Present: Absent: Councilmen Councilmen William Jerome, J.L.McBride, Thomas F. Larsen, Courtney R. Milford W. Dahl Chandler. Each member of the City Council having received copies of the Minutes of April 20, 1953, reading of the Minutes was dispensed with and approved on motion of Trustee Jerome, seconded by Larsen and carried. # In Re The Nayo~ a~ncu~eed tha~ ~hi~ is ~he ~ime anyplace fixed by this Hearing : Assess. The Clerk presented Affidavit of Publication, Affidavit cf Mailing Notice and Affidavit of Posting of Resolution of Intention No. 53-43. On motion of Councilman ~erome, seconded by McBride and carried, Affidavit 384 of P1~blication, Affidavit of Mailing Notice, and Affidavit of Posting of Resolution of Intention No. 53-43, were approved, received and filed. On ~he Mayor's request the Director of Public Works testified briefly concerning the work, extent of the assessment district and the g~ades.~i The Mayor requested the Clerk to read any written protests which had been received. The Clerk read w~itten protests of Mrs. Alice St.einberger, 1916 Maple Street and A.P.Jones, 2201 Maple Street. No persons being present desiring to orally protest concerning the work, extent of the assessment district and the grades, the Mayor requested the Director of Public Works to advise the 0ouncil what percent of the area of the property to be assessed for the proposed .improvement is represented by w~ltten protests filed with the Clerk, and the Director advised that the writte~ protests filed with the Clerk represented .63331% of the total area to be assessed for the proposed" In Re Resol. No.195 improvement, The Mayor announced the closing of the hearing. # On mqtion'Of Councilman .Jerome, seconded by Mcbride and carried, the followingResolution waaadopted: "Resolution Number 53-63 Resolution of the City 0ounoil of the 0ity cf Santa Aha, California, making findings and overruling protests and objections WHEREAS, the City Council of the City of Santa Aha by Re~olution No. 53J$3, adopted on the 30th day of March, 1953, declared its intention to order the construction of street work under the Improvement Act of 1911, Division ? of the Streets and Highways Code, and in said Resolution fixed the 4th day of May, 1953, at the hour of 7:30 P.M. in the Council Chambers of the City Council, as the time and place for the hearing before the City Council of protests and object- ions; and WHEREAS, at the time and place fixed in said Resolution No. 53-43, a hearing was duly held by this City 0ouncil at which all w~itten pro- tests or objections were duly presented and read and all persons desiring to be heard thereon were heard, and this City Council gave all persons present an opportunity to be heard in respect of any matter relating to the work proposed in said Resolution No. 53-~3 or the boundaries of the assessment district described therein, or in any way relating to the proceedings proposed by said Resolution No. 53-43; and WHEREAS, all persons desiring to appear and be heard have been heard, and this City Council has taken evidence relating to said proposed work, the boundaries of the proposed assessment district and the benefits to the property to be included in the proposed assessment district, and is fully informed in the premises; NOW, THEREFORE, the City Council of the City of Santa Aha, California,. DOES HEREBY FIND, RESOLVE, DETERMINE AND ORDER as follows: Section 1. That protests or obJ~ctions have not been made by owners of one-half of the a~ea cT the property to be assessed for said proposed work. Section 2. That all protests and objections are hereby overruled and denied.' Section 3. That no changes are to be made in the boundaries of the proposed assessment district or in the work proposed to be done, and the boundaries of the assessment district are defined and established as the boundaries described in the.resolution of intention, to-wit: Resolution No. 53-43, and the work proposed to be done is likewise defined and established as the work described in said Resblution No. 53-43, and reference is hereby made to said Resolution No. 53-43 for a full and complete description of said work and of the assessment district and for further particulars. Denney etux to permit const~uetion of a residence on the west half of Lots I and 2, Block l, Tract No. 696, to face St. Andmews Place and the portion of the p~operty involved is approx- imately 801 x 59.49' in size. # A communication was read from-the Planning Commission recommending denisl of variance application of Oliver E. Huseth to permit use of the living room in the existing residence at 1323 West Edinger as a dry cleaning and tailoring agency. A representative, on behalf of six persons living in the vicinity protested the establishment of the agency because of the increase in traffic. H~s. Donna Swank, renter of the property, presented a petition signed by sixteen pvoperty owners stating they have no objection to the proposed agency, and frOm Ben Liebermann, Department of Veteran's Affairs. Communication was presented by Maynsmd B. Huff of Sunshine Homes, stating that on January 10, 1952 Biltmore Homes purchased those lots in Tract 1508 which had Veterans Administration loan commlttments specificallY Lots I to 25 inclusive and Lots 27 to 82 inclusive; the L~maining Lots in Tract being retained by Sunshine Homes with the idea of selling for business purposes. On motion of T~ustee Jerome, seconded by Larsen and carried, the variance application was referred to the Councll as a whole and hearing continued until May 18, 1953. On motion of T~ustee Jerome, seconded by Lateen and carried, the communications, as submitted by H~s. Donna Swank were received, filed and made a part of the application. # On motion of T~ustee Jerome, seconded by McBride and carried, the following Ordinance entitled: "O~dinmuce prescribing the procedure for establishing set-back lines in the City of Santa Aha" was introduced, read, considered and placed on file for second reading. # On motion of T~ustee J~rome, seconded by Lsmsen and carried, Map Tract No. 1724, submitted by Rainspray, Inc. far the dedication of North Bristol, North Hesperian, alley, North Poplar, North Pacific, North Spruce, North Forest, Tamy Lane, Candie Avenue, Jody Avenue, Alona Street, 21st Street, 22nd Street and Edna Drive, for public use for highway purposes, was approved for official signatures, subject to in the sum of $149,252.45 the approval of the bcnd_Jby the City Attorney and Engineer if bond is submitted within one week from May 4, 1953. # On motion of T~ustee McBride, seconded by Jerome and carried, communication from the Planning Commission, together with copy of letter addmessed to Assembly Committee on Conse~vation, Planning and Public Works, at Bacramento, requesting that legislative action be taken for the purpose of controlling outdoor advertising along present and future freeways in the State, were received and filed. # Communication was read l~om the Planning Commission recommending approval of Tentative Map of Tract Nos. 1856-7-8, consisting of 151 lots, botuEled on the north by Wlllits Street, on the west by Raitt 390 Streetand on the south by the City Limits line, On motion of Trustee McBride, seconded by Jerome and carried, Tentative Map of Tract Nos. 1856-?-8 was approved subject to Conditions as set forth In Re Communication Plann. Comm. (industrlal area) by the Planning Commission. Communication was read from the Planning Oommission advising that it was the opinion of the Oommlesion that there should be a buffer strip between any M-1 and R-1 District, and for that reason, it wac voted to change that portion of land lying east of Standard Avenue. to an R-3 District. On motion of Trustee McBride, seconded by Jerome and carried, the communication was filed and ordered made a part of the In Re Tentative Map of Tract No. 182~ (Park Lane Estates) In Re Map of Tract No. 1531 In Re Request Childrenls Welfare Club Knights of Pythias industrial hearing to be held on May 18, 1953. · On motion of Trustee Jerome, seconded by Larsen and carried, Tentative Map of Tract No. 182~, consisting of sixty-five lots, submitted by Park Lane Estates, covering property bounded on the north by Memory Lane and on the east by Flower Street, was re-referred to the Plannln$ Commission with communication from the Division of Highways outlining its recommendations and with the notation that all street improvementeii oumbs and sidewalks be included in the recommendations to the Commission. Communication was read from Acting Representative, Children's Welfare Club Knights of Pythias, requesting permission to place donation coin boxes in and' about stores in the City in connection with a current drive to raise funds for a l~ee Day Clinic at 1138 South Duncan Avenue Los Angeles. On motion of Trustee McBride, seconded by Lateen and carried, the request was refe~ed to the Business Men~s Association In Re Communication Regional Water Pollution Control Board No. 8 In Re Request Charter Bus Transportation System for recommendation. # Communication was read from Executive Officer, Regional Water Poll~tlo~ Control Board No. 8, stating that a review was held'of the critical sewage disposal problems facing Orange County pending completion of the planned Joint works of the County Sanitation Districts, and quoting the Resolution which was adopted at meeting held April 17, 1953. On motion of Trustee McBride, seconded by Jerome and carried, the communication was received and filed. On motion of Trustee McBride, seconded by Larsen and carried, the request of Charter Bus Transportation System that bus stops be :: installed at Fourth and Main Streets and Seventeenth and Main Streets,. for the purpose of operating a bus service from Santa Aha to the In Re Report Diehl & Co. On recommendation of the Director of Public Works and on motion of Trustee McBride, seconded by Larsen and carried, the Clerk was author~ to advertise iz~_~/for bids for 20,000 feet of 6 inch cement lined Bell and Spigot, Class 150, cast iron pipe for water mains, to conform to Federal Specifications WW-p-421, Type I or Type II; bids to be opened June 1, 1953. # On motion of Trustee McBride, seconded by Jerome and carried, the Mayor was authorized to sign escrow instructions from Todds Creamery Corporation, for right-of-way purposes on Halladay Street. # On motion of Trustee Larsen, seconded by McBride and carried, the request of the Natiom~l Association of Letter Carriers, Branch 737, for permission to solicit funds on Thursday night, Nay 7, 1953, was ~ranted. Communication was read from Amalia A. Eastm-~ protesting the cutting down of the trees and shooting of birds by City employees, and tee ing that a tree be planted in the parkway in front of 1322 Orange Avenue. On motion of Trustee McBride, seconded by Jerome and carried 1~ matter was referred to the Park Superintendent. 811 Orange Avenue, Com~unication was read from Mary Fulle_E/protesting the shooting of birds by the Poundmaster and Police Officers, and on motion of Trustee McBride, seconded by Larsen and carried, the matter was referred to th City Manager for reply explaining the City's position. # On motion of Trustee Jerome, seconded by Lateen and carried, the toque of Jack Huneon that a loading zone be established at 1101 West Fifth Street was referred to the committee on curb usage. On motion of Trustee Jerome, seconded by Larsen and carried, the reports of the Police Department and Building Department, for the month of April, 1953, were received and filed. On motion of Trustee Jerome, seconded by Larsen and carried, the demands as audited by the Finance Committee were approved and the Clerk authorized to issue warrants for same. On motion of Trustee McBride, seconded by Jerome and carried, proper officials were authorized to execute Lease No. 13860, dated February 1, 1953, between the City and Pacific Electric Railway Company for the installation of an 8 inch water line on Halladay Street from Delhi Road to Dyer Road. The City Manager recommended that the low bid of R.J.Noble be accepted for the widening of South Main Street with the deletion of Item 12 which Mr. Noble had agreed to delete and recommendedthe adoption efa Resolution ordering that the City perform the work under Item 12 by force account and that gas tax funds not be used on any of said project, the same to be paid from the street bond monies now in the hands of the City.
