HomeMy WebLinkAbout61-187RESOLUTION NO. 61-187 ORDERING VACATION OF A PORTION OF SIXTH STREET BETWEEN MABURY STREET AND THE SANTA ANA FREEWAY RESERVING THEREFROM A PUBLIC UTILITY EASEMENT W~EREAS, a request for the vacation of that portion of Sixth Street herein described was received and referred to the Department of Public Works and the Planning Department, which said Departments recommended approval of the abandonment subject to certain conditions; and WHEREAS, a public hearing was duly held on said question on notice contained in Resolution No. 61-164,declaring intention to vacate, and on published and posted notices as required by law, and after hearing, the Council determined that said vacation should be effected. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby finds that the portion of Sixth Street between Mabury Street and the Santa Aha Freeway and herein described is unneces- sary for present and prospective street purposes. BE IT FURTHER RESOLVED: That the City Council hereby makes its ordeI vacating and abandoning for street purposes that portion of Sixth Street between Mabury Street and the Santa Ana Freeway, in the City of Santa Ana, County of Orange, State of California, described as: That portion of Central Avenue (now Sixth Street) as shown on a map of the "East Side Addition to Santa Aha" recorded in Book 1, Pages 21 and 22, Miscellaneous Maps in the Office of the County Recorder of Orange County, California, bounded Northerly by the South line of the North 10 feet of said Central Avenue (now Sixth Street); bounded Southerly by the North line of the South 10 feet of said Central Avenue (now Sixth Street); bounded Easterly by the Northerly prolongation of the East line of Lot 12 of said "East Side Addition to Santa Aha" and bounded Westerly by the following described line: Beginning at a point on the Northerly line of said Southerly 10 feet of Sixth Street, distant thereon 193.08 feet Westerly from the intersection of said Northerly line with the Northerly prolongation of said East line of Lot 12 and running thence Northwesterly in a straight line to a point on the Southerly line of said Northerly 10 feet of Sixth Street, said point being 235 feet Westerly from the inter- section of said Southerly line with the Northerly prolonga- tion of said East line of Lot 12; -1- RESERVING AND EXCEPTING THEREFROM a permanent easement and right of way for the construction, maintenance, opera- tion, repair, replacement and e~largement of sanitary sewers, water mains and lines, storm drains or ditches, poles and lines and conduits for the use of telephonic and telegraphic messages, transmission of ~&e~trical energy, and pipes for the transmission of gas, together with appurtenant structures in, upon, over and across a strip of land 25 feet in width, the South line of which is 10 feet Southerly, measured at right angles from the center line of said Sixth Street. at its ATTEST: C~L'~RK OF T}{E COUNCIL PASSED AND ADOPTED by the City Council of the City of Santa Ana regular meeting held on the 7th day of August, 1961.
