ALLEN & CO., a Corporation;` hereinafter ALLEN & CO., makes this agreement and covenant on the date hereinafter set forth with and for the benefit of.the City of Santa Ana, hereinafter "CITY RECITALS' 1. ALLEN & CO. is the owner in fee of that certain real property in the City of Santa Ana, known.an.d described as: PARCEL I: Lot 14 in Block C of Gardner and Moye's Addition to Santa Ana in the City of Santa Ana, County of Orange,.State of California, as per map recorded in Book 13, Page 24 of Miscellaneous Records of Los Angeles county.- PARCEL 11. Lot 6 of Turner's Addition to the Town of Santa Ana, in the City of Santa Ana, Countv of Orange, State of California, as per map recorded in Book 23, Page 58 of Miscellaneous Records of Los Angeles County. PARCEL III: 'The East 27 feet of the north 75 feet of the following: Lot 5 and the South half of Lot 4 of Turner's Addition to the Town of Santa Ana, in the City of Santa Ara, County of Orange, State of California as per map recorded in Book 23, Page 58 of.Miscellareous Maps of Los -Angeles County. 2. 'There is now maintained and erected upon Parcels I and II above described,.a multiple unit residential structure. There is now erected on Parcel III garage or carport facilities for the use and benefit of residents of the structure located on Parcels I and 11. The facilities above described existing on parcel III were placed there and are maintained there by reason of the Santa Ana' Municipal Code which. requires a fixed ratio of parking facilities for any given number of,residentiai units, depending.upon their size and type. 3. Parcels w, 11 and III above described are located within an area which had been subdivided prior to the erection of structures thereon. Parcel III above described was physically divided from Lot 5 and the south half of tot 4 of Turner's Addition to the Town of Santa Ana, in the City of.Santa Ana, County of Orange, State of I 002qpai516 California, as per map recorded in Book 23, Page 58 of Miscellaneous Records Of Los Angeles County, without compliance with Subdivision Rules and Regulations then in force and effect within said area. NOW, THEREFORE for the purpose of Complying with the requirements of the City of Santa Ana, the parties covenant and agree: 1. That Parcel III shall continue in the use to which it is now devoted, to wit: a parking structure for automobiles of tenants of the residential building now upon Parcels I and 11. 2. ALLEN & Co. and its successors and assigns in interest, whether voluntary or involuntary, shall not in any manner, voluntarily or involuntarily, cause or permit title to Parcels 1, 11 or III to be conveyed except as,a single parcel. S. All covenants herein contained shall run with the land and shall I be binding upon the undersigned and its successors in interest. 4. The covenants hereby created shall terminate when the building now located on Parcels I and T1 is,physicallyremoved. Furthermore, the covenants and easements hereby created may be terminated at such time as the Santa Ana Municipal Code unconditionally permits a contrary I use, I or no longer continues the parking requirement now in existence, or is terminated by the Planning Director and the Director of Building Safety and Housing or the appropriate official Or Officials of the CITY then charged with the equivalent responsibility of these designated officials.'
