AND DUTIES OF THE MUSEUM BOARD
WHEREAS, members of the Museum Board have inquired of the
City Council regarding their responsibilities and powers; and
W/qEREAS, as set out in the Charter of the City of Santa Aha,
the Museum Board is directly responsible to the City Council in its
capacity as an advisory agency; while the Museum Director is directly
responsible to the City Manager for all Museum administrative matters,
including budget preparation, personnel, operation, and maintenance
of the Museum; and
WHEREAS, Sections 900 through 906 of Article IX of the Charter
of the City of Santa Ana, Ordinances No. 939 and 1194, Sections
2350 through 2353 of the Santa Ana Municipal Code, and Sections 37540
through 37564 of the Government Code all pertain to the Museum and
Museum Board, but do not clearly delineate all of the responsibilities
and powers of this Board, but rather, in fact, appear to present
several conflicts in the respective areas of responsibility of the
Museum Board and the Director; and
WHEREAS, the City Attorney has ruled that the Charter of the
City of Santa Ana takes precedence in these areas of conflict;
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Aha does hereby adopt the following rules to clarify
and delineate the powers and duties of the Museum Board:
The Museum Board shall consider matters that may be referred to
it by the Museum Director, the City Manager, or the City
Council, and render such counsel and advice in regard thereto
as may be requested by the referring authorities.
On
its own motion, the Museum Board may make such studies and
investigations as it may deem necessary for the formulation
of its policies, plans, and procedures dealing with Museum
matters and report i~ findings and recommendations to the
Museum Director, the City Manager, or the City Council, or
to any or all of the above authorities as it may see fit.
The Museum Board may accept or reject all ~ems (except money)
which have been offered as gifts or loans to the Museum,
but only after they have been recommended for acceptance by
the Museum Director. It shall be part of the Museum
Director's professional responsibility to consider all items
offered to the Museum (except moneh) and to reject those
which he feels are not suitable. Such rejection shall be
final. If the gift or bequest is in the form of money, the
Museum Board and the Director shall recommend to the City
Manager its acceptance or rejection. The City Manager shall
forward these recommendations with his comments, if any, to
the City Council.
The Museum Board shall consider the annual budget during the
process of its preparation by the Museum Director and make
recommendations with respect thereto to the City Manager and
the City Council.
The Museum Board shall solicit to the fullest extent possible
the cooperation of all public and private agencies and
individuals interested in the Museum's programs, including,
but not limited to, the expansion of private financial
support for Museum activities.

The Museum Director shall keep the Museum Board fully informed
about all ~useum exhibits and other events and shall provide
ample opportunity for the Board to review the program for
such exhibits and events before completion of the program.
The Board may advise or recommend to the Director in regard
to any aspects of the prospective or scheduled program
affecting Museum policies.
The City Manager shall designate a secretary who shall record
the minutes for the Museum Board, as provided by the City
Charter.
8. If
a member of the Museum Board absents himself from three
regular meetings of the Board, consecutively, unless by
permission of the Board first had and obtained, expressed
in its official minutes, his office shall become vacant and
shall be so declared by the City Council.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 20th day of February, 1967.
