HomeMy WebLinkAbout61-280RESOLUTION NO. 61-280 GRANTING APPEAL ON APPEAL APPLICATION NO. 47 FILED BY CONTINENTAL BAKING COMPANY FROM ONE CONDITION IMPOSED PURSUANT TO A VARIANCE GRANTED UPON VARIANCE APPLICATION NO. 1551 BY THE ZONING ADMINISTRATOR WHEREAS, after hearing on notice, the Zoning Administrator granted a variance on Variance Application No. 1551, filed by CONTINENTAL BAKING COMPANY, which said variance was requested to permit an addition to existing warehouse, offices, etc. in the R-1 District; and said Variance No. 1551 was granted, subject to c~nditions; and WHEREAS, Appeal Application No. 47 was duly filed with the City Council by CONTINENTAL BAKING COMPANY appealing the imposition of one condition so imposed by the Zoning Administrator and requesting a modification of said condition; and WHEREAS, after hearing before the City Council; after careful consideration of the statements contained in and the materials accompanying the application; the testimony offered at the hearing; examination of all the facts established; and after determining that the use applied for by the Variance Application meets the re- quirements of Section 9250.8 of the Santa Aha Municipal code, it has been determined that the Variance should be granted, subject to the certain conditions, and that/one condition imposed by the Zoning Administrator should be modified. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Aha hereby grants Appeal Application No. 47 and grants a variance on Variance Application No. 1551, subject to conditions as follows: 1. That the owner place sidewalk on Walnut Street for the full width of the property involved in this variance. 2. That the owner dedicate vehicular access rights from this property to First Street and Walnut Street. -1- 3. That the sidewalk and the proposed drive approach on Walnut Street be installed in accordance with City of Santa Ana standards, except that said sidewalk shall be 6 feet wide and may be installed to the curb; provided, said however, that in any event,/sidewalk shall be so constructed as to properly align with a sidewalk to be provided on that property immediately West of the applicant's property, which said future sidewalk on said Westerly property shall be installed strictly in accordance with all City standards. 4. That a 6-foot solid brick wall be erected between the parking area and the adjoining residentially walled property to the West of said property. 5. That the area between the existing block wall and the future Walnut Street sidewalk be landscaped and maintained; said landscaping plan shall be submitted to the Planning Department for its approval prior to the approval of a building permit. 6. That development be otherwise according to plot plan. 7. That all of the above conditions be complied with prior to the issuance of a building permit by the Building Department.
