ORANGE COUNTY, CALIFORNIA
February 5, 1974
On motion of Supervisor Caspers, duly seconded and carried, the
following Resolution was adopted:
BE IT RESOLVED that the Chairman of this Board is hereby authorize
to execute the Revenue Sharing Agreement dated February 5, 1974, between
the County of Orange and the City of Santa Ana for.the development of
Spurgeon Intermediate Ballfields in the sum of $79,350, and the Clerk of
this Board is directed to attest to same.

REVENUE SHARING AGREEMENT ' I
THIS AGREEMENT made and entered into this' -5-f 07 d, a y o K
1977-°l1 by and between the CITY OF SANTA ANA, a chartered Municinal

corporation, hereinafter referred to as "CITY" and the COUNTY OF
ORANGE, a division of the State of California, hereinafter refer-
red to as "COUNTY".
W I T N E S S E T-H
WHEREAS, COUNTY has agreed to share some of its general revenue
sharing funds with cities, service areas and Park and Recreation
Districts; and
WTIEREAS, the CITY has requested the one of these revenue sharing
and matching fund projects be the development of additional
recreation facilities for Spurgeon Intermediate School and that
the funds shall be used to purchase and install lighting for
three (3) ball fields, three (3) backstops with bleachers, play-
ground equipment, drinking fountain, benches, restroom fixtures,
par'kinq facilities and walkways; and
WHEREAS, Spurgeon Inter -mediate School is a recreational facility
serving a 2/3 mile radius in the west central area of Santa Ana,
with an approvimate population of 4,000 people, and
iffIEREAS, CITY has adopted the General Plan Program oF the City,
page 16, technical work-bood 4 Facilities Plans/Imple-mentation

Proposals, whereby the minimal park requirements are two acres
per one thousand population; and
TMEREAS, CITY has further delineated park and recreation lards
and facilities in its General Plan, page 19, workbook 4, existing
and proposed;
NOW, THEREFORE, FOR AND IN CONSIDERATION OF THE P<IUTU_UL PRaMISES,
COVENANTS AND CONDITIONS HEREINAFTER SET FORTH, THE P.kRTIES
HERETO AGREE AS -FOLLOWS

Spurgeon Intermediate School is located at 2701 !•Test 5th
Street, Santa Ana, California.
IT
The parties hereto agree that the cost of developiment for recrea-
tional use of the Revenue Sharing project site described in para-
graph I above shall be equally divided between the CITY and the
COUNTY and the CITY shall pay 50% of the project cost, or Seventy-.
Nine Thousand Three Hundred Fifty Dollars
and the COUNTY shall,pay 50% 6a the project cost, or Seventv-Mine
Thousand Three Hundred Fifty Dollars ($79,350.00) or a
lesser amount, if the CITY'S cost of development after the date
of the agreement decreases. CITY shall be responsible.for the cost.
of overhead, operation and maintenance; such costs are not to be in-
cluded in this joint funding agreement. Monthly payments by the
COUNTY, based on actual expenditures,.shall he made upon tender of

znvoices and proper documentation of accounting and with the
.approval of the County Administrative'Offiee.
III
The CITY'S source of funds for its share of the project cost
-is derived from its participation in the Federal Revenue
.sharing Program_
IV
For the purpose of this agreement Spurgeon Intermediate School
shall be completed no later than Dece-nber-31, 1974 and all funds
received under this agreement shall be disbursed or encumb'red"
.on or before that date..
V
CITY shall maintain proper.accounting records and procedures
and other evidence pertaining to costs incurred which records
_�shali be kept available at the CITY'S office during the
agreement period and thereafter for five (5) years from tine
date of final payment of county revenue sharing funds and
.shall make said records available to the COUNTY for the
purposes .of.auditing and that quarterly progress reports
shall be supplied by the CITY to the County Adsqiniscrative
Office. ;
VI
CITY agrees that for development projects planning and design
services and all other development overhead shall not be included
` n joint funding_ -The CITY acknowledges responsibility for -the
%esign of development projects and agrees that plans and spec;ii--
ications shall be approved by the COUNTY prior to advertising for
bids.

VII
The CITY acknowledges that funds being provided by COUNTY
are funds received by the County of orange pursuant to the
state and local Fiscal Assistance Act of 1972% Public Lata
92-512, and that expenditure of these funds must be in
accordance with said law and regulations issued by agencies
of the federal government. CITY further acknowledges that
when such funds are used on any construction_ project for
which twenty five percent C250) or more of the costs are
paid out of revenue funds, prevailing wages must be paid in-
accordance.with the Davis -Bacon Act, as amended, 40 U.S.C.
276(a) and 276(a)(7), and in compliance with labor standards
as specified by the Secretary of Labor. CITY further agrees
that any federal funds which are expended improperly by the
CITY shall be refunded to the COUNTY.
VIII
No person shall, on the basis of race, color, national origin-,
or sex, be.excluded from participation in or be denied the
benefits of, or be subject to discrimination under, any program
or activity funded in whole or in part with funds made
available under this agreement..
IX
CITY agrees the projects under this program _-Lust be retained
for public parks, recreation or open_ space purposes, along
��ith the level of operation and maintenance adequate to insure
the maximum utilization.oF the project by

the public for recreation purposes and that the use of the
property shall he granted to all residents of the County on
the same conditions that residents of CITY use the property
and that if the property ceases to be used for said purpose
by CITY, CITY shall repay to COUNTY the sum Contributed by
the County-.herethder.
IN WITNESS WHEREOF the parties hereto , have executed this
Agreement this day and year first above written.
