HomeMy WebLinkAbout67-029RESOLUTION 67-29 MODIFYING CONDITION NO. 2(b) IMPOSED BY THE PLANNING COMMISSION IN THE GRANTING OF A CONDITIONAL USE PERMIT ON APPLI- CATION C.U.P. 66-15, FILED BY THE SALVATION ARMY WHEREAS, after hearing on notice, the Planning Commission granted a Conditional Use Permit on Application C.Ui.P. 66-15, filed by THE SALVATION ARMY, to permit the construction of a church and youth center at 1708-1718 West Edinger Avenue, Santa Aha, California, with no bisecting streets; and Appeal Application No. 188 was duly filed by the applicant appealing the imposition of Condition No. 2(b) by the Planning Commission; and presenting the matter to the City Council; and WHEREAS, the City Council, determined that Condition No. 2(b) hereinbelow set out. after public hearing on notice, has should be modified to read as NOW, THEREFOP~E, BE IT RESOLVED: That the findings made and the conditions imposed by the Planning Commission are approved, except that Condition No. 2(b) of the Finding of Facts on said Conditional Use Permit is amended to read as hereinbelow set out, and said Conditional Use Permit is granted subject to the following conditions: 1. That a detailed plot plan showing all existing and proposed land uses, buildings and structures to be submitted to and approved by the Planning Commission; THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE ISSUANCE OF A BUILDING PERMIT: 2. That a continuing offer of dedication for street purposes for a period of ten years, ending on December 7, 1976, be provided for the following streets: a. Pomona Street for a width of 30 feet, center line to property line; Doreen Way for a width of 40 feet along the westerly portion of Parcel 8 from Edinger Avenue south to Stanford Street and to include a 25-foot property line spandrel at the southeast corner of Edinger Avenue and Doreen Way and a standard knuckle at Doreen Way and Stanford Street (per Exhibit A). 3. That an easement be provided for Edinger Avenue for a width of 50 feet, center line to property line, for street purposes and vehicular access rights except at driveways. (Access can be determined and approved prior to dedication.) NOTE: Dedication shall be initiated by owner, through the Department of Public Works, at least two weeks prior to application for a building permit to avoid delay. 4. That the subdivider submit street improvement plans for Edinger Avenue; 5. That all plans and surveys for the required improvements be completed by the owner's engineer and submitted to the Department of Public Works for approval. 6. That all elevations be on 1958 Orange County Survey Datum. 7. That the subdivider submit an on-site drainage flow plan and grading plan. -1- THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO ISSUANCE OF UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING SAFETY AND HOUSING: 8. That the owner provide sanitary sewer and storm drain facilities to meet with the approval of the Department of Public Works; 9. That the owner place curb, gutter and full width sidewalk and pave up to the edge of existing pavement on Edinger Avenue. The new curb and gutter to be placed 42 feet south of the center of Edinger Avenue. 10. That the owner pay sewer assessment reimbursement (Agree- ment 36) of $4.35 a front foot on Edinger Avenue.
