J.L.McBride Each member of the City Council having received copies of the Minutes of September 15th and 22nd, 1952, reading of the Minutes was dispensed with and approved on motion of Trustee Jerome, seconded by Dahl and carried. O~ motion of Trustee Hunter, seconded by Dahl and carried, the Clerk was authorized to open the bid from John J. On motion of Trustee Jerome, seconded by Dahl and carried, the bid was referred to the Administrator and Fire Chief for report at the next meeting. # The Clerk stated no bids were received for the re-roofing of the City Hall, and on motion of Trustee Dahl, seconded by Jerome and carried, the Administrator was authorized to negotiate a contract for the re- roofing of the City Hall. , This being the date s et for hearing of protests and no protests having been received reference Amendment Application No. 95 of Emmet 0. Roger~ etal to reclassify certain parcels of land between Bristol and Baker Streets and lying adjacent to the north of a line approximately 293 feet north of the center line of West 17th Street, from R-1 to R-2 as to a part of the land and from R-1 to R-3 as to a portion abutting Bristol Street, on motion of Trustee Dahl, seconded by Jerome and 268 carried, the City Attorney was instructed to prepare amendment to In Re Petition requesting crossing guard at 17th & Baker ets. Municipal Code to ~eclassify the property. ,, A petition was read signed by forty-three members of the Woodrow wilson Parent Teacher Association requesting the services of a crossing g~aard at the intersection of Seventeenth and Bakex- Streete. On motion of Trustee Hunter, seconded by. Jerome and carried, the petition was referred to the Clerk for checking of signatures and to the Administrator In Re Rssol. A petition was read signed by thirty-three residents and property owners in the vicinity of East Edinger and Cyprese Avenue requesting that some traffic control system be installed immediately, especially on Cypress Avenue and on motion of Trustee Hunter, seconded by Jerome In Re Walter C. Collins, Grace Vandenberg; Offer to dedicate a street and carried, the petition was referred to the Administrator and Chief of Police for re~ort and hearing to be held at the next meeting. ,, Communication was read from Walter C. Collins and Grace F. Vandenberg submitting detailed sketch of proposed street dedication from Washington Avenue south, together with street, sewer, drainage, water and curb detailed drawings. On motion of Trustee Hunter, seconded by Dahl and carried, the dedication of the street was referred to the Administrator and City Engineer for written r~port at the next meeting,~ # In Re Request Myrtle E. On motion of Trustee Hunter, seconded by Dahl and carried, the follow- ing Ordinance entitled: "An Ordinance fixing the compensation of certain elective officers of the City of Santa Ana and repealing Ordinance Number 1317" was introduced, read, considered and placed on file for second reading. On motion of Trustee Jerome, seconded by Hunter and carried, the recommendation of the Plannlng Commission was approved and variance .granted to the Franciscan Sisters to permit construction and use of a chapel and convent and/or home for the aged or else to extend or add to the present home for the aged for a chapel and convent building and/or home for the aged, and to permit a reduction in the front yard requirements to a minimumdepth of ten feet, and to waive the rear yard requirements, on a parcel of land at the southwest corner of Sixth Street and Western Avenue, subject to certain conditions. Communication and Resolution No. $47 of the Planning Commission were read, recommending an amendment to the Municipal Code requiring a six foot solid fence or wall around Junk yards, salvage yards and certain other yards.- On motion of Trustee Dahl, seconded by Hunter and carried, a notice of public hearing was ordered published setting date as November 3~ 1952, 270 In Re Amend. Greenwald oral, recommending an amendment to the Municipal Code to reclassify from R-2 Residential District to the C-2 General Commercial District, a parcel of land 150 feet deep along the south side of West First Street between Baker and Bristol Streets, the parcel being described as the east 550 fees of the north 150 feet of Lot 1 of Tract No. 905. On motion of Trustee Dahl, seconded by Hunter and carried, a notice of public hearing was ordered published setting date as November 3rd, 1952. # Communication was read from Republican Central Committee of Orange County requesting permission to install and maintain a booth on the street for the purpose of making available to the public campaign literature, brochures, bumper stickers, buttons and other materials to promote and otherwise work in behalf of the Republican candidates on both national and local levels. On motion of T~ustee Hunter, seconde~ by McBride and carried, the Administrator was authorized to permit any political organizations to provide such equipment on the streets between now and November Sth election. ,, On motion of Trustee Dahl, s ~conded by McBride and carried, Map Tract No. 1315 submitted by Honer Development Company was approved and officials authorized to sign Map covering dedication of 19th and Olive Streets. Bond was not submitted as improvements were completed. On motion of Trustee Jerome, seconded by McBride and carried, Map Tract No. 1658 and bond submitted by Floyd B. Rogers, in the sum of $8,500.00 were approved and officials authorized to sign Map covering dedication of Poinsettia Street and Edgewood Road. On motion of Trustee Dahl, seconded by Hunter and carried, Purchasing Agent and Audltor~s statement of receipts, disbursements and fund balances for August, reports of the Building Department, Judge~s Offic. and Police Department, for the month of September, were received and filed. # On motion of Trustee McBride, seconded by Jerome and carried, the Minutes of the Executive Committee of the Joint Outfall Sewer held at Anaheim, September tSth, were approved. # On recommendation of the committee and on motion of Trustee Dahl, seconded by McBride and carried, the bid of R.J.Noble Company was accepted for the furnishing of 900 tons of plant-mixed surfacing at $2.86 per ton and contract entered into; all other bids rejected and the low bid of John J. Swigart Co. rejected on the basis of no bid bond. On recommendation of the committee and on motion of Trustee Ds/al, seconded by McBride and carried, the bid of Sully-Miller Contracting Company was accepted for the furnishing, delivery and spreading wi/th Barber Greene spreader at $3.09 per ton and contract entered' into; all other bids rejected and the low bid of John J. (Santa Ana Commercial Company) On motion of Trustee Hunter, seconded by Dahl and carried, the request of Santa Ana-Tustin Community Chest for permission to place pole cards on light standards throughout the downtown area dtu'ing the period of the annual Community Chest campaign was granted, provided the cards are removed from the poles not later than one week after the campaign. # On motion of Trustee Hunter, seconded by Dahl and carried, oommunicatic from American Municipal Association extending an invitation to attend ~he annual American Municipal Congress to be held in Los Angeles on 'December 1, 2, 3, 1952, was received, filed and referred to the Administrator for future reference. # Communication was read from Santana Inc. advising that i$ is part of the required improvements of Tract 1608 to top the trees along the south bank of the Santiago Creek back to forty feet in heigh~ at their expense, and on motion of Trustee McBride, seconded by Jerome and carried, the communication was received, filed and approved. # Communication was read from the Division of Highways reference installation of traffic signals at the intersection of Santa Aha Boulevard and Flower Street and advising that the City will be request- ed to participate in one-half of the cost of the installation. On motion of Trustee McBride, seconded by Hunter and carried, the Administrator was authorized to negotiate a contract with the State, the City to pay $5000.00 of the installation fee, the money to be paid out of the parking meter fund and officials authorized to execute contract. . Communication was read from the Pacific Electric Railway Company advising that the Santa Ana Line between Bellflower and Santa Ana, also between New Delhi and Dyer and between Greenville and the Air Base will be discontinued and that the Company will either remove with its own forces or let contract for the removal of poles and overhead wires, On motion of Trustee Hunter, seconded by Dahl and carried, the communication was referred to the Administrator and Attorney for writt~ report at the next meeting as to the effect on its franchise. # On motion of Trustee Jerome, seconded by-McBride and carried, the Order of Submission and Findings of Fact of the Industrial Accident Commission in the case of State Employees' Retirement System and Johan J. Hansen versus the City of Santa Ana, was received and filed. . The Administrator recommended that a contract be entered into with Adam Schlenining, Jr. and Randolph 0dne dba Lennox Disposal Service for the collection of trash and garbage under the terms of the submitted bid of 85~ per meter per month for all operations except the dump, $100.00 per month to be paid to the City for use of the Dump and be official~authorized to execute contract. On motion of Trustee Dahl, seconded by Hunter and carried, the recommendation of the Administrator was approved and officials authorized to execute contract, with the modifications as dlsoussed by the Council. (flood control) Communication was read from the City Engineer advising that improve- ments within the boundaries of Tract No. 1558 have been completed and on motion of Trustee Jerome, seconded by McBride and carried, check filed by Emmet C. Rogers, in the sum of $11,000.00, was ordered released. A petition was read signed by five business persons in the 300 block East First Street requesting that a 24 minute parking limit be est- ablished on the south side of the street from Orange Avenue to the school alley, and a Resolution passed by the Roosevelt School Parent- Teacher~ Association roquesting that the curbing on the west side of Maple Avenue between First Street and Walnut Street be painted yellow; that crosswalks be painted corner to corner at the intersection of Maple Avenue and Walnut Street and at the point where the alley west of the school grounds Joins Walnut Street and that a "Safety Girl" traffic sign be placed at the intersection of Walnut Street and Maple Avenue. On motion of Trustee Hunter, seconded by McBride and carried, the requests were referred to the standing committee on curb usage for definite report at the next meeting. On motion of Trustee Dahl, seconded by Jerome and carried, the application of the Pacific Electric Railway Company for authority to adjust and increase its interurban fares, was received and filed. On motion of Trustee. McBride, seconded by Jerome and carried, communication from the Boundary Commission approving amended proposal of Walter Cole reference propose& annexation of approximately eight acres lying between the River Channel and King Street south of 15th Street, was received and filed. . Communication was read from Preston Turner, Special Counsel' for the Joint Outfall Sewer advising that Supplemental Agreement provides thati~ the alternate shall be a member of the governing board of the respecti'~e Cities and Sanitary Districts, and it will be necessary to reappoint an alternate to comply with the terms of the last Supplemental Agree- mont. On motion of Trustee. Hunter, seconded by Jerome and carried, J.L.McBride was reappointed the designated representative of the Executive Committee empowered to enter into a contract between the Executive Committee of the Orange County Joint Outfall Sewer and the State Employee's Retirement System, and Mayor Courtney R. Chandler wasi! reappointed to serve as alternate representative of the Executive Committee. # Communication was read from Towner Manufacturing Company requesting that adequate flood control measures along the Santa Aha River be take~ to protect their property. On motion of Trustee McBride, seconded by! Jerome and carried, the Administrator was instructed to communicate with To~ner Manufacturing CompanY and indicate the Council's willingness to do everything possible to bring about the improvement of the flood control dikes. 273 In Re Communication Or. In Re Leave of absence Mayor Chandler' In Re Communication Dick Taylor Chief, Communications Service Communication was read from the Orange County Title Company returning Warrantc Nos. 126 and 39~ payable to the Orange County Title Company, in the sums of $33.05 and $270.00 respectively and advising that Gertrude Burns does not wish to convey the property located on South Main Street at this time. On motion of Trustee Dahl, seconded by Jerome and carried, the communication was referred to the Administrato: and City Attorney to determine, if possible, the rights of the City in the matter and committee instructed to submit written report to the Council at the next meeting. On motion of Trustee Hunter, seconded by Dahl and carried, the Administrator was instructed to contact the City Attorney for immediat~ action reference the condemnation proceedings for South Main Street widening and to furnish report on the status of the plans and spec- ificatkons being prepared by the Engineer, together with a report of the entire project, to be submitted at the next meeting. Communication was read from the City Attorney requesting authorization to file with the Public Utilities Commission a Dismiesal on behalf the City coupled with the request that the City be notified of the filing of an Advice Letter in the State seeking publication of a divided directory .for the County of Orange. On motion of Trustee Dahl, seconded by Hunter and carried, the reques~ was approved and Attorney instructed to file the Dismissal on behalf of the City. . Communication was read from Z.B.West reference retainer fees to handle the case of People versus MarJorie Burns, such fees to be a retainer to cover preparation $100.00, fee of $100.00 for the first day and $75.00 per day for each. day of trial thereafter. On motion of Trustee Dahl, seconded by McBride and carried, the requeet reference retainer fees in this specific case was granted and arrangements to be made for compensation for expert witnesses. Communication was read from Chief Building Inspector recommending that Chesley Johnson be appointed as a member of the Plumbing Examining Board due to ~he resignation of Robert Watson. On motion of Trustee Jerome, seconded by Dahl and carried, the recommendation was approved and appointment authorized. . Communication was read from President, Santa Ana City Employees Association requesting that W.G.Secrest, N.D.McLean and C.A.McCullough be relieved from their duties for one and one-half days leaving at October 9th in order to attend the Sixth Annual Conference of the California League of City Employees Associations to be held at Oakland October 10th, llth and 12th, and on motion of Trustee Dahl, seconded by McBride and carried, the request was granted. # On motion of Trustee Hunter, seconded by Dahl and carried, the request of Mayor Oourtney R. Communication was road f~om Attorney George Bradley advising of pro- posed increase in fares of the Santa Aha Bus Service as follows: adult fare 15~, children under 12 and over 5, 10~ and student tickets, 15 rides for $1.35 or 9~ per ride, with the exception of the South Main Street line from any point on South Main or downtown Santa Ana to any point on South Main or downtown Santa Aha, the adult fare shall remain at 10~, and on motion of T~ustee Jerome, seconded by Hunter and carried, the communication was received and filed. # Communication was read from T. Gray Johnston, 1250 South Broadway, requesting that action be taken in regard to irregular trash pick-up, and on motion of Trustee McBride, seconded by Jerome and oarried,.the communication was referred to the Administrator for reply. On motion of Trustee McBride, seconded by Hunter and carried, the notifications of the State Board of Equalization of alcoholic beverage applications made by Eagles Lodge, $31 W. 3rd St., and Rebecca Castro, 1211 E. lst~St., were received and filed. On motion of Trustee Jerome, seconded by Hunter and carried, the · application ef Gladys Radine Hayes, to drive taxicabs, was received and perml~ granted. On motion of Trustee Dahl, seeonded by McBride and carried, the Mayor : was authorized to sign escrow instructions from Antonio Holguin aka Antonio Holgin, for the acceptance of an easement deed for street purposes, being the extension of Orange Avenue between Dyer Road and Delhi Road. # On motion of Trustee Jerome, seconded by McBride and carried, the ~ayor was authorized to sign escrow instructions from Clyde O. and Emma Louise Mussack, for the acceptance of an easement deed for street purposes, being the westerly half of the southerly extension of Orange Avenue from Dyer Road approximately 466 feet north. # On motion of Trustee Hunter, seconded by Dahl and carried, thJ claim of Anna A. Z.
