J F eard�r I AGREEMENT THIS AGREEMENT is made this 3 day of ,, 1972, between the COUNTY OF ORANGE, hereinafter referredd t�COUNTY", and THE CITY OF SANTA AI'VA, hereinafter referred to as "CITY". 1. COUNTY and CITY own adjoining properties which are shown on Exhibit "A", attached hereto and made a part hereof. 2. COUNTY plans to construct a Southwest Santa Ana Community Building on its property to house the Welfare, Medical Center, and Probation Departments. 3. CITY plans to develop its property as a neighborhood park 11. COUNTY and CITY have been cooperating in the over-all design plan for both projects. 5. COUNTY and CITY have designed both the community building and the park in order to have joint use of parking which provides the most effective use of land for parking requirements. 6. The peak parking requirements for both the CITY'S park and the COUNTY'S community building will be at different times, enabling the most effective use of parking spaces. 7. COUNTY will begin construction prior to CITY, and will install parking spaces on both the east and west sides of the proposed building as shown on Exhibit A. 8. CITY will install parking spaces in the two areas in the CITY property as shown on Exhibit A at the time of park development. NOW, 'THEREFORE, in consideration of these premises, the parties hereto agree as follows: I COUNTY shall: A. Construct the proposed parking lot in accordance with the plan shown on Exhibit „A"'. Allow CITY to use parking spaces on COMITY property to handle any overage parking needs of CITY'S park when ours. hparking spaces'are not required during normal working hours. II J , CITY shall: A. In the extent COUNTY desires additional parking prior to CITY'S development of park, allow COUNTY to install parking facilities on CITY'S property in accordance with parking plan in Exhibit A. III It is mutually understood and agreed that: A. In the event COUNTY installs parking facilities onCCITY'Swill property prior to CITY°S own development of property, pay for the construction of the parking facilities on CITYtS property. B. COUNTY and CITY will be responsible for the repair and maintenance of the parking lots located on their respective properties. C. COUNTY and CITY will hold each other harmless of any liability arising out of the. use of their respective properties. yne as D.
