MODIFICATION OF
SENIOR CITIZENS SERVICE CENTER
REVENUE SHARING AGREEMENT
The CITY OF SANTA ANA, a chartered municipal corporation,
hereinafter referred to as "CITY" and.the COUNTY OF ORANGE, hereinafter
referred to as "COUNTY", between the parties dated May 28, 1974.
W I T N E S S E T H:
WHEREAS, CITY and COUNTY have entered into a Revenue Sharing
Agreement for the purpose of specifying the location and construction
of a Senior Citizens Service Center and to provide to the elderly poor
of CITY financial and health counceiing and recreational facilities.; and
WHEREAS, it is desired that the location of said senior Citizens
Service Center be changed from the northerly side of Third Street
between Ross and Birch Streets in the City of Santa Ana, to the southerly
side of Third Street between Ross and Birch Street, comprising the
approximate one-third (1/3) western portion of Birch Park; and
WHEREAS, said Senior Citizens Service Center will constitute a
park purpose, consistent with the park purposes presently being made of
Birch Park; and
WHEREAS, the former site for said Senior Citizens Service Center
designated 'in the agreement between the parties dated May 28, 1974,
located on the northerly side of Third Street between Ross and Birch
Streets, in the City of Santa Ana, is to be used for parking purposes
for said Senior Citizens Service Center except for a portion thereof
which, at -some future time, may possibly be used for street purposes
for the extension of Fourth Street to interconnect with Third Street;
and
WHEREAS, when and if a portion of said Senior Citizens Parking
site is used for street purposes by the City of Santa Ana for the
extension of Fourth Street to interconnect with Third Street, Birch
Park may possibly be enlarged.
NOW, THEREFORE, FOR AND IN CONSIDERATION OF THE MUTUAL PROMISES,
COVENANTS AND CONDITIONS HEREINAFTER SET FORTH, THE PARTIES HERETO
AGREE TO MODIFY THE REVENUE SHARING AGREEMENT ENTERED INTO BETWEEN
THEM, MAY 28, 1974, BY CHANGING PARAGRAPHS I, II, IV, VI, IX AND X
TO READ AS FOLLOWS:

I
The Senior Citizens Service Center shall be located on the
southerly side of Third Street between Ross and Birch Streets, in the
approximately western one-third (1/3) portion of Birch Park, in the
City of Santa Ana, California, as shown on the map which is attached
hereto as Exhibit "A" and incorporated herein and made a part hereof
by this reference as though fully set forth. In addition thereto, CITY
agrees to provide parking for said Senior Citizens Service Center, on
the site formerly indicated for said Center in the May 28, 1974,
agreement which site is located on the northerly side of Third Street
between Ross and Birch Streets in the City of Santa Ana as designated
on Exhibit "A" herein, except for a portion of said parking site which,
at some future time, may possibly be used for street purposes by the
City of Santa Ana extending Fourth Street to interconnect with Third
Street.

The parties hereto agree that the cost of acquisition, development,
construct -ion, and operation of the Senior Citizens Service Center, and
the parking site for said Senior Citizens Service Center, for Senior
Citizens Social Services and park services use regarding the project
site described in Paragraph I above, shall be divided between the CITY
and the COUNTY, and the CITY shall pay Six Hundred Sixty Fight Thousand
Four Hundred ($668,400.00) Dollars, and the COUNTY shall pay not more
than Four Hundred Ninety Thousand ($490,000.00) Dollars. COUNTY'S
and CITY'S share of said cost of acquisition, development, construction,
and operation is set forth in the proposed budget for said Santa Ana
Senior Citizens Service Center, and parking site therefor, attached
hereto as Exhibit "B", and incorporated herein and made a part hereof
by this reference as though fully set forth. CITY shall be responsible
for the costs of -overhead, operation, and maintenance of said Senior
Citizens Service Center and said parking site; such costs are not to
be included in this joint agreement. Monthly payments made by the
COUNTY, based on actual expenditures, shall be made upon tender of
invoices and proper documentation of accounting, and with the approval
of the COUNTY'S Revenue Sharing Office.

IV
For purposes of this agreement all funds under this agreement
shall be disbursed or encumbered on or before July 1, 1976, except
as provided under Section X of this agreement.
VI
CITY agrees that the overhead for the facility itself and the
parking site, planning not including design services and all other
development, shall not be included under this joint funding agreement.
The CITY acknowledges responsibility for the design of the facility,
and the parking area, and agrees that the plans and specifications
shall be approved by the COUNTY prior to advertising for bids. COUNTY
agrees that the design services shall be included under this joint
funding agreement.
IX
CITY agrees that the Senior Citizens Service Center to be provided
under this agreement ,_list be retained for use consistent with Senior.
Citizens Social -Park Service purposes as provided for under CITYS
concept proposal dated December 3, 1973, as submitted to COUNTY -
Revenue Sharing Office which is attached hereto and incorporated herein
by this reference as though fully set forth. These programs for Senior
Citizens shall include, but not be limited to assistance in the location
of housing, jobs, consumer protection, health, recreation, transportation
and counseling assistance in obtaining legal and medical aid.
CITY further agrees that level of operation and maintenance for
the Senior Citizens Service Center to be provided under this agreement
must be adequate to insure the maximum utilization of the facility by
the public for Senior Citizens Social Park Services purpose, and that
the use of the property shall be granted to all residents of the COUNTY
on the same conditions that the residents of the CITY use the property,
and if the Senior Citizens Service Center ceases to be used for said
Senior Citizen Social -Park purposes by CITY, and such cessation is not
approved by the Board of Supervisors, CITY shall repay to COUNTY the sum
contributed by the COUNTY under this agreement at the time of such cessation.
CITY also agrees to use the aforedescribed parking site for
Senior Citizens Service Center parking except a portion of said site
which at some future tire may possibly be used for street purposes by
the City of Santa Ana extending Fourth Street to interconnect with Third
Street.

In the event of any conflict or inconsistency between the
provisions of this agreement and the May 28, 1974, agreement, the
provisions of this agreement shall control in all respects.

CITY agrees that $90,000 shall be used exclusively for planning
and implementing service to assist in the transportation needs of
Senior Citizens to and from the Center. As outlined in Exhibit "C"
which is attached hereto and incorporated herein by this reference as
if fully set forth. 11owever before any funds may be expended CITY
must submit all plans and r)roQc)sal.s to COUNTY for approval by COUNTY'S
Revenue Sharing Office or Board of Supervisors. Funds must be disbursed
prior to July 1, 1976.
IN WITNESS WHEREOF, the parties hereto have executed this
modification of agreement on the day and year first above written.

SANTA ANA SENIOR CITIZEN SERVICE CENTER TRANSPORTATION
CITY agrees that t90,000 shall be used exclusively for planning and imple-
menting service to assist in the transportation needs of Senior Citizens to
and from the Center.
Special transportation needs of the elderly have become evident in other
social/nutritional programs currently being operated in Orange County.
These needs occur because the grid pattern of existing bus routes is often
inaccessible due to long distances between pick-up points and waiting periods
which are unbearable for the elderly and handicapped. In addition, dial -a -
ride systems utilize mini -buses which are not equipped to handle wheel chairs
and semi -ambulatory elderly or handicapped persons.
Through negotiations with the Orange County Rapid Transit District several
possible specializedservices will be provided with the $90,000 allocated
for transportation. Specifically, the City proposes that Orange County
Transit District purchase two (2) specially equipped buses to augment the
existing fixed bus routes to make the Center more accessible to the handi-
capped Senior Citizens.
These buses will be used by Orange County Transit District for provision
of the following services to Seniors:
1. A modified dial -a -ride system using the specially equipped bus to
transport Senior Citizens from areas not serviced by the fixed bus route.
2. A "subscription" bus type service for handicapped Senior Citizens which
would provide transportation to and from the Senior Citizens Center for
specific purposes in accordance with pre -arranged schedules such as for
dental, heart, lung and/or eye examinations, etc.
This special transportation service will be in addition to the County's free
pass system for Senior Citizens which is excellent but which is unable to
reach many isolated handicapped Senior Citizens who will thus be unable to
avail themselves of Senior Citizen Center services.
The City's concern is to maximize the utilization of the Social Services at
the Center, specifically to insure that handicapped and isolated Citizens
have adequate access to the Medical, dental, welfare and nutritional programs
proposed for the Senior Citizens Center.
The proposed special transportation program will insure that the target groups
for whom Center programs have been designed will be able to reach those
programs.

In accordance with the City of Santa Ana's policies regarding
implementation of the California Environmental Quality Act of
1970 (specifically Section 21151 of the Public Resources Code),
the Environmental Impact Evaluator for this department has
reviewed the Environmental Assessment Form submitted in re-
quest for Negative Declaration status for the above described
project and hereby finds that the proposed project cannot, or
will not, have a significant effect on the environment. -
Neg-ative Declaration status is therefore granted for this pro-
ject and the submittal of an Environmental Impact Report is
thereby not necessary.
The granting of Negative Declaration status is based upon the
following:
1) The Proposed project is an expansion to an existing
senior citizen's facility on existin ublic lands
requiring no relocation or adverse effects to the
surrounding area.
2) The proposed project will be located in an area that pre-
sently has a high percentage of poor elderly. The center I
will be conveniently located and will be in harmony with
the surrounding area;
