WITNESSETH
Recitals:
A. The City and the County entered into that certain
Agreement dated August 17, 1992, by which the County undertook to
provide the services of a Deputy District Attorney and a Deputy
Probation Officer as part of the City's "Operation Weed and Seed"
(the "Agreement").
B. The parties hereto do now desire to amend the Agreement
to extend its term and increase the maximum payable compensation.
WHEREFORE, in consideration of the foregoing, and subject to
the terms and conditions of the Agreement as hereby amended, the
parties hereto do hereby agree that the Agreement is amended as
follows:
1. In Section 2, the figure 11$146,161" is replaced with the
figure 11$292,32211 and the date "December 31, 199211 is replaced with
the date "September 30, 1993.11
2. The first sentence of Section 10 is amended to read as
follows: "This Agreement shall be effective for eighteen months
commencing on April 1, 1992, and terminating on September 31, 1993. 11

SPECIAL CONDITIONS
1. The grantee agrees to comply with the financial and
administrative requirements set forth in the effective
edition of the "Financial and Administrative Guide for
Grants," OJP M 7100.1D.
2. The recipient agrees to comply with the organizational audit
requirements of OMB Circular A--128, "Audits of state and
Local Governments.." In conjunction with the beginning date
of the award, the audit report period of the state or local
governmental entity to be audited under the single audit
requirement is July 1, 1992 to June 30, 1993. The audit
report must be submitted no later than July 31, 1994, and
for each audit cycle thereafter covering the entire award
- period -as -originally approved or amended. The management
letter must be submitted with the audit report. Subsequent
audits must be submitted no later than thirteen (13) months
after the close of the recipient organization's audited
fiscal year. The submission of the audit report shall be as
follows:
An original and one copy of the audit report shall be sent
to the Department of Health and Human Services. Also, a copy
of the audit report shall be sent to the Department of
Justice, Regional Inspector General for Audit, 525 Market
Street, Suite 3522, San Francisco,"California 94105. A copy
of your audit transmittal letter to the regional inspector
general's office shall be sent to Audit Services, Office of
the Comptroller, office of Justice Programs, DOJ, Room 942,
633 Indiana Avenue, N.W., Washington, D. C. 20531.
The recipient agrees to submit a corrective action plan with
the audit report to the DOJ Regional Inspector General for
Audit, when there are findings, recommendations disclosed in
the audit report. The corrective action plan should
include: (1) the specific steps taken to comply with the
recommendations; (2) the timetable for performance and/or
the implementation date for each recommendation; and (3) a
description of the monitoring to be conducted to ensure
implementation.
3. The Grantee shall submit to BJA, for review and discussion,
approval or disapproval, all drafts of written documelts as
they are developed. The Grantee shall submit to BJA one
hard copy of the final draft of written documents which are
to be printed by the government, accompanied by IBM

4. Grantee agrees that all income generated as a direct result
of this project shall be deemed program income. It must be
accounted for and it must be used for the purposes and under
the conditions applicable to the use of grant funds. This
is in accordance with regulations for program income under
the Common Rule, Uniform Administrative Requirements for
grants and Cooperative Agreements.
5. Grantee shall be aware that lodging, meals, and incidental
expenses (M & IE) relative to OJP sponsored conferences
shall generally be limited to the established Federal rate
for the geographic location of the conference. Any
exception to this policy must be justified as cost effective
and will require the prior approval of the Bureau of Justice
Assistance and the Office of the Comptroller, OJp. Any such
conference costs exceeding the Federal rate and incurred
without prior justification and prior approval will be
disallowed-

6. Prior to the expenditure of program funds that may be
allocated for confidential funds, the project director shall
sign a certification indicating that he or she has read,
understands and agrees to abide by all of the conditions
pertaining to confidential fund expenditures as set forth in
the effective edition of the Guideline Manual M 7100.1D,
"Financial and Administrative Guide for Grants." This
signed certificate must be returned to the Office of Justice
Programs, Office of the Comptroller, for inclusion in the
official grant file.
7. The grantee agrees to provide to the Bureau of Justice
Assistance (BJA) a listing of all consultants to be used
under this.. grant, a summary of their professional
qualifications, and their proposed daily rates, which may
not exceed $150 without the express separate approval of
BJA.
8. The grantee agrees to participate in management "cluster"
conferences sponsored by BJA.
9. one of the provisions of M 7100.1D, Chapter 5, "Compensation
for Personal services," Paragraph 49. b.(2) states that, if
paid, ('...overtime premium should be prorated among the
various jobs and not charged exclusively to grantor agency
funds." That provision has been waived for this program.
Grantee agrees, however, to comply with all other provisions
of M 7100.1D, Chapter 5, Paragraph 49 and, in addition, the
Grantee agrees to maintain project records of overtime
payments in a form that, for audit purposes, is easily
identifiable and traceable as expenditures of Federal
project funds.
10. DISCLOSURE OF FEDERAL PARTICIPATION:.In compliance with
Section 623 of Public Law 102-141, the recipient agrees that
no amount of this Award shall be used to finance the
acquisition of goods or services (including construction
services) for the Project unless the recipient:
(a) specifies in any announcement of the awarding of the
contract for the procurement of the goods and services
involved (including construction services) the amount of
Federal funds that will be used to finance the acquisition;
and
(b) expresses the amount announced pursuant to paragraph (a)

This project site will initiate a comprehensive, multi -agency program to coordinate the delivery of criminal
justice and social services to eliminate violent crime, drug -trafficking, and drug -related crime and to provide a
safe environment for law-abiding citizens to live, work, and raise a family. Through the application of
coordinated law enforcement and criminal justice services in a target neighborhood, the City will "weed" from that
neighborhood criminal offenders engaged in drug crimes and other violent offenses, stabilize the neighborhood
through coanunity-oriented policing, and "seeci" that neighborhood with housing, employment, and social sustaining
programs.

The grant included funding for a team of professionals including
a Deputy District Attorney and a Deputy Probation Officer from the
County of Orange. Funding for these two positions is not to exceed
$292,322 during the period from April 1, 1992 through September 30,
1993.
The grant included funds to establish a "victim -witness" program.
This program provides victims and witnesses with support and
services during the process of investigation, court hearings and
follow-up periods. Funding for this program is not to exceed
$58,880 during the period from July 1, 1992 through September 30,
1993.
FISCAL IMPACT
The appropriation adjustment will increase the anticipated revenue
in the Weed & Seed Grant account (account no. 126-01-5350) and the
expenditure appropriations (account no. 126-337-various) by
$487,000.
