HomeMy WebLinkAbout61-287RESOLUTION NO. 61-2~7 AUTHORIZING CONDEMNATION OF REAL PROPERTY EAST OF BAKER STREET FOR THE EXTENSION OF THE NORTH HALF OF BROOK STREET TO THE EAST AND DECLARING THE NECESSITY THEREFOR WHEREAS, Brook Street as it now exists at a point approximately 120 feet East of the East line of Baker Street is inadequate in width, being but the Southerly half of said Street. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby find and determine that public interest and necessity require that Brook Street be widened and that property for the North half of said Street be acquired, and it is declared that the City do have, take and acquire a fee title for said purpose through and across certain land in the City of Santa Ana, County of Orange, State of California, described as: PARCEL 1: The Southerly 30.00 feet of the East half of Lot 10 of the Highland Street Tract as shown on a map thereof recorded in Book 6, Page 40, Miscellaneous Maps, Records of Orange County, California. PARCEL 2: The Southerly 30.00 feet of Lot 8 of said Highland Street Tract. PARCEL 3: The Southerly 30.00 feet of the West half of Lot 6 of said Highland Street Tract. BE IT FURTHER RESOLVED: That the City Attorney is hereby ordered and directed to bring an action in the name of said City in the Superior Court of the State of California, in and for the County of Orange, to condemn said property necessary to be taken as herein ordered and described, and to do all things necessary to prosecute said action to final determination. BE IT FURTHER RESOLVED: That the public interest, necessity and convenience require, and it is hereby ordered, that the City of Santa Ana, a municipal corporation, Plaintiff in the condemnation -1- action ordered herein, take i~ediate possession and use of the property herein ordered to be acquired upon compliance with the re- quirements-of the law applicable thereto; that the City Attorney report to the Director of Finance the amount of money required thereof, and that the Director of Finance shall deposit said amount with the Clerk of the Court. BE IT FURTHER RESOLVED: That the said action for condemnation of said property so to be acquired shall be taken in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain.
