RESOLUTION NO. 60-28 GRANTING VARIANCE ON APPLICATION
NO. 1244 FILED BY JOE MONTAN0 WHERE PLANNING COMMISSION
RECOMMENDED DY IAL
WHEREA~, the Planning Commission after public hearing, on
notice, has recommended dmui~ of Variance Application No. 1244,
and the City Council after consideration has decided that said
Variance should be granted upon said conditions;
NOW, THEREFORE, BE IT RESOLVED: That the City Council hereby
grants a Variance on Application No. 1244 to permit the use of prop-
erty known and numbered as 633 East Central Street, S~uta Ana, Cali-
fornia, lying in t he County of Orange, State of California, des-
cribed as:
Lot 33, Block D, Emmett's Addition, including
portion of abandoned alley adjacent (Book 16
Page 13 Assessor's Maps City of Santa Anaj)
in an R-1 District, to be used for occupancy by two families,
either by using two living units in the main house, or by using the
main house as a single family residence, and by the use of the
garage apartment, it being expressly provided that if the garage
apartment be used for living quarters that the main house shall be
used only as a ~ ngle family residence ~nd that said lot shall not
have more than two dwelling units located thereon. Said Variance
is granted upon the conditions that:
(1) There shall be no more th~ two dwelling units.
(2) If~plumbing facilities or rough plumbing exist for three
dwelling units, all such plumbing shall be removed which would pro-
vide for one of said three dwelling units before any use and occup~ cy
certificate is granted for said property, and the Building Department
is directed to inspect for the existence and removal of any plumbing
for the third dwelling unit.
(3) A drive be blacktopped from the street to a point 28 feet
past the garage, and that a 28-foot area the width of the lot be
blacktopped in front of the garage.
(4) All of the above be completed prior to final inspection
and release by the Building Department.
B~ IT FURTHER RESOLVED: That the City Council finds that:
1. Special circumstances exist because of ~he size and
shape of the property.
2. Substantial property rights are involved because of the
uses of other property in the area, and
3. Material damage will not result to other p~ope~ties in
the area.
PASSED AND ADOP1ED by the City Council of the City of Santa
Ana at its regula~ meeting held on the l~th day of February, 1960.
