HomeMy WebLinkAboutCOSTA MESA COUNTY WATER DISTRICT (2)AGREEMENT FOR CONSTRUCTION, OPERATION AND 14ATNTENANCE OF FACILITIES FOR AUTOMATIC INTER -CONNECTION BETWEEN THE COSTA _MESA COUNTY WATER DISTRICT AND THE CITY OF SANTA ANA THIS CONTRACT, made and entered into by and between the City of Santa Ana, a chartered California Municipal Corporation, hereinafter referred to as SANTA ANA and the COSTA MESA COUNTY WATER DISTRICT, hereinafter referred to as DISTRICT. W I T N E S S E T H WHEREAS, there is presently a need to have an automatic- ally controlled and metered inter -tie to provide an independent emergency water supply to district at the location depicted in Attachment "A"; and WHEREAS, such automatically and meter -controlled water supply inter -connection does not presently exist, NOW, THEREFORE IT IS AGREED AS FOLLOWS: (1) STATEMENT OF WORK A. It is agreed that the DISTRICT shall bear the total cost of installation, operation, supervision and maintenance of the twelve inch (12") automatic inter -connection, including, but not limited to controls, meters and all pertinent auxiliary equipment, piping and valves required for the proper functioning of said inter- connection, system as depicted in Attachment "A". B. The type of manufacturer of the meter and automatic valve controls shall be approved by the Director of Public Works City of Santa Ana, prior to the .installation of said inter -connection. General specifications for said equipment are provided in Attachment "B". C. Upon execution of this agreement DISTRICT shall submit a cashier's check in the amount of eight thousand dollars ($8,000.00) to Santa Ana in payment of one half the cost of the existing twelve inch (12") Santa Ana water stain located on Sunflower Avenue from Bear Street to Bristol Street, Santa A-na. D. Both parties shall be responsible for the installation and maintenance of their respective water mains as depicted in Attachment "A". (2) EMERGENCY USE - Should a failure of District's water supply in this area occur, this inter -connection is intended to automatically supply District's immediate emergency needs to this area from Santa Ana's water supply. Should a failure of water supply occur simultaneously to SANTA ANA and DISTRICT, the emergency inter -connection will remain closed until the managers of both agencies are able to make an allocation of available water to each agency, duly con- sidering each agency's obligation to supply their own needs before permitting the inter -connection to be opened and operable. In the event that the respective nfanagers are unable to agree on operation of this emergency inter -connection, or it appears one of the parties will be placed in an injurious position due to lack of adequate water supply, the parties agree to hold individual or joint meetings of the Board of Directors and the City Council within seventy-two (72) hours after request for such a meeting. (3) PAYMENT FOR WATER OBTAINED The cost of water obtained by DISTRICT through this emergency inter -connection shall be paid pursuant to Santa Ana Municipal Code Section 39-35 providing Santa Ana to charge the applicable rates, charges and penalties for customers outside the city limits. Said water charges will be in compliance with such water rates as are established by:councilmanic resolution when payment is due. Articles I and II of Chapter 39 of the Santa Ana Municipal Code, Attachment "C" are hereby incorporated by reference and are to be utilized to clarify the intent and provisions of this agree- ment. (4) QUANTITY OF WATER GUARANTEE. Santa Ana by this agreement does not guarantee nor anticipate the sale of any regular or specific quantity of water to DISTRICT, -2- IN WITNESS THEREOF, the parties have set their hands the day and, year as is written below: DATE Jal-Mary 2 19 711 ATTESTATION: Florence I. The proposed inter -tie shall be metered with a meter suitable for the required fire flows and for any domestic water requirements which might occur. The high flow recording portion of the meter shall be transmitted by telemetering over a leased telephone line to the Santa Ana Walnut Water Plant to differen- tiate readily between a high flow through the connect- ion and a large main line leak. 2. The automatic valve control must be adequate to deli- ver both the anticipated fire demand and the domestic flow. The valve will require pressure sensors and recording pressure gauges both upstream and down- stream of the pressure regulator that will sense a drop in pressure of the Costa Mesa system below a predeterftindd minimum. The pressure regulator valve will then open allowing Santa Ana pressure and flow to make up the required amount. 3. Personnel certified as qualified to operate and main- tain automatic valve equipment shall operate the automatic valves bimonthly and certify to their opera- tion and make whatever repairs are found necessary. The cost of this operation, test and repairs shall be borne by the District. 4. Personnel certified as qualified to test and maintain large meters of this type shall operate the meters bimonthly and test the meters annually and make what- ever repairs are found necessary. The City Council received their request on August 21, 1972 and referred it to staff to determine conditions to be applied in an agreement for the proposed inter -tie. The district and the South Coast Plaza owners are agreeable to the attached conditions prepared by Santa Ana. The conditions provide for reimbursement of half -the cost of the water main on Sunflower Avenue, installation of the interconnection at District expense, operation and maintenance of' the automatic pressure control valve and meter at District expense and the applicable double rate water charges for a metered connection serving outside the Santa Ana City limits. Recommendation Prepare an agreement for an automatic inter -connection between the Costa Mesa County Water District and the City of Santa Ana water system. Include in the agreement the attached conditions that are required to control and meter the water that may enter the Costa Mesa County Water District System in the event of an emergency. R2oald E.
