HomeMy WebLinkAbout66-162RESOLUTION 66-162 OVERRULING THE DECISION OF THE PLANNING COMMISSION AND GRANTING A VAi%IANCE ON VA 66-40 FILED BY GEORGE L. ARGYROS WHEREAS, after hearing on notice, the Planning Commission DENIED a variance on Application VA 66-40, filed by GEORGE L. ARGYROS, and Appeal Application No. 184 was duly filed by the applicant presenting the matter to the City Council; and WHEREAS, the City Council, after public hearing on notice, has determined that said Application meets the requirements of Section 9250.8 of the Santa Ana Municipal Code; that the decision of the Planning Commission should be overruled; and that said Variance should be granted subject to the conditions set forth in the Staff Comments of said Variance. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby overrule the decision of the Planning Commission and does hereby grant a variance on VA 66-40 to permit the construction of a commercial center at the southwest corner of McFadden Avenue and Flower Street in an R-2 District with less than the required parking area. Said Variance is granted subject to the following applicable conditions: 1. That development be according to approved plot plan and eleva- tions except for minor modifications approved by the Planning Department; That a landscaped plan be submitted to and approved by the Planning Department; said landscaping shall be implemented and maintained. Planting areas shall be bounded by 6" high curbs. That compressors and other equipment be located inside of the building and insulated so as not to be disturbing to surrounding residences. 4. That the applicant install a sprinkler system in the landscaped area. That all proposed signs be directed away from surrounding residences and that they be approved by the Planning Department. 6. That the proposed wall be a decorative solid masonry wall constructed on the west property lines. That all signs shall be affixed to the front or street side of the building and no sign shall contain more than 20 square feet. In no case shall there be more than three separate signs. 8. That the proposed building be residentially designed so as to be compatible with surrounding development. 9. That all off-street parking be paved and marked to City standards. 10. That bumper stops be provided at each parking space. 11. That the driveway on McFadden Avenue be relocated to the westerly property line. THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE ISSUANCE OF A BUILDING PERMIT: 12. That an easement be provided for McFadden Avenue for a width of 40 feet; and for Flower Street for a width of 40 feet, -1- center line to property line, for street purposes and vehicular access rights except at street intersections and approved driveways and to include a 25 foot radius property line spandrel at the southwest corner of McFadden Avenue and Flower Street. NOTE: Access can be determined and approved prior to dedication. NOTE: Dedication shall be initiated by owner, through the Department of Public Works, at least two weeks prior to application for a building permit to avoid delay. 13. That the subdivider submit street improvement plans for McFadden Avenue and Flower Street. 14. That a new plot plan be provided to Public Works showing construction of street improvements to ultimate width and for approval of drives by the Traffic Engineer. THE FOLLOWING CONDITION IS TO BE COMPLIED WITH PRIOR TO ISSUANCE OF UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING SAFETY AND HOUSING: 15. That the owner place curb, gutter and sidewalk and pave up to the edge of existing pavement of McFadden Avenue and Flower Street. The new curb and gutter is to be placed 32 feet south of the center of McFadden Avenue and 32 feet west of the center line of Flower Street, and the new sidewalk is to be 8 feet wide from new curb to ultimate property line on both streets.
