with and approved on motion of Councilman Jerome, seconded by
Dahl and carried, with the exception of Item 52 on page 4.33
that the wording "through at right angle" be corrected to

This being the date set for hearing on the Amendment Application of
E.C.Mtssildine, for a change of District classification of property
at the northeast and northwest corners of Sycamore and Pomona Streets,
and the northeast corner of Broadway and Pomona f~om R-1 and R-2 to
C-2 District, two petitions containing thirty-two signatures protest-
ing the reclassification of the property hereinbelow described were

and carried, the petitions were received and filed. J. Ogden Markel
stated his reasons for opposing the reclassification of the property
and was of the opinion that this is spot-zoning. Gustave Maler,
1616 South Sycamore Street stated he agreed with N~. Markel's object-
ions. Attorney M.S.Bernard, on behalf of E.C.Missildine, said the
proposed development would be an orderly expansion of a potentially
commercial area. The Chairman asked if the applicant would object
to a variance on the property in question. Attorney Bernard stated
that a variance would be a hind~anoe until the area develops as a
business district. It was moved by Councilman Dahl that the applican~
be granted a zone chan~e. Motion lost for want of a second.
Councilman Jerome stated he would prefer ~ wait until the Plannin~
Commission submitted their recommendations. It was moved by Council-i!
man Dahl, seconded by Larsen and .car. tied that the City Attorney prepar~
an ordinance reclassifying Lots 27 to 32 inclusive in Block "A" and
Lots ~8 to 31 inclusive in Block "B", Tract No. 531, facing Sycamore
Street, from the present classification to C-2 District. It was
moved by Councilman Dahl that the City Attorney prepare an Ordinance
to reclassify Lots 32 to 35 inclusive in Block "Bm, Tract No. 531,
facing Broadway from R-1 District to C-2 District, subject to the
granting of a ten foot strip to the City along the easterly boundary
of Broadway and the westerly boundary of the property. Motion lost
for want of a second. On motion of Councilman Jerome, seconded by
McBride and carried, the request that Lots 32, 33, 34 and 35, in Blockl
"B", Tract No. 531, facin~ Broadway, be reclassified from R-1 to
District,was denied.
On motion of Councilman McBride, seconded by Jerome and carried, the
reading of the Ordinance was waived. On motion of Councilman Jerome,
seconded by Dahl and carried, the following Ordinance entitled:
"Ordinance amending Chapter 4 of Article VII
of Santa Ana Municipal Code, correcting charges
for the installation of water.service and moving
of meters, p~ohibiting cross connections and
creating service charge"
was considered, designated Ordinance No. NS-9 and passed by the follow-

On motion of Councilman Jerome, seconded by Larsen and carried, the
Mayor was authorized to sign escrow instructions from Nelle Marie
Remsberg, Helen L. Adams and Katherine E. Remsberg, for an easement
deed on property described as the southerly ten fee~ of the easterly
140.5 feet of Lot 14, Block "B", Wiley Addition, being property at the
northeast corner of Seventeenth and North Main Streets.

On motion of Councilman McBride, seconded by Larsen and carried, the
recommendation of the Planning Commission was approved and variance
granted to Louis B. Byram to construct a small residence on the rear
of the lot at 815 North Van Ness Street.

On motion of Councilman McBride, seconded by Jerome and carried, the
recommendation of the Planning Commission was approved and variance
granted to Effie Neiderhiser to permit use of the building as it now
exists at 1077 West First Street for the sale of antiques and modern
gifts, subject to the conditions as imposed by the Planning
Commission.

On motion of Councilman Dahl, seconded by Larsen and carried, Map of
Tract No. 1457, submitted by Prudential Homes-Santa Ana, for the
dedication of Raymar Street, Richland Avenue and Bristol Street, for
public highway purposes, and bond in the sum of $28,000.00 were
approved and officials authorized to sign Map and Agreement. On
motion of 0ouncilman McBride, seconded by Dahl and carried, the con-
sents executed by Virgil C. and Celia Collier, Clarence E. and Blanche
M. Fowler, Mrs. Lilllan H. Cubbon and Kenneth J. Cawthon and H.J.
Stevens, were accepted and letters ordered filed.

Petitions were presented signed by ninety-seven residents and propert~
owners and from Julius Kreeger protesting the granting of a variance
to John S. and Vivian E. Geiger. On motion of Councilman Larsen,
seconded by Jerome and carried, the petitions and protest of Julius
Ereeger were received and filed. On motion of Councilman Larsen,
seconded by Jerome and carried, the recommendation of the Planning
Commission was approved and variance denied to John S. and Vivian E.
Geiger to construct an office building for retailing nursery and
florist stock at the southeast corner of Fruit and Grand Avenue.

Charlie Wolf, 313 East Pine Street, appeared before the Council statin
that he had cut the weeds in the alley at the rear of his property and
the trash collectors refused to pick up the trash and weed cuttings.
On motion of Councilman Dahl, seconded by Larsen and carried, the
matter of the trash collection was referred to the City Manager and
the cleaning of the weeds in the alley was referred to the City
Manager and Engineer.
Attorney Mark Soden presented petitions containing 111 names of
residents registering their objections to any extension of the Civic
Center to include the double block from Sixth to Eighth Street and
from Ross to Van Ness Avenue, The Chairman stated that the Council
had received numerous anonymous cards and the Council does not
recognize any card or communication which is not signed. Also, the
Council will recognize signed communications or discuss matters with
the citize~$. J.B.Dailey, 1035 West Sixth Street, stated his reason~
for objecting ~o the proposed library site. The Clerk read a card

Communication was read from C.A.Brockman requesting two thirty-foot

Communication was read from the City Engineer advising that improve-
ments within the boundaries of Tract No. 1623 have been completed,
and on motion of Councilman McBride, seconded by Lateen and carried,
bond filed by Melody Homes, Inc., in the sum of $27,000.00, was
ordered released and improvements within Tract No.. 1623 accepted as
completed in accordance with plans and specifications.

On motion of Councilman Jerome, seconded by Larsen and carried, the
.request of Rettew and Company that a 30-foot section of curbing in
front of 116 East Sixth Street, which is now used as a red-curb zone,
be designated as a loading zone, was referred to the committee on
curb usage for recommendation.

On motion of Councilman Jerome, seconded by Larsen and carried,
communication from Aaron R. McDaniel relative to damages to his d~ive-
way and sidewalk at 1044 West Pine Street due to the installation of
a stor~ drain by Nick Guho, contractor, was received, filed and
referred to the City Engineer.
On motion of CoUncilman Jerome, seconded by Larsen and carried,
communication from John L. Sentesy relative to damages to his property
at 1042 West Pine Street, in the sum of $192.15, due to the install-
ation of a.storm drain by Nick Guho, contractor, was received, filed
and referred to the City Engineer.

On motion of Councilman Jerome, seconded by Lateen and carried, the
claim of Fred H. Smith, im the sum of $36.50, for alleged injuries
sustained when he tripped on a broken section of sidewalk on the east
side of Broadway at Eighth Street, on July 16th, 1953, was referred
to the City Attorney and Insurance Carrier.

Tentative Map of Tract No. 1925, submitted by College Crest, Inc.,
consisting of 111 lots bounded on the west by English Street, on the
north by 15th Street, on the east by College Avenue and lying approx-i!

Communications were read from Minnie M. Wild, 636 North Ross Street,
protesting the purchase of additional property for public improvements
west of Ross Street and from Mrs. Anna M. Smith, 626 North Rose Street,
protesting the purchase of additional property for the Library site,
and on motion of Councilman McBride, seconded by Larsen and carried,
the communications were received and filed.

A petition was read signed by eight property owners in the 1400 block
South Hesperian Street.stating that on May 18th, 1953, the Council
approved a variance submitted by Oliver E. Huseth to operate a clean-
ing establishment at 1323 West Edinger Street and provided three
restrictions which the owners of the property has not complied with.
On motion of Councilman Dahl,eeconded by Lateen and carried, the
petition was referred to the Chief Building Inspector.

Communication was read from C.J.Poppa, 2035 Meriday Lane, protesting
the amendment application submitted by Allison Honer Company for
College Manor, Inc., reference the proposed rezoning of property
located west of Santa Aha Junior College and adjacent to the inter-
section of North English Street and Meriday Lane from R-1 to R-3 for
the construction of apartment type rental buildings, and the right of
Councilman Dahl to serve as a representative of 0ollege Manor, Incor-
porated. On motion of Councilman Jerome, seconded by Larsen and
carried, the communication was received and filed. Councilman Dahl
stated that he was a member of the Board of Directors of College Manor
Inc., in the beginning only as a "Dummy Director" and his interes~ was
only that of an Attorney to a client; that he has no financial interest
in this property and is no longer a member of the Board of Directors
as he resigned at the first meetingof the Board.

Communication was read from Mrs. B.D. Simmons, 1112 West Sixth Street,
protesting dogs running at large and on motion of Councilman McBride,
seconded by Larsen and carried, the communication was referred to the
City Manager to instruct the Animal Control Officer to contact
Mrs. Simmons.
0n motion of Counci]m=n Jerome, seconded by Larsqn and carried, the
claim of Alice R. Wlndlate, in the sum of approximately $5.00, for
damages sustained to her automobile on J~ly 15th, 1953, in the Alpha
Beta Parking Lot on North Sycamore Street, was referred to ~he City
Attorney and Insurance Carrier.

On motion of Councilman Dkhl, seconded by Larsen and carried, the
petition signed by William T. and Louise M. Reetz, Floyd S. and
Virginia E. Splawn, to abandoh that Vance Street right-of-way as it
exists east of Santiago Avenue, was referred to the Plannin~
Commission for recommendation.

report of the Police Department for the month of July, 1953, was
received and filed.
On motion of Councilman Jerome, seconded by Larsen and carried, the
notification of the State Board of Equalization of alcoholic beverage

received and permits granted.
On recommendation of the committee and on motion of Councilman Dahl,
seconded by Larsen and carried, the request of the Santa Aha P.T.A.
Council, that a member of the Police Department be mssigned,
on a part time or full time basis, to the position as a safety
coordinator for the schools, was denied and the City Manager inst~uotedil
to forward a communication to the Santa Ana P.T.A. advising of the
reasons for the denial of the request.
