OF CERTAIN REAL PROPERTY SOUTH OF FIRST STREET,
NORTH OF McFADDEN AVENUE, FOR THE CONSTRUCTION
OF PROPOSED FAIRVIEW STREET
WHEREAS, Fairview Street is presently proposed to be extended
South of First Street to provide an artery for North and South
vehicular traffic.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Ana does hereby find and determine that public interest
and necessity require that Fairview Street be extended Southerly from
First Street, as shown on maps thereof on file in the office of the
Department of Public Works and herein referred to for greater detail,
to accommodate the demands of traffic, and further require that said
City do have, take and acquire an easement for street purposes over,
through and across certain lands in the City of Santa Ana, County of
Orange, State of California, described as:
That portion of a strip of land 104 feet wide the center
line of which is described as follows:
Beginning at the intersection of the center lines of Fair-
view Street and McFadden Avenue as shown on a map of Tract
Number 3423 recorded in Book 127, Pages 10, 11, and 12 of
Miscellaneous Maps, Records of Orange County, State of Cal-
ifornia, said intersection also being the Northwest corner
of said Tract Number 3423, and running along the following
courses, bearings based on said center line of McFadden
Avenue as being North 89~ 22' 28" East; thence North 0° 47'
20" West 2,215.57 feet to the beginning of a tangent curve
concave Easterly having a radius of 1,200.00 feet; thence
Northerly along the arc of said curve through a central
angle of 34° 58' 14" an arc distance of 732.42 feet to a
point of reverse curvature; thence Northerly along the arc
of a curve concave Westerly having a radius of 1,238.97
feet through a central angle of 34° 52' 44" an arc distance
of 754.23 feet to a tangent line; thence North 0° 41' 50"
West 307.72 feet to a point on the center line of First
Street, said point lies 823.03'Westerly from the center line
of Sullivan Street measured along said center line of First
Street, said center line of First Street being the South
line of Section 10, Township 5 South, Range 10 West, San
Bernardino Base and Meridian.
Lying within that portion of Lot 1 of the Sepulveda Tract
in the City of Santa Ana, County of Orange, State of Cali-
fornia, as per map recorded in Book 31, Page 197 of deeds in
the office of the County Recorder of Los Angeles County,
California, described as follows:

Beginning South 19.38 chains from the common corner of
Sections 10, 11, 14 and 15, in Township 5 South, Range
10 West, which point is at the intersection of the
center of Newport Road and the South line of said Lot 1
of the Sepulveda Tract; thence West 16 chains along said
South line of said Lot 1; thence North 5 chains; thence
East 16 chains parallel with said South line of Lot 1 to
the center line of the Newport Road; thence South 5 chains
along the center of said Newport Road to the point of
beginning.
BE IT FURTHER RESOLVED: That the City Attorney is hereby
ordered and directed to bring an action in the name of said City in
the Superior Court of the State of California in and for the County
of Orange, to condemn said property necessary to be taken as herein
ordered and directed and to do all things necessary to prosecute
said action to final determination.
BE IT FURTHER RESOLVED: That the public interest, necessity
and convenience require, and it is hereby ordered that the City of
Santa Aha, a municipal corporation, Plaintiff in the condemnation
action ordered herein, take immediate possession and use of the
property herein ordered to be acquired upon compliance with the
requirements of the law applicable thereto; that the City Attorney
report to the Director of Finance the amount of money required there-
of; and that the Director of Finance shall deposit said amount with
the Clerk of the Court.
BE IT FURTHER RESOLVED: That said action for condemnation of
said property so to be acquired shall be taken in accordance with the
provisions of the Code of Civil Procedure and the Constitution of
the State of California relating to eminent domain.
PASSED AND ADOPTED by the City Council of the City of Santa
Aha at its regular meeting held on the 3rd day of April, 1961.
