HomeMy WebLinkAboutGARDEN GROVE, CIY OFAGREEMENT THIS AGREEMENT made and entered into this 23rdday of _May____ 1973, by and between the City of Garden Grove" a municipal corporation, hereinafter called "GARDEN GROVE" and the City of Santa Ana, a municipal corporation, hereinafter called "SANTA ANA"- NlTNE55ETH THAT: WHEREAS, considerable traffic congestion presently exists and is increasing at the intersection of Euclid Street at Westminster Avenue; WHEREAS, a study has been completed and the conclusion drawn that traffic conditions at the said intersection warrant the intersection to be included within a progression system for the proper and orderly movement of traffic on Euclid WHEREAS, portions of said intersection are within the City boundaries of Santa Ana and of Garden Grove; WHEREAS, it is the desire of the parties hereto to set out their respective rights and obligations concerning the improvement, modification, operation and maintenance of existing traffic signal and lighting system at the intersection of Westminster Avenue and Euclid Street; NOW THEREFORE, for and in consideration of the covenants herein contained, performed and to be performed, the parties hereto agree as follows: l' The parties hereto agree to share the engineering, administration, construction and inspection costs of the installation of the traffic signal modification in the same ratio as the number of legs under each party's jurisdiction entering the intersaofionareto the total number of legs entering the intersection. 2- The total cost of said modification project is presently estimated not to exceed $41,500-00 and shall initially be borne by Garden Grove. 3' Following completion of construction, Santa Ana shall, upon receipt of proper demand, reimburse Garden Grove in an amount equal to fifty percent (50%) of the total eligible cost' Both Garden Grove and Santa Ana plan to finance their share of the costs for this project with TOPICS funds and City matching funds. It is mutually understood that Santa Ana will only be required to finance that portion of this project where TOPICS and City matching funds are eligible to be jointly used. -l- 4. Garden Grove shall have jurisdiction of the construction area within -the project limits. 5. At all times during the progress of the construction of this project, Santa Ana shall have access to the work for the prupose of inspection thereof and should Santa Ana deem any remedial measures to be necessary, Santa Ana shall notify Garden Grove thereof. 6. After completion of this project, the entire traffic signal and highway lighting system at this intersection shall be maintained and operated by Garden Grove. 7. Upon annual submission by GARDEN GROVE of maintenance, operation and energy costs, SANTA ANA shall pay to GARDEN GROVE its proper share of said costs which shall be in the same ratio to the total costs as the number of legs under 5ANT8 AMA's jurisdiction entering the intersection are to the total number of legs entering the intersection, said ratio presently being 58%. S. Costs for right of way and road construction work on any leg shall be borne by the agency which has jurisdiction over that leg. ED TO THE CITY OF SANTA ANA FOR THE YEAR 1972-73. WHEREAS, a. Master Agreement for the 'TOPICS Program was entered into between the City of Santa Ana and the State on February 1, 1971; and WHEREAS, program recpulations permit assignment of TOPICS funds to an- other City or County; and CAS, the City of Santa Ana and the City of Garden Grove agree that traffic signal progression is necessary on Euclid Street; and WHEREAS, a participation Agreement between the Cities has previously been enacted by the Cities; and TrFt1EREAS, certain modifications are necessary to upgrade the signal system existing at the intersection Euclid Street and Westminster Avenue; NOW T:MREFORE, THE CITY COUNCIL OF THE CITY OF SANTA AM DOES RESOLVE AS FOLLOWS: SECTION 1: The City of Santa Ana shall assign to the City of Garden Grovel=7iunds allocated to the City of Santa Ana for the year 1972-73, in an amount of approximately Fifteen Thousand Dollars ($15,000.00); the exact amount to be determined by the exact final cost of the curpleted project. SECTION 2: Assigruent of these funds will not jeopardize TOPICS funds being utilized under current or proposed projects within the City of Santa Ana. SECTION 3: The City Clerk is hereby directed to forward certified copies of this Resolution to the State Department of Public Works and to the City of Garden Grove.
