FOURTH AMENDMENT TO AGREEMENT
THIS FOURTH AMENDMENT TO AGREEMENT is entered into on November
20, 2006, by and between hygiene Technologies International, Inc., a California
corporation ("Consultant") and the City of Santa Ana, a charter city and municipal
corporation of the State of California ("City").
RECITALS:
A. The parties entered into Agreement No. N-2002-122 dated ALI-IlSt 12, 2002,

(hereinafter "said Agreement") by which Consultant has provided industrial hygiene
testing.
B. In accordance with the terms and conditions of said Aareernent, the parties wish to

increase compensation to conclude projects for the City, including indoor air quality
improvements, clearance Surveys, mold rernediation and noise assessment Surveys.
WHEREFORE, in consideration of the covenants contained in said Agreement, as
amended, and subject to all the terms and conditions of said Agreement, except those
amended in this Fourth Amendment to Agreement, the parties agree as follows:
1. Section 2, COMPENSATION, shall be amended to increase compensation by
$100,000,00 for a total of $110,000 during the 2006-2007 fiscal year.
3. Except as amended ill this Fourth Amendment to Agreement, all terms and
conditions of said Agreement, as previously amended, shall remain in full force and
effect.
IN WITNESS WHEREOF, the parties hereto have executed this Fourth Amendment to
Agreement on the date and year first written above.

Direct the City Attorney to prepare and authorize the City Manager and
the Clerk of the Council to execute an amended agreement with Hygiene
Technologies International, Incorporated to conduct industrial hygiene
studies for an additional $100,000.
DISCUSSION
The City utilizes Hygiene Technologies International, Incorporated
(HygieneTech) to provide comprehensive occupational health and safety
services. HygieneTech conducts periodic industrial safety engineering,
indoor air quality, noise assessment and control., industrial ventilation,
asbestos and lead identification, health and safety training,
environmental air monitoring, and regulatory compliance. The City I s
current agreement with HygieneTech expires on June 30, 2007.
CalOSHA requires the City to conduct air quality surveys in City
facilities when environmental conditions warrant. The City has
successfully contracted with HygieneTech on various occasions to conduct
air quality surveys in the City's Main Library, Animal Care Shelter, and
the Parks, Recreation & Community Services Administration building. They
have also provided technical. information relating to lead testing at the
Police Department's firing range.
The current assessments include indoor air quality improvements,
clearance surveys and mold remediation for eight fire stations, noise
assessment surveys for three departments and a (general indoor air quality
survey in City Hall. Additional money is needed to conclude these
projects.

FISCAL IMPACT
Funds are available in the Liability & Property Insurance Fund (account
no. 80-180-6191) and the Workers' Compensation Fund (82-178-6191) to pay
for services up to $100,000.
