THE CITY OF SANTA ANA, a Municipal Corporation and THE CITY OF
GARDEN GROVE, a Municipal Corporation, both situated in the County of Orange,
State of California, do hereby enter into the following agreement:
W I T N E S S E T H:
W11ERE,AS, City of Santa Ana and City of Garden Grove contemplate
the installation of a traffic control signal system and highway lighting to
provide for the orderly movement of traffic at the intersection of Euclid
Street with Hazard Avenue, within the City of Santa Ana and, the City of Garden
Grove.
WHEREAS, City of Santa Ana has a portion of three approach legs of
the highways entering the intersection within the City limits of Santa Ana; and
WHEREAE), City of Garden Grove has a portion of one approach leg of
the highways entering the intersection within the City limits of Garden Grove;
and
WHEREAS, both cities desire to specify the proportionate share of
the construction and maintenance costs to be paid by each City; and
WHEREAS, both cities desire to specify the city responsible for
the construction and maintenance of said traffic control signal system and high-
way lighting;
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
SECTION I
For and in consideration of the covenants and conditions to be
kept and performed 'by the City of Garden Grove, -the City of Santa Ana agrees:
a. To furnish traffic control signal system and highway lighting
he-reinabove mentioned, through construction by contract with contractors licensed
by the State of California, said contract to 'be carried out in accordance with
the provisions of the Government Code, and to be completed in conformity with
plans and specifications as approved by City of Santa Ana and City of Garden Grove.
b. To -bear the City of Santa Ana's share of the expense of pre-
paration of plans and specification.s and construction engineering costs, such
share to 'be three -fourths (3A) of the total preliminary and construction engineer-
ing costs.
c . To bear the City of Santa Ana's share of the construction
costs required to complete the traffic control system and highway lighting
referred to herein, such share to be three -fourths (3/11) of the total con-
struction costs.
d. To acquire and pay for all, costs involved in securing E1-1
rights of way and to pay for all costs for all road work within the City of
Santa Ana necessary for the construction of the traffic control signal system
and highway lighting,
e, City of Santa Ana shall maintain and operate the entire traffic
control signal system and highway ligbting as constructed.
f. City of Santa Aria will relocate traffic signal equipment as
required in the future by further development of adjacent properties either
within the City Limits of Santa Ana, or Garden Grove.
SECTION II
For and in consideration of the covenants and conditions to be
kept and performed by the City of Santa Ana as set forth. in this Agreement,
-the City of Garden Grove agrees:
a. To reimburse City of Santa Ana promptly upon -rendition of
statement therefor, City of Garden Grove's share of expense of preparation of
plans and specifications, construction engineering costs and construction costs
required to complete the traffic control signal. system and highway lighting,
such share to be one-fourth (1/4) of the total preliminary and construction
engineering costs and construction costs.
b. To reimburse the City of Santa Ana promptly upon rendition
of statement therefore, City of Garden. Grove's share one-fourth (1/4) of the
total subject intersection's traffic signal system and intersection lighting
maintenance and operational expenses.
C. To acquire and pay for all costs involved in securing all
rights of way and to pay all costs for all road work within the City of Garden
Grove necessary for the construction of the traffic control signal, system and
highway lighting,
d. To reimburse City of Santa Ana for the actual costs of re-
locating, by City of Santa Ana Public Works personnel or designated contractor,
any traffic signal facilities requested -to be moved by the City of Garden Grove
that are located within the City of Garden Grove, location to include present
boundaries and future changes, if' any.
WITNESS WHEREOF, the parties hereto have caused this Agreement
to be executed by their respective officers, duly authorized by the City of
Garden Grove -this day of 1-961 1 and by the City- of
Santa Ana this day of' 19EL.
