CITY OF SANTA ANA AUTHORIZING AN AMENDMENT TO
THE CONTRACT BETWEEN SAID CITY OF SANTA ANA
AND THE STATE EMPLOYEES' RETIREMENT SYSTEM
WHEREAS, the City Council of the City of Santa Aha entered
into contract effective July 1, 1947, with the Board of Administration,
State Employees' Retirement System% providing for the participation
of said City in the State Employees' Retirement System; and
WHEREAS, a subsequent amendment effective September 1, 1963,
made by Ordinance NS-672, adopted July 15, 1963, required an increase
of 0.15~ of member payroll in the current service rate of the City
because of the inclusion of Section 20804.5, the amendment thus
provided a new current service rate of 6.693%; and
WHEREAS, said contract provides in accordance with
Section 20127 of the Retirement Law that contributions of the city
are subject to change from time to time as directed by said Board
of Administration in order to provide for the funding of the benefits
on an actuariatly sound basis; and
WHEREAS, the Retirement Syste~had instructed the city that
effective July 1, 1963, it should discontinue the $5.00 monthly
payment by the city for each member covered under the 1959 survivor
program, substituting therefor a monthly amount equal to 0.229% of
the total salaries paid to all members; and
WHEREAS, the amendment made by Ordinance NS-672, adopted
July 15, 1963, was in error in failing to substitute the new rate of
0.22~ in lieu of the $5.00 per member charge; and
WHEREAS, Section 20461 of the State Employees' Retirement
Law provides that an error made in a contract may be corrected through
amendments approved by the adoption of suitable resolutions by the
contracting parties.
NOW, THEREFORE, BE IT RESOLVED: That said City Council of
the City of Santa Aha authorize an amendment to said Contract, a
copy of said amendment being attached hereto marked "Exhibit A",
and by such reference made a part hereof as though herein set out in
full; and
BE IT FURTHER RESOLVED: That the Mayor of said City be,
he is hereby authorized, empowered and directed to execute said
amendment for and on behalf of said City Council.
