PROPERTY NECESSARY FOR TH~ LOCATION OF
NEW TALRERT AVENUE
WHEREAS, in the southwesterly part of Santa Ana there exists
no east and west street south of Warner Avenue which affords
uninterrupted traffic flow between Main Street and Harbor Boulevard
and the present and prospective demands of traffic in the area will
increasingly require such a street.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of
the City of Santa Aha hereby finds and determines that public
interest and necessity require that a new street will be required
between Bristol and Greenville Streets and do require that said
City have, take and acquire for street purposes fee simple title to
that certain land in the County of Orange, State of California,
described as:
A strip of land 40 feet in width bounded westerly by the
East line of Bristol Street; bounded easterly by the west
line of Assessor's Parcel No. 140-182-4; the south line
of said 40-foot strip being a straight line which if
extended would intersect the center line of Main Street
at a point 2126.79 feet north of the intersection of the
center lines of Main Street and Sunflower Street, and
said south line of said 40-foot strip intersects the
center line of Bristol Street at a point 2099.30 feet
north of the intersection of the center lines of Bristol
Street and Sunflower Street.
BE IT FURTHER RESOLVED:
1. That the City Attorney is hereby ordered and directed to
bring an action in the name of the City of Santa Aha to condemn
said property necessary to be taken and to do all things necessary
to prosecute said action to final determination;
2. That the public interest, necessity and convenience
require and it is hereby ordered that the City take immediate
possession and use of the property herein ordered to be acquired
upon compliance with the requirements of law applicable thereto as
a right of way for public use;
3. That said public improvement is planned and locate~ in a
manner which will be most compatible with the greatest public good
and the least private injury;
4. That the City of Santa Ana, a municipal corporation, is
authorized and empowered to provide for the opening, establishment,
extension, widening, construction and maintenance of public streets
and highways for the benefit of the City and the citizens thereof;
5. That said action in condemnation shall be taken in
accordance with the provisions of the Code of Civil Procedure and the
Constitution of the State of California relating to eminent domain.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 16th day of September, 1963.
