HomeMy WebLinkAboutIRVINE RANCH WATER DISTRICTAGREEMENT I / " FOR FIRE INTERCONNECTION WITH THE IRVINE RANCH WATER DISTRICT TO SERVE HIGH PRESSURE WATER TO THE MARINE CORPS AIR STATION, TUSTIN LTA FROM THE CITY OF SANTA ANA'S WATER SYSTEM THIS AGREEMENT is made and entered into this day of 1988, by and between IRVINE RANCH WATER DISTRICT, a California Water District, hereinafter referred to as "DISTRICT", and the CITY OF SANTA ANA, a municipal corporation, hereinafter referred to as "CITY". WI TNESS E T H: WHEREAS, DISTRICT has requested that CITY permit a high pressure connection to its 24-inch water line located on the north side of Warner Avenue, west of Red Hill Avenue, hereinafter referred to as "24-inch water line", as delineated on Exhibit "A", attached hereto, and by this reference made a part hereof; and WHEREAS, the sole purpose for the connection is to provide water for fire testing and suppression purposes on the grounds of the United States Marine Corps Air Station - Tustin LTA; and WHEREAS, the CITY has sufficient high pressure water available at the aforesaid connection to meet the aforesaid fire testing and suppression requirements; I. DISTRICT shall: A. Bear the total cost of the installation, operation, supervision and maintenance of the sixteen (16) inch automatic fire Y interconnection including, but not limited to, controls, meters and all d pertinent auxiliary equipment, piping and valves required for the proper functioning of said interconnection. B. Submit the type and manufacturer of the fire interconnection (including controls, valves, meters and all pertinent auxiliary equipment) to the Water Resources Manager, Public Works Agency of CITY for written approval prior to the installation of said interconnection. All work for installation and operation of the interconnection, including such additional, extra and incidental work as CITY may consider necessary to complete the interconnection work in a satisfactory and acceptable manner, shall be in accordance with the specifications and requirements of CITY. C. Operate the interconnection for the sole purpose of providing the aforesaid Marine Corps. Air Station with a source of water for fire testing and suppression. The interconnection shall be operated only in the event of a fire and twice a year for testing the system. The maximum duration of the test sequence shall be one (1) hour at a maximum flow of 8,775 gallons per minute. DISTRICT shall provide CITY with at least 24-hours written notice prior to operation of the interconnection, except in the event of fire. CITY shall have the right to require rescheduling of the operation of the interconnection where the proposed schedule would interfere with CITY'S ability to meet water supply needs. D. Maintain, operate, supervise and be responsible and liable for the fire interconnection (flange) installed by DISTRICT, and all pipeline or other appurtenances related to the fire interconnect south of said inter- - 2 - r connection (i.e. outside the service boundaries of the CITY OF SANTA ANA,, and/or running from the interconnection to the Marine Corps Air Station, Tustin LTA). E. Assume all responsibility and liability associated with its use of the interconnect, including, but not limited to, notification of Metropolitan Water District of Southern California regarding peaking, payment of penalties associated with peaking, liability for SA-7 Pressure Reducing Station use and payment of any other charges imposed on CITY by appropriate government agencies due to DISTRICT'S use of the fire interconnect. II. CITY shall: A. Allow DISTRICT to connect to the existing 20-inch outlet at Sta. 1+60 of the 24-inch water line. B. In the event of a loss of water supply on the East Orange County Feeder No. 2, operated by the Metropolitan Water District of Southern California, or in CITY'S 24-inch high pressure waterline connector to its SA-7 Pressure Reducing Station, have the right to close the interconnection until ' such time as the aforesaid feeder or connector is back in full service. The water supply needs of CITY shall take precedence over DISTRICT'S when both wish to use CITY'S source of supply simultaneously. Whenever possible, CITY shall give DISTRICT twenty-four (24) hours notice of its need for priority. C. Be responsible for taking monthly readings of the interconnection meter for the purpose of measuring the water used for fire testing and suppression purposes. An annual summary sheet shall be prepared showing the total water used during the fiscal year. A copy of the summary sheet shall be sent to DISTRICT for verification and checking. -3--
