HomeMy WebLinkAbout61-226RESOLUTION NO. 61-~26 INITIATING PROCEEDINGS FOR THE ANNEXATION OF TERRITORY TO THE CITY OF SANTA ANA AFTER THE CITY COUNCIL OF THE CITY OF GARDEN GROVE HAD RECEIVED THE WRITTEN CONSENT OF ALL OF THE OWNERS OF ALL OF THE REAL PROPERTY WITHIN THE TERRITORY AND HAD CONSENTED TO THE DETACHMENT OF SAID TERRITORY BY RESOLUTION NO. 1742-61, DESIGNATING AN APPROPRIATE NAME FOR SAID TERRITORY OF "VERANO AND ROBERTS - WEST ANNEX" AND GIVING NOTICE OF PROTEST HEARING THEREON WHEREAS, heretofore the territory herein described had been annexed to the City of Garden Grove, California, was~ wholly uninhab- ited, having no person residing within said territory, and the City Council of Garden Grove received the written consent and request of the persons holding all of the value of said real property in the territory, and on July 25, 1961, said City Council adopted Resolution No. 1742-61 consenting to the detachment of said territory for the purpose of allowing said territory to be annexed to the City of Santa Ana; and WHEREAS, the description of said territory was presented to the Santa Ana Planning Commission, which approved annexation thereof, and to the Orange County Boundary Commission, which caused a report to be prepared finding that the boundaries of said territory met the approval of the Orange County Surveyor's office in respect to Government Code Section 35002. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby finds that the facts next hereinabove recited are true; and hereby initiates proceedings for annexation of said territory to the City of Santa Ana for the following reasons: 1. That said territory is surrounded on three sides by the City of Santa Ana, is a long,narrow strip of land, and is proposed as a part of a subdivision to be developed as a unit. 2. That it is to the mutual benefit of the City and the owners of said territory that the same be annexed to Santa Ana. ~1- That this proceeding under Government Code Section 35304 is the first such proceeding in the County of Orange, evidences a vision, spirit of cooperation and genuine appreciation of the obligation and trusteeship imposed by the offices held on the part of the Council Members of the City of Garden Grove to afford a reasonable and economically feasible method of property development to the property owners, for which said Garden Grove Councilmen should be co~mended and which should be held up to public~ew as an example to offset petty provincialism and post office pride which has too often been displayed by little minds heretofore. Such trusteeship should be encouraged and publicized. BE IT FURTHER RESOLVED: That the City Council hereby declares its intention to annex all of the territory hereinbelow described under the provisions of the Annexation of Uninhabited Territory Act of 1939; hereby finds and declares that said territory is uninhabited within the meaning of Government Code Section 35303 on the date of the adoption of this Resolution; that said territory is contiguous to the City of Santa Aha, lies in the County of Orange, State of Call- fornia, and is described as: Beginning at an angle point in the existing boundary of the City of Santa Ana as established by Ordinance NS-367 adopted March 23, 1959 by the City Council of said City of Santa Ana, s~id an~le point also being an angle point in the existing boundary of the City of G~rden Grove as establist~ed by Ordinance Nq. 217 adopted December 30, 1958, by the City Council of sai~ City of,Garden Grove and certified'by the Secretary of State of California January 29, 1959, said angle point being in the center line of Verano Street distant thereon N 0°41'40'' W 1318.04 feet from the center line of Smeltzer Avenue, said angle point being the Southeast corner of the North half of the Southeast quarter of Section 17, Township 5 South, Range 10 West, as shown on a map recorded in Book 51, Page 12 of Miscellaneous Maps, Records of the County of Orange, State of California; thence S 88009'20'' W, along said existing boundary of the -2- City of Santa Ana and along the South line of the North half of said Southeast quarter, 1321.22 feet to the West line of the East half of said Southeast quarter, and to an angle point in said City boundary of Santa Ana as established by said Ordinance NS-367; thence leaving said existing boundary as established by said Ordinance NS-367, N 0v 40' 34" W along said West line, 329.72 feet to the North line of the South half of the South half 0f the North half of said Southeast quarter and to an angle point in the existing boundary of said City of Santa Ana as established by Ordinanc~ NS-367; thence N 88009' 52" E, along said North line and said existing boundary, 1321.11 feet to the center line of said Verano Street, and to an angle point in said existing boundary of said City of Santa Ana as established by Ordinance NS-364; thence S 0°41'40'' E, along said center line and said existing boundary, 329.51 feet to the point of beginning. BE IT FURTHER RESOLVED: 'I~nat "VERANO AND ROBERTS - WEST ANNEX" is hereby designated as an appropriate name by which said territory shall be known for the purpose of this annexation. BE IT FURTHER RESOLVED: That notice is hereby given that November 6, 1961, at the hour of 7:30 P.M. in the Council Chambers, City Hall, Third and Main Streets, Santa Ana, California, is the time and place fixed at which said Council will hear protests against this annexation made by any person owning property within said territory. At any time before said hearing, any owner of real property within said territory may file written protest against this proposed annexation. Such protest shall state the name of the owner of the property affected and the description and area of the property in general terms, all as provided for in the California Government Code Section 35312.
