EASEMENTS FOR STREET PURPOSES FOR THE WIDENING
OF WARNER AVENUE FROM ORANGE AVENUE TO THE
EAST CITY LIMITS
WHEREAS, the rapid population growth in the City of Santa Ana
and in Orange County makes it necessary that Warner Avenue be widened
and improved east from Orange Avenue to accommodate the increasing
flow of traffic to the Newport Freeway.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Aha hereby finds and declares that the public interest
and necessity require that Warner Avenue be widened and improved from
Orange Avenue to the East City Limits to accommodate the east-west
flow of traffic and further require that said City do have, take and
acquire for street purposes that certain real property in the City of
Santa Ana, County of Orange, State of California, described as:
PARCEL 1:
An easement for street purposes over the Northerly 10.00
feet of Lot 37 of Tract 1575, as shown on a map recorded
in Book 56, page 36 and 37 of Miscellaneous Maps, records
of Orange County, California.
PARCEL 2:
An easement for street purposes over the Northerly 10.00
feet of Lot 38 of Tract 1575, as shown on a map recorded
in Book 56, page 36 and 37 of Miscellaneous Maps, records
of Orange County, California.
PARCEL 3:
An easement for street purposes over that portion of the
land allotted to James McFadden, as described in the
Final Decree of Partition of the Rancho Santiago de Santa
Ana, which was entered September 12, 1868 in Book "B",
page 410 of Judgments of the District Court of the 17th
Judicial District in and for Los Angeles County,
California, being that portion described in Deeds to
H. E. Huntington, Trustee, recorded June 7, 1909 in
Book 174, page 258 of Deeds and in Book 174, page 262 of
Deeds. lying Northerly of a line parallel with and distant
Southerly 40.00 feet from the center line of Delhi Road,
now known as Warner Avenue, as shown on a map filed in
Book 27, page 30 of Record of Surveys in the office of the
County Recorder of Orange County, California.
EXCEPTING that portion previously dedicated for street
purposes.
PARCEL 4:
An easement for street purposes over the Northerly 10.00
feet of Lot 12 of Tract 1575, as shown on a map recorded
in Book 56, pages 36 and 37 of Miscellaneous Maps, records
of Orange County, California.
BE IT FURTHER RESOLVED: That the City Attorney is hereby
ordered to bring an action in the name of the City of Santa Ana to
condemn said property necessary to be taken and to do all things
necessary to prosecute said action to final determination;
That the public interest, necessity, and convenience require,
and it is hereby ordered, that said City take immediate possession
and use of the property herein ordered to be acquired upon compliance
with the requirements of law applicable thereto as a right of way for
public use;
That said public improvement is planned and located in a manner
which will be most compatible with the greatest public good and the
least private injury;
That the City of Santa Ana, a municipal corporation, is
authorized and empowered to provide for the opening, extension,
widening, construction and maintenance of public streets and
highways within the City; and
That said action in condemnation shall be taken in accordance
with the provisions of the Code of Civil Procedure and the Constitution
of the State of California relating to eminent domain.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 16th day of May, 1966.
