HomeMy WebLinkAbout61-206RESOLUTION NO. 61-206 AUTHORIZING CONDEMNATION OF CERTAIN REAL PROPERTY FOR THE PURPOSE OF EXTENDING THE CITY SEWER SYSTEM ON THE EAST SIDE OF TUSTIN AVENUE, NORTH OF FIRST STREET, AND DECLARING THE NECESSITY THEREFOR WHEREAS, in order to provide satisfactory municipal services to a certain area annexed to the City of Santa Ana that is presently without sanitary sewers, it has been determined that said sewers need be installed along the East side of Tustin Avenue, North of First Street; and WHEREAS, it is necessary that the City obtain an easement for sewer purposes along said East side of Tustin Avenue, North of First Street, in order to install adequate sewer facilities. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Aha does hereby find and determine that the public interest and necessity require that said sewer system be installed and improved, and further require that said City do have, take and acquire an easement for sewer purposes over, under, through and across certain lands in the City of Santa Ana, County of Orange, State of California, described as: The Westerly 40.00 feet of the following described property: Commencing at the Southwest corner of land owned by W. B. Wall in the center of the highway known as the Newport Road; thence South along the center of said highway ten chains and~xty-eight and three-fourths links; thence East eight chains and eighty-nine and one-half links; thence North ten chains and sixty-eight and three-fourths links; thence West eight chains and eighty-nine and one-half links to the place of beginning, said tract containing nine and one-half acres of land, more or less, and being a part of the Felipe Yorba Tract of land partitioned to him by decree of court September 12, 1868. Excepting therefrom that portion of said 40.00 feet previously dedicated for street purposes. BE IT FURTHER RESOLVED: That the public interest, necessity and convenience require, and it is hereby ordered, that the City of Santa Ana, a municipal corporation, Plaintiff in the condemnation action -1- ordered herein, take immediate possession and use of the property herein ordered to be acquired upon complying with the requirements of the law applicable thereto; that the City Attorney report to the Director of Finance the amount of money required thereof; and that the Director of Finance shall deposit said amount with the Clerk of the Court. BE IT FURTHER RESOLVED: That the said action for condemnation of said property so to be acquired shall be taken in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain.
