HomeMy WebLinkAboutORIGINAL HOUSE OF PIESOHOP #1038, L E A S E This Lease is between the CITY OF SANTA ANA, herein called Lessor, and the ORIGINAL HOUSE OF PIES, a California Corporation, herein called Lessee. WITNESSE'Pff This agreement is being executed to legally rectify the Lessee inadvertently extending its building on to City of Santa Ana property. Per variance 70-17, an encroachment permit will be granted to Lessee for twenty years or the life of the building presently standing whichever is less in duration. Lessor leases to Lessee, and Lessee hires from Lessor, as herein provided, the premises located at 2699 N. Main Street, City of Santa Ana, County of Orange, State of California, and described more particularly as follows: Legal description of proposed lease area. A portion of the southwesterly quarter of Section 31, Township 4 South, Range 9 West, S.B.B. & M. in the City of Santa Ana, County of Orange, State of California, described as follows: Commencing at the intersection of the east line of North Main Street as said east line existed on January 10, 1922, with the south line of said Section 31; thence along said east line, North 00 18' 30" East, 50.00 feet; thence leaving said east line and running parallel with the south line of said Section 31, North 880 38' 30" East, 31.00 feet to the east line of an existing easement for public street purposes as recorded in Book 9316, Page 748, Official Records of said County; thence along said east line, being also along a line parallel with and 64.00 feet easterly at right angles from the centerline of said North Main Street, North 00 18' 30" East, 67.00 feet to the True Point of Beginning of this description. Thence continuing along said east line, North 00 18' 30" East, 30.00 feet; thence South 880 38' 30" West, 1.500 feet; thence South 10 36' 12" East, 30.00 feet to a line which bears South 880 38' 30" West from the True Point of Beginning. Thence North 880 38' 30" East, 0.50 foot to the True Point of Beginning. II The term of this Lease is twenty (20) years beginning January 1, 1971, or the life of the Building presently standing on the premises, whichever is less. The total rent of this Lease is the sum of Two Thousand and no/100 ($2,000.00) Dollars, payable upon execution of the lease. all Lessee agrees to procure and main -Lain in force during the term of this Lease, at his expense, Public Liability insurance adequate to protect against liability for damage claims through public use of or arising out of accidents occuring in or around the leased premises, in a minimum amount of $100,000 for each person injured; $300,000 for any one accident; and $50,000 for property damage. Such insurance policies shall provide coverage for Lessor's contingent liability on such claims or leases. Proof ofCoverage shall be delivered to the Lessor and Lessee agrees to obtain a written obligation from the insurers to notify Lessor in writing at least twenty (20) days prior to cancellation or refusal to renew any such policies. Lessee agrees that, if such insurance policies are not kept in force during the entire term of this Lease and any extension thereof, Lessor may procure the necessary insurance,pay the premium, therefore, and that such premium shall be repaid to Lessor as an additional rent installment for the month following the date on which such premiums are paid. W In the event Lessor employs attorneys to enforce the terms of this Lease, it shall be entitled to reasonable attorney fees in addition to all other sums recovered.
