HomeMy WebLinkAbout61-112P~SOLUTION NO. 61-112 APPROVING MAP AND DECLARING INTENTION TO VACATE A PORTION OF FAIRVIEW STREET NORTH OF McFADDEN AVENU~ AND FIXING HEARING DATE THEREON WHEREAS, due to realignment of Fairview Street North of McFadden Avenue there is along the Westerly boundary of said Fairview Street a two-foot strip of land which is unnecessary for street purposes, and the Planning Commission and the Department of Public Works have recom- mended the same be vacated. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby adopts the map attached hereto and orders that the same be filed with the original of this Resolution in the office of the Clerk of the Council and reference is made to said map for particulars of the street right of way area proposed to be vacated. BE IT FURTHER RESOLVED: That the City Council hereby declares its intention to vacate for street purposes that portion of Fairview Street in the City of Santa Ana, County of Orange, State of California, described as: Co~,encing at the intersection of the center line of Fairview Avenue with the new center line of McFadden Avenue, as said intersection is described in deed to the City of Santa Ana, a Municipal Corporation, recorded October 20, 1959, in Book 4935, Page 146, Official Records of Orange County, California; thence along said center line of Fairview Avenue North 0° 46' 50" West 351.85 feet; thence South 89° 13' 10" West 50.00 feet to the true point of beginning of this description: thence South 2° 54' 05" West 31.14 feet to the Westerly line of the 104.00 foot strip of land described in said deed; thence along said Westerly line North 0° 46' 50" West 1894.80 feet to a tangent curve concave Easterly and having a radius of 1252.00 feet; thence Northerly along said curve 362.21 feet through a central angle of 16° 34' 16" to a point that bears North 0~ 46' 50" West from said center line intersection of Fairview and McFadden; thence South 0° 46' 50" East 7.08 feet to a point on a curve concave Easterly and having a radius of 1250.00 feet, said curve being concentric with the curve first described herein, a radial to last mentioned point bears North 74° 31' 13" West; thence Southerly along last mentioned curve 354.74 feet through a central angle of 16° 15' 37" to the point of tangency with a line bearing South 0° 46' 50" East; thence along said tangent line South 0° 46' 50,' East 1863.72 feet to the true point of beginning. -1- BE IT FURTHER RESOLVED= That June 5, 1961, at the hour of 7:30 P.M., in the Council Chambers, City Hall, Third and Main Streets, Santa Ana, California, is hereby fixed as the time and place for hearing all persons interested in or objecting to said proposed street vacation. The City Council declares its intention to proceed with the street vacation under the provisions of the street vacation Act of 1941 (Sections 8300 through 8374 of the California Streets and High- ways Code). The Clerk of the Council is ordered to publish this Resolution in the manner prescribed by law for the publication of Ordinances of the City, and the Director of Public Works is ordered to post notices of street vacation conspicuously along the line of said street, stating the passage of this Resolution of Intention to Vacate, and the time and place of hearing thereof. Said notices shall be posted not more than 300 feet apart and at least three shall be so posted. Both publication and posting shall be completed at least 10 days before the date of said hearing. PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 1st day of May, 1961.
