AGREEMENT FOR THE PAYMENT OF EXTRAORDINARY SEWER
MAINTENANCE FEES BETWEEN THE CITY OF SANTA ANA
AND THE GARDEN GROVE SANITARY DISTRICT
THIS AGREEMENT, made and entered into this WtZ, day
of MF41 r 1977, by and between the City of
Santa Ana, a municipal corporation of the State of California
hereinafter called "CITY", and the GARDEN GROVE SANITARY DISTRICT
OF ORANGE COUNTY, a public corporation of the State of California,
hereinafter called "DISTRICT",
W I T N E S S E T H
RECITALS
1. CITY proposes to construct a northerly and easterly
extension of its C-5-F Storm Drain to its ultimate upper terminus;
and
2. DISTRICT owns and maintains an existing ten -inch sani-
tary sewer in First Street at the intersection with Figueroa
Street located at a depth which conflicts with the proposed storm
drain; and
3. CITY proposes to remedy said conflict by constructing
an inverted siphon in DISTRICT'S ten -inch sewer, thereby creating
extraordinary maintenance costs over and above the costs of main-
taining the presently un-siphoned sewer.
WHEREFORE, in consideration of the respective and mutual
covenants and promises hereinafter contained and made, the
parties hereto agree as follows:
A. CITY agrees to construct an inverted siphon in
DISTRICT'S said ten -inch sanitary sewer without flow
interruption.
B. DISTRICT agrees to permit CITY'S construction
of said inverted siphon on its ten -inch sanitary
sewer in the vicinity of First Street and
Figueroa Street, Santa Ana.
C. CITY agrees to pay DISTRICT two -hundred forty

dollars ($240.00) per year for twenty (20) years
commencing one (1) year after the date of this
agreement.
D. DISTRICT agrees that said two -hundred forty
dollars ($240.00) per year is full and complete
compensation for any and all extraordinary main-
tenance costs arising and to arise by virtue of
said inverted siphon construction.
E. The term of this agreement shall be for
twenty (20) years commencing on the date of
execution.
IN WITNESS WHEREOF, the parties hereto have executed
this agreement on the date and year first above written.
