HomeMy WebLinkAbout63-195RESOLUTION 63-195 AUTHORIZING CONDEMNATION OF TEN FOOT ~-ASEMENT FOR WATER MAIN AND SANITARY SEWER PURPOSES IT IS HEREBY RESOLVED: That the City Council of the City of Santa Ana has determined that public interest, convenience and necessity require the acquisition of an easement in, over and across that certain real property hereinbelow described as right of way for the installation, maintenance, repair and reconstruction of water mains and sanitary sewers. The real property over, through and across which this easement and right of way is necessary is situated in the City of Santa Aha, County of Orange, State of California, and is described as: A strip of land 10 feet in width, the center line of which is described as follows: Commencing at the intersection of the center lines of Main Street and Sunflower Avenue, said intersection being the East Quarter corner of Section 36, in Township 5 South, Range 10 West, San Bernardino Base and Meridian, and running thence North 89° 40' 35" West, along said center line of Sunflower Avenue 2,848.20 feet, to the true point of beginning; thence North 00° 40' 10" East 1131.57 feet. Excepting that portion of said t0 foot strip lying within said Sunflower Avenue. BE IT FURTHER RESOLVED: 1. That the City Attorney is hereby ordered and directed to bring an action in the name of the City of Santa Ana to condemn said easement necessary to be taken as herein provided for and to do all things necessary to prosecute said action to final determination; 2. That the public interest, necessity and convenience require, and it is hereby ordered, that the City take immediate possession and use of the property and property rights herein ordered to be acquired upon cempliance with the requirements of the law applicable thereto; 3. That said public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury; 4. That the City of Santa Aha is a municipal corporation authorized and empowered to provide sewerage facilities and collecting systems and to provide water mains, lines and appurtenances for the service of the citizens, businesses and residents of the City. 5. That said action in condemnation shall be taken in accordance with the provisions of theCode of Civil Procedure and the Constitution of the State of California relating to eminent domain. PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 2nd day of December, 1963.
