The SAMC does not list short-term rentals as an approved use in any zoning district, making them prohibited and unauthorized under the current enforcement practice afforded by Section 41-190(a). For the purposes of CEQA, we are recommending tiering off the City of Santa Ana (City) General Plan Update (GPU) Environmental Impact Report (EIR) (GP EIR); therefore, the buildout identified in Table LU-2, Buildout Table, will be considered the approved project environmental baseline (existing conditions) of the project site, and the proposed project's impacts will be analyzed against this baseline. Based on an initial review of the GP EIR and the information available about the City's intended ordinance, PlaceWorks believes the tiering approach would yield an EIR Addendum. The EIR Addendum may also include a discussion regarding the proposed project's qualification for an exemption. If determined to qualify for an exemption, an analysis showing that use of the exemption is not precluded by the exceptions outlined in CEQA guidelines section 15300.2 will also be included. The exceptions address issues of location, cumulative impact, significant affect, scenic highways, hazardous waste sites, and historical resources. Approach PlaceWorks will use the City's EIR Addendum template as a guide to evaluate the proposed project against the GPU and GP EIR. This proposal covers the preparation of the ER Addendum to evaluate the proposed project compared to the existing General Plan and GP EIR. PROJECT-DESCRIPTION PlaceWorks will prepare the project description for review by the City after the kick-off meeting. Concurrent with the preparation of the project description, PlaceWorks will prepare the administrative draft Addendum.We assume that the project description is fixed as discussed, but can adjust the analysis if changes are made during preparation of the Addendum. Parallel review of the Project Description and the Addendum is needed to meet the schedule. We understand that review and edit will be an iterative process and will work with the City to incorporate reviews as they occur. We prefer to work in Microsoft Word to enable all reviewers to make comment(s) and edits in track change mode. This shortens the edit timing and ensures the final product reflects the needs of the City. Although we fully understand the extent of the project, if the details of the project description change significantly, additional budget may be necessary. EIR ADDENDUM 2.1 Administrative Draft EIR Addendum Using the agreed upon formatforthe Addendum, PlaceWorks will prepare an administrative draft for review. The administrative draft Addendum will: » Focus on the proposed changes compared to the approved project. » Determine if there are any effects peculiar to the project that were not originally evaluated. » Perform a Section 15162 analysis and determine whether a subsequent EIR is required. » Include a qualitative discussion of the proposed project's impacts related to air quality, energy, greenhouse gas, noise, and transportation. The Addendum will include a discussion that compares the proposed project to the GP EIR. We will include findings of the environmental effects of the proposed project compared to the GP EIR.We will rely on and make use of the analysis and mitigation measures in the GP and GP EIR. Please note that, unlike other CEQA documents (e.g., EIR, MND), an Addendum does not require a public review period. Also, an Addendum does not require Assembly Bill (AB) 52 tribal consultation. The completed Administrative Draft Addendum will be submitted to the City for review and comment in Microsoft (MS) Word. As noted above, we anticipate an accelerated delivery date and an iterative review process to meet the schedule. PROJECT MEETINGS, MANAGEMENT, AND COORDINATION During the course of the proposed project, PlaceWorks staff time will be required to manage the PlaceWorks team; manage Addendum preparation effort; and maintain constant, close communication with the City. The Project Management task is based on the estimated schedule for the project. This task is intended to ensure that the proposed project will be completed on time and within budget and that all work products are of high quality. PlaceWorks will coordinate the team's communication of issues, transmittal of comments, financial management, and other project management matters. We are assuming that all essential work will be completed within 3 weeks of authorization to proceed and have budgeted this time accordingly. If the schedule of the project is extended for reasons beyond PlaceWorks' control, a contract amendment may be required for additional fees for project management and coordination efforts. STAFF REPORT ASSISTANCE In preparation for the public meetings, PlaceWorks will prepare a summary of the project and environmental findings for insertion into the staff report.
