HomeMy WebLinkAbout61-208RESOLUTION NO. 61-208 INITIATING PROCEEDINGS FOR THE A~TION OF TERRITORY TO THE CITY OF SANTA ANA, DESIGNATING AN APPROPRIATE NAME FOR SAID TERRITORY OF "SEVENTEENTH ANDMABURY NORTH ANNEX" AND GIVING NOTICE OF PROTEST HEARING THEREON WHEREAS, at the request of property owners in the territory herein described, a description and map of said territory were pre- sented to the Santa Ana Planning Commission and to the Orange County Boundary CO~unission, which caused a report to be prepared finding that the boundaries of said proposed annexation met the approval of the Orange County Surveyor's office in respect to Government Code Section 35002. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby initiates proceedings for annexation of said territory herein described to the City of Santa Aha for the following reasons: 1. That said territory can best be served by the City of Santa Aha with municipal services of the highest quality anywhere obtainable at a cost for such services which is lower than can be obtained anywhere else in the County of Orange. 2. That it is to the mutual advantage of the City and the land owners that said territory become a part of said City. BE IT FURTHER RESOLVED: That the City Council hereby declares its intention to annex all of the territory hereinbelow described under the provisions of the Annexation of Uninhabited Territory A ct of 1939; hereby finds and declares that said territory is uninhabited within the meaning of Government Code Section 35303 on the date of the adoption of this Resolution; that said territory is contiguous to the City of Santa Ana, lies in the County of Orange, State of Cali- fornia, and is described as: -1- Beginning at a point on the centerline of Seventeenth Street 831.24 feet North 89° 43' 30" East frc~ the intersection of the centerlines of Wright Street and Seventeenth Street aS shown on a map recorded in Book 18, Page 17, Record of Surveys in the Office of the County Recorder of Orange County, California, said point being an angle point in the existing City boundary of Santa Ana, california as establishedby the Seventeenth and Mabury N.W. Annex, Ordinance NS-495 to said City of Santa And; running thence North 89° 43' 30" East along said City boundary as established by Ordinance 73 a distance of 215.46 feet to the intersection of the centerlines of Seventeenth Street and Mabury Street, as shown on said Record of Survey, and to an angle point in said City boundary as established in said Ordinance 73; thence North along the Northerly prolongation of said centerline of Mabury Street and along said City boundax~ as established by the Mabury Annex No. 2, Ordinance NS-270, 40.00 feet to the North line of Seventeenth Street, 80.00 feet wide, and to an angle point in said City boundary as established by said Ordinance NS-270, thence East along said City boundary 622 feet,~ore or less, to a point on the West line of Lot 16, Block "A", of the A. B. Chapman Tract as surveyed by Frank Lecouvreur in December, 1870 and shown On a map thereof recorded in Book 102, Page 15, Miscellaneous Maps, Records of said Orange County and to an angle point in said City boundary as established by the Seventeenth and Mabury N.E, Annex, Ordinance NS-494, to said city of Santa And; thence North along the West line of said Lot 16, Block "A" of the A. B. Chapman TraCt and along said City boundary as established by Ordinance NS-494, 959 feet, more or less, to the Southeast corner of the one acre tract conveyed by Frank S. Buchheim to AarOn Buchheimby deed recorded in Book 23, Page 241 of Deeds, Records of said Orange County; thence West, departing fr~m said City boundary, along the South line of said one acre tract 830 feet, more or less, to the East line of Tract Number 3741 as shown on a map thereof recorded in Book 136, Page 43 and 44, Miscellaneous Maps, Records of said Orange County, and to the existing boundary of the City of Santa Ana as established by the Twentieth and Lyon Annex, Ordinance NS-490, thence South 00° 01' 55" East along the East line of said Tract Number 3741 and along said City boundary 473.91 feet, more or less, to the Southeast corner of Tract Number 3741 and to an angle point in said City boundary as established by said Seventeenth and Mabury N.W. Annex, Ordinance NS-495; thence South 00° 02' 00" East along said City boundary 525.66 feet to said centerline of Seventeenth Street and to the point of beginni~g. BE IT FURTHER RESOLVED: That "SEVENTEENTH AND MABURY NORTH ANNEX" is hereby designated as an appropriate name by which said territory shall be known for the purpose of this annexation. BE IT FURTHER RESOLVED: That notice is hereby given that October 2, 1961, at the hour of 7:30 P.M. in the Council Chambers, City HalI, Third and Main Streets, Santa And, California, is the time -2- and place fixed at which said Council will hear protests against this annexation made by any person owning property within said territory. At any time before said hearing, any owner of real property within said territory may file written protest against this proposed annex- ation. Such protest shall state the name of the owner of the property affected and the description and area of the property in general terms, all as provided for in the California Government Code, Section 35312.
