CITY CLERK DATE JAN Z 4 2025 TIIIRD AMENDMENT TO AGREEMENT WITH Al PARTY RENTAL TO PROVIDE, INSTALL, AND REMOVE RENTAL EQUIPMENT FOR VARIOUS CITY EVENTS THIS THIRD AMENDMENT to the above -referenced agreement is entered into on January 21, 2025, by and between Al Party Rental ("Contractor"), and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California ("City"). RECITALS A. The parties entered into Agreement No. A-2022-050 ("Agreement") dated March 15, 2022, to provide equipment rentals for various events conducted by the City's Parks, Recreation, and Community Services Agency for a three (3) year term. The Agreement remains current and in effect through March 31, 2025. B. On October 4, 2022, the parties entered into a First Amendment to the Agreement (#A- 2022-192) to increase the overall annual compensation for services during the remainder of the term of the Agreement. C. On January 16, 2024, the parties entered into a Second Amendment to the Agreement (#A- 2024-012) to increase the overall annual compensation for years 2 and 3 of the Agreement to fund and accommodate additional events held by the City. D. The parties wish to further amend the Agreement to increase the overall compensation to increase the budget for the upcoming Tet Festival to be held in January 2025. There are no further amendments contemplated by this Third Amendment. The Parties therefore agree: 1. Section 2.a., Compensation, is hereby amended to increase the total not -to -exceed amount for the remainder of the Agreement by an additional $50,000.00. The total amount to be expended during the term of this Agreement shall not exceed $590,000.00. 2. There shall be no further amendments to the Agreement prior to its expiration. 3. Except as modified by this Third Amendment, all terms and conditions of the Agreement, as amended, shall remain in full force and effect.
