Santa Ana does hereby find and determine that public interest and necessity require that Edinger Avenue be widened and improved on the north and south sides, and does require that said City do have, take and acquire, for street purposes, fee simple title to that certain land in the City of Santa Aha, County of Orange, State of California, described as: PARCEL 1: Lots 37 and 38 of Tract No. 1265, as thereof recorded in Book 40, Page 48, Maps, Records of said Orange County. shown on a map Miscellaneous PARCEL 2: 'I~at portion of Lots 1, 2, 3, 4, in Block F of Tract No. 531, as shown on a map thereof recorded in Book 18, Pages 2 and 3, of Miscellaneous Maps, Records of said Orange County, lying within the following described property: Beginning at a point On the North line of Block "F" in Tract No. 531 as shown on a map thereof recorded in Book 18 at Pages 2 and 3 of Miscellaneous Maps, records of Orange County, California, said point being 43.18 feet Westerly, measured along said North line from the Northeast corner of said Block F and running thence North 89° 42' 45" West 206.82 feet along said North line to the Northwest corner of said Block F; thence South 00° 33' 15" West 44.93 feet along the West line of said Block F to a point of cusp in a curve concave Southeasterly, having a radius of 15 feet; thence Northeasterly and Easterly along the arc of said curve through a central angle of 89° 44' 00" an arc distance of 23.49 feet to a tangent line; thence South 89° 42' 45" East along said tangent line which is parallel with and 30 feet South, measured at right angles from the North line of said Block F; a distance of 112.65 feet to a tangent curve concave Northerly, having a radius of 46 feet; thence Northeasterly along the arc of said curve through a central angle of 41° 24' 35" an arc distance of 33.25 feet to a point of reverse curvature; thence Northeasterly and Easterly along the arc of a curve concave Southerly having a radius of 74 feet, through a central angle of 41v 24' 35" an arc distance of 57.10 feet to a tangent line and to the point of beginning. A spandrel shaped parcel of land bounded Northerly by the South line of Parcel No. 15a, bounded Westerly by the East line of Parcel 15b and bounded Southeasterly by the arc of a curve concave Southeasterly having a radius of 25 feet and tangent to said Northerly and Westerly boundaries. BE IT FURTHER RESOLVED: 1. 'fhat the City Attorney is hereby ordered and directed to bring an action in the name of the City of Santa Ana to condemn said property necessary to be taken and to do all things necessary to prosecute said action to final determination; -4- 2. That the public interest, necessity and convenience require and it is hereby ordered that the City take im~aediate possession and use of the property herein ordered to be acquired upon compliance with the requirements of law applicable thereto as a right of way for public use; 3. That said public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury; 4. That the City of Santa Ana, a municipal corporation, is authorized and empowered to provide for the opening, extension, widening, construction and maintenance of public streets and highways withi~ the City; 5. That said action in condemnation shall be taken in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain.
